Terrance Mock) has petitioned for a change in zoning from RS-2 to AG for certain property located on the Northeast corner of Kings Highway and Graham Road. On April 23, 1987, the Planning and Zoning Commission voted unanimously to recommend that the Board approve the petition. Consistent.with Board policy, staff has drafted a resolution approving the proposed zoning change. RECOMMENDATION/CONCLUSION: Staff recommends that the Board deny the attached Resolution as drafted. Terrance Mock) for a Change in Zoning from RS-2 (Residential, Single Family - 20u/ac) to AG (Agricultural) On Tuesday April 28, 1987, you will be asked to review a petition on behalf of K. Terrance Mock for a change in zoning from RS-2 (Residential, Single Family - 2 du/ac) to AG (Agricultural) for property located along the north side of Graham Road, east of North Kings Highway. This petition was initiated by this Board during the December plan amendment review hearings in order to aOdress the concerns of the resiOents of thiS area about the need for a buffer between the planned commercial use of this-property and residential areas to the northeast ano east. On Thursday, April 23, 1987, the St. Lucie County P%anning anO .Zoning Commission voteO unanimously to recommenO approval of bnis petition as presenteo. In reviewing this petition, County staff finds that it must recommenO against applying the AG Oesignation to this property. Since the development proposal for this property was first presented to this Board for consiOeration, staff nas consistently been supportive of the proposeO use, a native plant nursery. We have however, expressed some concern over the depth of commercial encroachment along Graham RoaO anO were in fact supportive of a depth along this roaoway of only 600 to 800 feet from North Kings Highway. Staff's primary objection to the application of an agricultural zoning Oesignation at this location is, that it is not consistent with any of the Agricultural Location Requirements of the Growth Management Policy Plan and tne purpose anO intent of the agricuitural zoning Oistrict. Specifically, GMPP Policy Number 59, states that agricultural zoning classifications Should only be applieO as a means of protecting proOuctive agricultural uses anO not as means of April 2~, 1987 Page 2 Petition: B.C.C. - K. UnOer the GMPP Development Guidelines, it is the intention of this Board to encourage agricultural development in the areas west of the planned urban form and not to encourage the sporadic and spot application of the agricultural zoning designation within this planned urban area. Discussion was held at the Planning anO Zoning Commission meeting about the application of the Oevelopment guiOellne that permits the contlnueO use of agricultural uses even if the lanO use classification was changeO .to a nonagricultural use. Staff ls not proposing anythlng t~at woulO remove or Oilute the intention of this guiOellne. In summary, at this time, County staff would recommend denial of this petition. Attached for your review are copies of the March 16, 1987, memorandum to the Planning and Zoning Commission on this matter. St. Lucie County Board of County Commissioners heard a petition on Behalf of K. Terrance MOCk to rezone and plan amend, to commercial,a parcel of property at tne intersection of Graham Road and Kings Highway. At this public nearing, the Board granteO partial approval to this request and directed that a separate rezoning petition be initiated in tneir name that would propose to change the zoning on the East 273 feet of this property from RS-2 to AG. The petitioner proposes to establish a native plant nursery on this site similar to a companion facility in Palm Beach County. County staff nas carefully reviewed tn£s petition and finds that under the written polices anO purpose statements of the St. Lucia County Zoning OrOinance and the Growth Management Policy Plan tnl$.requesteO rezonlng to AG (Agricultural) snoulO not de approved.-Neitner oocument supports the granting of a productive agricultural zoning Oesignation in the future urban areas of this community. UnOer the AR-1 District Regulations a horticultural service facility is permitted as a Conditional Use. The Oesignation of this property as AR - I woulo, in staffs opinion, accommodate the neeOs of the applicant (Terrance Mock) and preserve the integrity of the County's LanO Use Regulations. Therefore, at this time, staff ,oulO recommend that the petitioner, St. Lucie County Board of County Commissioners, consioer amenOing tnis petition to AR-1. Since this petition was initiated on behalf of a private citizen, that individual shoulO also concur with this action. Terrance Mock) for a change in zoning from RS-2 (Residential, Single Family - 2 du/ac) to AG (Agricultural) located North side of Graham Road, approximately 1000 feet east of Kings Highway. Mr. Dan Harrell represented the petition for K. Terrance Mock. He explained that the petition was the result of a compromise concerning the land use amendment and rezoning of this property. The land use designation was amended to tourist commercial and as a means of addressing the concern of some of the residents in the area concerning the potential intensity of uses on that property, the Board of County Commissioners indicated it would initiate a petition for Agricultural zoning on the back property as opposed to rezoning all the Property to the requested General Commercial. He wanted to hear the public's and Staff's.comments. Mrs. Ruth Sizemore addressed the Board and stated she was not necessarily for or against this petition. The rezoning of this proposed-portion from Residential to Agricultural for the buffer zone is second choice to residential. She requested that area be kept a buffer zone for their neighborhood. Chairman Terpening referenced for the record one letter of sup- port from Fred C. Felice. Chairman Terpening asked for public comment in favor of or in opposition to the petition. There were none. Mr. Murphy said this petition was being presented by ~e Board of County Commissioners as an offered compromise by the Board as a result of the December Plan Amendment hearings. He said that there has not been a problem with the proposed use of the pro- perty as a plant nursery. Staff's concern was about the depth of commercial encroachment down Graham Road. Staff's earlier recom- mendations were for partial approval of this petition for a depth of 600-800 feet off Kings Highway and the balance of the property being retained in Residential classification. During the plan amendment review before the Board of County Commissioners they agreed to 1000 foot depth of commercial zoning and the entire property land use be designated as Commercial Tourist, the balance of the property 250 feet for Agricultural classification. In reviewing this petition, Staff was at a position it could not recommend for the agricultural designation primarily because of the way the agricultural district is set up in our zoning ordi- nance, i.e. the zoning for productive agricultural areas outside of the planned urban area of this community. This property is partially surrounded by agricultural uses. Staff offered the potential compromise position of AR-1. The AR-1 district would permit a plant nursery but it would also require a conditional use. If this Board and the Board of County Commissioners ulti- mately find some reason to disagree with that, specific reasons should be cited.
