the petition, after publishing a notice of such hearing
at least 15 days prior to the hearing-and notifying by

subject property.

My first impression of So Hutchinson Island was that of a
magnificent, quiet retreat; and, so we invested in a vaca-
tion, pre-retirement.home. Admittedly, I wondered whatever
possessed the Town Fathers to write co~es that allowed high
density development on such a fragile parcel, of land, besides
not even having in place, a public sewerage system.
Now, fourteen, or so, years after granting building rights for
Sand Dollar Villas, the County proposes to build a ?;ater
Treatment Plant - better recognized as a Sewerage Treatment
Plant - diagonally south, across So Ocean Drive. Lack of fore-
sic2ht is now going to become the burden of buyers wb~o purchased
in good faith? In addition to the number of owners~-in Dune
';gatk, at Sand Dollar Shores there are, approximately 200 o~;ners
who, together pay~'~oout ~

STANDARDS OF P~EVIEWAS SET FORTH IN SECTION 10.01.00,
ST. LUCIE COUNT~ LAND DEVELOPMENT CODE
In reviewing this application for proposed rezoning, the Board of
County Commissioners shall consider and make the following
determinations:
The variance requested arises from a condition that the
particular physical surroundings, the shape, or
topographical Condition of the specific parcel of land
involved, would result in unnecessarF hardship for the
owner or developer, as distinguished from a mere
inconvenience, if-the provisions of this Section are
literally enforced, and the condition is created by the
regulations of this Section, and not by an action or
actions of the owner, developer or applicant;
The requested variance is a result of the specific and
limited developable area of the subject property. In
attempting to limit any encroachments or impacts on the
existing wetland communities found on the northwest
quadrant of the site., all development activities will be
limited to the upland portion Of the property. While it
is'technically possible to keep these structures out of
the required setback area, it has been determined that a
greater public benefit will be achieved by maintaining as
much of the existing native plant communities on this
property as possible. As a result, a limited encroachment
(see attached Exhibit A) is unavoidable.
The granting of the variance will not impair or injure
other property or improvements in the neighborhood in
which the subject parcel of land is located;
The granting of this variance will not impair or
otherwise injure other properties within the immediate
area. The granting of this variance would permit the use
of other properties in that it would allow the
construction of a sub-regional water reclamation facility
necessary for the reasonable use of the surrounding
properties on South Hutchinson Island.

The variance:granted is the minimum variance that will make
possible the reasonable use of the land, building or
structures; and
The granting of the requested variance is the minimum
necessary to,provide for the construction of the South
Hutchinson ISland Water Reclamation Facility.
The variance desired will not be opposed to the.general spirit
and intent of this ordinance or the St. Lucie County
Comprehensive Plan.
The requested variance is consistent with, and furthers the
following polices of the St. Lucie County Comprehensive Plan:

The above Findings are further supported by the following comments.
COMMENTS:
This petition would permit a limited encroachment of a portion of
the proposed South Hutchinson Island Water Reclamation Facility
into lands immediately adjacent to the Indian River Lagoon.
Section 6.02.02(C) of the St. LUcie County Land Development Code
establishes a minimum shoreline setback/vegetative buffer of 50
feet for all development activity adjacent to the Indian River
Lagoon. No clearing of land or other site disruptions are
permitted within this vegetative buffer zone, unless specifically
authorized through a variance procedure.
For a number of years State, County and local residents have been
working on plans that would ultimately provide for the elimination
of most, if not all, of the existing wastewater treatment plants on
South Hutchinson Island'. In early 1994, following a comprehensive
site selection process, the Board of county Commissioners acquired
this property for the specific purpose of constructing a water
reclamation facility that would serve the needs of the residents of
South Hutchinson Island. The final site plan/construction drawings
for the this facility are being prepared and construction
expected to begin during the second quarter of 1995.

The characteristics of the site have made it necessary to encroach
into a portion of the required shoreline setback area. Copies of
the overall preliminary development plan, with a detail of the
specific area under review are attached as Exhibits "A" & "B".
As indicated onthe site plan, the site layout for these facilities
have taken intoconsideration the presence of a substantial area of
wetlands in the northwest quadrant of the site as well as the
variety of existing vegetation found on the eastern and
southeastern upland portions of the site. In order to provide for
previouSly committed design considerations in the screening of this
facility from SR A-l-A, along with attempts to protect as much of
the existing on-site vegetation as possible, it has become
necessary to locate Clarifier #2, and the required access areas
around it, in shoreline setback area.
County staff has worked with the projects designers and have
developed what we believe to be an acceptable program for
addressing the impacts of building within this setback area.
Attached is a copy of the proposed landscaping plan for this site,
which includes a schematic restoration plan for this impacted
shoreline area. While much of the overall site contains healthy
and viable native plant cOmmunities, the area around the ClarifYing
Tanks are some of the sparsest in terms of native vegetation. The
impacts of locating these clarifiers in this area is expected t° be
minimal. The plied construction activities .in this area are not
expected to have impacts on any mangrove or other protected
plant/tree communities.
Staff recommends that the Board approve the following:

Permission to Advertise - BCC Shoreline Variance
As this Board is aware, the County is in the process of finalizing
the site plan for the new South Hutchinson Island Water Reclamation
Facility. As a part of the site layout process, and in trying to
minimize the impacts of this development on the remaining native
tropical habitat found on this site, it has been determined to be
necessary to encroach into the required 50 foot shoreline setback
from the Indian River Lagoon. This setback is required under the
provisions of Section 6.02.02(C) of the St. Lucie County Land
Development Code.
Specifically, the proposed site plan layout has the two clarifying
tanks encroaching into the required shoreline setback. The current
site layout indicates that the maximum encroachment by structures
will be approximately 30-35 feet, however, there will be .the need
for site disruption to take place to the"edge of the tidally
influenced wetlands. There are no plans to encroach into any
regulated wetlands. As permitted under Section 6.02.02(C)(4) and
Section 10.01.30 of the Land Development Code, this Board is
empowered to review variance requests from this minimum setback
standard. These permitted reviews may only be considered following
a formal public hearing that is held in- accordance with the
provisions of Section 11.00.03 and 11.00.04 of the Land Development
Code.
Staff recommends that the public hearing schedule outlined below be
authorized for review of the following request:

o the west 50 feet of the following described parcel:
a parcel of land in section 22, twp 36S, range 4tE,
St. Lucie County, Florida, bounded on the south by
a line parallel to and _6323.74 feet northerly
(measured at right angles) from the south line of
section 27; on the north by a line parallel to and
6712.25 feet northerly (as measured at right
angles) from the south line of section 27; on the
west by the waters of the Indian River; and on the
east by the waters of the Atlantic Ocean, less
right-of-way for Highway A-1-A.
