The St. Lucie County Board of County Commissioners (Ralph E.

Commission voted unanimously to recommend that the Board approve

On Tuesday, May 26, 1987, you will be asked to review a
petition on behalf of Ralph E. Johnson for a C~ange in zoning
from RS-2 to AR-I. The subject parcel is located between
Nestwood High School and North Jenkins Road (future extension).
On Thursday, April 23, I987, the St. Lucia County Rianning and
Zoning Commission voted unanimously to recommend approval of this
petition.
After reviewing this proposed Change in zoning, County
staff recommends against tgis Petition. T~is recommendation is
based on the following. First, t~e purpose statement of the AG
zoning district suggests that the district is to provide and
Protect an environment suitable for commercial agriculture.
While it is correct that the Subject property is' currently being
used for agricultural pursuits, the lntent of the AG d/strict is
to provide an area to be used Primarily for agriculture in the
long term. The subject property is, however, located wltnin an
area proposed for future urban development.
A second factor ls the inconsistency of such a zoning Change
relative to the Growth Management Policy Plan (G.M.P.p). T~e
G.M.P.p. provioes for agricultural OeveIopment ano zoning in SU
(Semi-Urban) and AG areas of the County. While those areas
iOentified as RL (Low Density Residential) may continue to be
used for agricultural pursuits without penalty, they neeo not be
zoneo for PrOOuctive agriculture.

spirlt of offering a compromise proposal, staff woulo recommeno
that the petitioner eonsioer the zoning classification of AR-1

designation woulo be consistent wlth those properties to the
west, and would not be in conflict with the comprehensive plan
sznce the purpose of AR-1 is to provide a transition between
Agricultural and 'Urban uses.

Some months ago, Mr. Ralph JOhnson approached the Board
County Commissioners and requesteo that they initiate a rezoning
petition for that Portion of his Property designated RS-2
(Residential, Single Family _ 2 au/ac) to AS (Agricultural). it
was Mr. 3onnson's Position that nfs Property was Previously zoned
Agriculture (A-I), ne was not aware of the County Wide
Comprehensive Rezonings of 198~ and ne wisneo for his Property to
retain an agricultural classification. Pursuant to the Oire2tion
of t~e Boa~d of County Commissioners, stafff is now Or-sen~ing
this Petition for consideration.
In reviewing this oetition.,, stoic finds that it cannot
recommend approval of this request. /ne petitioned property is
located directly west of ~estwooo Senio~ High School,
NOrth Jenkins Road. ThOSe Properties immediately west of the
nigh school are designated RL (Low Oensity Residential) in the
Land Use Naps of the St. Lucie County Growth Management Policy
Plan. Those Properties to the west of this petitioned property
are designated SU (Semi Urban) in the Land Use Maps of the St.

INVOCATION
The Invocation was given by Mrs. Mabel Fawsett.
PUBLIC HEARING:
Petition of St. Lucie County Board of County Commissioners (Ralph
E. Johnson) for a change in zoning from RS-2 (Residential, Single
Family - 2 d.u./ac) to AG (Agricultural) located approximately
3/4 mile north of Orange Avenue, east of North Jenkins Road.
Mr. Ralph Johnson presented the petition. He explained that the
subject property has been in his family for over 40 years, and
has been used as a grove for the same length of time~ He said
that the zoning was changed in 1984 to RS-2. He said the proper-
ty is maintained as a grove and will remain so as long as he owns
it. He thanked those Board members that viewed the property for
taking the time to do so.
Chairman Terpening asked for public comment in favor of or in
opposition to the petition. There was no public comment. Chair-
man Terpening then closed the public portion of the hearing.
Mr. Murphy, representing Staff, explained that the petitioned
property and the general area is being used for agricultural
purposes. Under the previous zoning categories, the petitioned
property was zoned A-1. Staff had no particular objection to the
continued use of this property for agricultural purposes. How-
ever, based upon the way the zoning regulations are written,
there is a problem of rezoning this property to an agricultural
desi§nation when the agricultural zoning district is intended for
the areas outside the planned urban form for St. Lucie County.
Staff recommended that the agricultural designation not be
approved, but that a compromise of AR-1 be applied to this prop-
erty which is consistent with Mr. Johnson's property to the west
of North Jenkins Road. ._
Mr. Sciturro asked Mr. Murphy to explain the differences between
AG and AR-1. Mr. Murphy said the differences between the two are
greater than just residential density. The AG district was
designed and intended to be applied in the agricultural areas of
the County. The AR-1 district is a transitional type district
from the urban areas into the agricultural area. The AR-1 dis-
trict uses permit agricultural operations and related activities
but as conditional uses. The AG district has more intense condi-
tional uses, if related to agriculture and approved by the Plan-
ning and Zoning Commission and the Board of County Commissioners.
It is Staff's position that we are responsible to enforce the
land development documents as they are written. As these regula-
tions are written, it is inappropriate to apply agricultural
zoning this close to the urban areas of the community. Should
the Board feel there are grounds for exception, the Board would
need to be specific as to what those grounds are in any recommen-
dations made. This Board could ultimately ask the Board of
County Commissioners to review their whole position on this
issue.
Mr. Sciturro asked~:~r. Murphy if this involves-% boundary road
that designates w~ jn side should be AG and wk~ch should be AR-1.
Mr. Murphy replied that it involves a general policy or philos-
ophy of the Board of County Commissioners. He said that the low
density land use line stops roughly at Kings Highway, and the
semi-urban land use goes from Kings Highway west to Brocksmith
Road Corrider. That area was considered to be a transitional
district between agricultural~and urban uses. When the zoning
densities were applied in 1984, those land use guidelines were
used.
Mr. Carman asked Mr. Murphy why those properties east of Brock-
smith Road that are zoned AG are not petitioned to change them to
AR-1. Mr. Murphy explained that when the zoning maps were done
in 1984, Staff made short to intermediate term decisions/recom-
mendations to the Planning and Zoning Commission and the Board of
County Commissioners, keeping in mind the land use designation,
to classify properties west of Kings Highway AG. There are
several properties east of Kings Highway zoned AG despite Staff's
recommendation against.
Mrs. Ferrick said that during the hearin§-processes in 1984,
there were a lot of people that were not aware that their prop-
erties were changed. Those who were aware of the changes, went
throuah the hearinq process and in some instances the Board of
County Commissioners saw fit to allow those people to keep their
zoning designations. She state Page 76 of the Zoning Ordinance
that states, "All lands and structures currently zoned or prop-
erly used for agricultural purposes that are existing at the time
of the plan adoption, or subsequently zoned for agricultural use,
shall be deemed as conforming for any legally permitted principal
use in any planned land use district." She said this was to help
those who felt that their lands were being unfairly reclaSsified.
She said that the Florida Statutes is now recommendin§ through
the Florida Administrative Code that (9J-5'.021), "Florida's Agri-
cultural Goal - Florida shall maintain and strive to expand its
food, agricultural, ornamental, and horticultural, aquacult~ral,
forestries and related industries in order to be a healthy and
competitive force in the national and international marketplace."
She said that people didn't buy their property 40 years ago and
anticipate its future growth. From her viewpoint, she said she
is in favor of Mr. Johnson being granted AG zoning.
After considering the testimony presented during the public
hearing, excluding Staff Comments and Standards of Review set out
in Section 5.3.300 'of the St. Lucie County Zoning Ordinance, Mrs.
Fawsett made a motion that the Planning and Zoning Commission
recommend to the Board of County Commissioners grant the petition
of St. Lucie County Board of County Commissioners (Ra%~h E.
Johnson) for a change in zoning from RS-2 to A~. Mr. Russakis
seconded the motion, and upon roll call, the Board unanimously
votred in favor of the motion. Chairman Terpening informed Mr.
Johnson that the petition would be forwarded to the Board of
County Commissioners with a recommendation of approval.

Posting of Notice
(a)
The petitioner shall erect and conspicuously place
upon the subject property at least one notice which
shall contain the following information:
(i) Present zoning and requested rezoning ~ciassifi-
cation; and
(ii) Dates of scheduled hearings.
The ipetitioner shall also provide an affidavit
signed by the petitioner and notarized stating that
the ~notice was posted at' the initiation of the
-advertising period. Failure to maintain a conspic-
uous notice on the property shall not affect any
change or amendment of said Zoning Ordinance.
Section 5.1.200 Hearing Procedures
(1)~'- Setting the Hearing
When the Development Coordinator determines that an'appli-
cation for an amendment to the Official Zoning Atlas, an
application for an amendment to the text of this Or-
dinance, an application for a Planned Unit Development, an
application for conditional use approval, an application
for a major adjustment to a conditional use, an
application requesting a Class A Mobile Home be defined as
a detached single-family dwelling unit, or an application
for a variance is completed, or that a 'petition for an
administrative appeal has been filed, he shall notify the
appropriate decision making body so a public hearing may
be set and notice given in accordance with the provisions
of this Ordinance.
(2)
Examination and Copying of Application and Other Documents
Any time after the provision of notice, as required by
this Ordinance in Section 5.1.100, any person, upon
reasonable request, may examine the application or
petition in question, and the material submitted in
support or opposition to the application or petition in
the Office of the Development Coordinator during regular
