John T. Carmody appeared before the Board on behalf of the
petitioner to request approval of this petition. Mr. Carmody
also advised that petitioner would like to wi~~-tbe-~aque~st~d

staff (A-aC(-the proposed marzna in this project would not require
a commercial zoning, because it is not for a commercial project;
and also it must comply with the Fire Department Code

Preserve, and would be only for the use of the residents who live
in this developed area.
It was moved by Com. Culpepper, seconded by Com. Minix, to adopt

Management Policy Plan Land Use/Rezoning Amendments
As the Board is aware, on Tuesday, December 1, 1987, you are
sCheduled to review a series of Comprehensive Land Use Plan and
Rezoning Amendments as a part or,the December 1987 review cycle.
Under separate cover, you were transmitted copies of the staff
reports on these petitions. Attached, you will find a copy of the
agenda for this meeting.
Since the preparation of these reports/agenda, two items have
emerged that staff would like to bring to this Board's attention.
First, on the attached agenda, reference is made to a petition on
behalf of Ft. Pierce Investors Ltd., for a change in land use
and zoning. Please note that at the petitioners request, this
pro3ect has been withdrawn from consideration. This request for
withdrawal ~ was presented at the November 10, 1987, Local
Planning Agency/Planning and Zoning Commission review meeting.
Due to the fact that we had already set up advertising for this
petition, it was necessary to include this item on the agenda for
this meeting. Please note, since this item was withdrawn at the
LPA/P&Z meeting and no action was taken on it, this Board should
simply acknowledge its withdrawal for the record.
Secondly, in regard to petition number I-K, both this office
and after further review by the County Attorney we would at this
time offer an amended recommendation for this Board's
consideration. As you will recall, from reading our comments of
November 24, 1987, the petitioner is offering to withdraw from
consideration those parts of this petition that would add a
commercial land use designation to portions of this property. The
petitioner did request, following discussions with staff, that
the property along the St. Lucie River originally planned for a
commercial designation, be included in the requested amendment
from SU to RL. From a strict land planning point of view, staff
has no ob3ection to this requested change.

Subject: Plan Amen~nent Review - Agenda
The proposed inclusion of this property as residential would be
a lower intensity use than the commercial and generally
consistent with previous Board actions in regard to this type
request. However, upon further reflection we feel that there may
be some question in regard to the consistency with this action.
Both the County Attorney and I would be more comfortable, from a
challenge perspective, if the properties requested for commercial
use were simply dropped and left in their present land use state,
and that no action be taken to amend them to something else,
unless the appropriate procedures were followed. Staff has
reviewed this issue with the petitioner's representative and
determined that such an action would not have any adverse effect
upon the proposed development plans for this pro3ect.
If you have any questions on these two items, staff can
provide additional elaboration at the public hearings. If you
have any other questions, please let me know.

Petition of H. Wayne Huizenga, to amend the Future
Land Use Maps of the St. Lucie County Growth
Management Policy Plan from SU (Semi-Urban) to RL
(Low _Density Residential Development) and CG
(Commercial General).
On Tuesday, December 1, 1987, you will be asked to review a
petition on behalf of H. Wayne Huizenga, for a change in Land Use
from SU to RL and CG for property located along the the North
Fork of the St. Lucie River, in extreme southern St. Lucie
County. The petitioners propose to develop this property for
residential use.
On Tuesday, November 10, 1987, this petition was presented to
the St. Lucie County Local Planning Agency for review and
recommendation. At that hearing the petitioners representatives
requested that, in light of recent changes in the basic
development plan for this project, they would like to withdraw
the requested changes for Commercial Land Use. Referencing the
property description map included in this package, this request
would effect those cross hatched parcels designated with the
letter "A". The petitioner has further requested, that the parcel
of land along the St. Lucie River, originally to be considered
for a commercial designation, be included within the area for
consideration as Low Density Residential. The property at the
intersection of Becker and Gilson Roads, would retain its present
SU Land Use designation.

County staff has no objection to the proposed deletions. The
requested change for the property along the St. Lucie River from
CG to RL is consistent with this Boards policy of permitting a
lateral, or downward, movement in Land Use/Zoning designations
during the public hearing process.
Staff discussions with the petitioners representatives
indicate that there may ultimately be a request for some type of
commercial use at the intersection of Gilson and Becket Roads.
However, given the emerging character of this area, and the
proximity of sensitive environmental lands adjacent to this
property, this site offers itself as a prime candidate for
application of the County's new Planned Non-Residential
Development District, instead of a standard commercial zoning
application.
Noting the petitioners requested amendments, the Local
Planning Agency, by unanimous vote, agreed to forward a
recommendation of approval to the attached Draft Ordinance #8?-
95. Please note that this Ordinance, as being presented to this
Board, HAS NOT been modified to reflect the recent requests of
the petitioner. Any approval action by this Board in regard to
Draft Ordinance #87-95, must also include direction to amend the
legal descriptions contained therein, in accordance with the
petitioners proposals, if so desired.
In addition to the Draft Ordinance #87-95, please find
attached copies of our original staff report to the Local
Planning Agency on this petition, as well as the minutes of that
meeting. As required, this petition was reviewed by the
Department of Community Affairs and other interested Parties.
Comments were received from the Treasure Coast Regional Planning
Council (TCRPC), Department of Natural Resources (DNR), South
Florida Water Management District (SFWMD), and Martin County
Board of County Commissioners. For the most part, these agencies
expressed concern about the sensitive wetland environments in
this area and recommended that all design activities on this site
include best management practices in protecting the functions of
these areas. Furthermore, all development activities along the
shoreline of the St. Lucie River Aquatic Preserve must be in
accordance with the approved management plan for this estuary.
Staff has provided the petitioners representatives with copies of
this information and will be working closely with them through
the development processes.

Additional comments from the Regional Planning Council address
concerns expressed~ by both St. Lucie and Martin County officials
in regard to the impacts of any development on this site on
facilities within Martin County. The developers representatives
have been advised from the earliest contacts with my office,
about the need for careful coordination of this development plan
with both Local Governments, as well as the City of Port St.
Lucie.

COMMENTS
The petitioner is proposing to develop this property as a
mixed use resident~lal/commerc£al development. The master
development plan for tnls site lncludes a small commercial area
at the intersection of Gllson and Backer Roads along wltn a
commercial area around an existing cove on the Nortn Fork of the
St. Lucia River. The petitioner is proposing to preserve two
extensive wetlano systems on site as well as creatlng new wetland
areas to be used as a part of the storm water management system.
Under the aeveloper's proposed land use classification, the
maximum number of units that this site will accommodate is 885.
The actual number is expected to be less. Although tnis project
is not a clear Development of Regional Impact, staff would at
this time advise the developers that because of tnis project's
unique location, bOth Martin County and the City of Port St.
Lucia will be consulted in the eevelopment review process about
the impacts of this project in those jurisdictions.
Agency comment nas been received from the Florida Department
of Community Affairs (DCA), Treasure Coast Regional Planning
Council (TCRRC), Flolrida Oepartment of Natural Resources (DNR),
and tne South Florioa Water Management District (SFWMD). Both DCA
aris TCRRC are in concurrence with our recommendation tnat born
Martin County and the City of Port St. Lucia be consulted in
reviewing the eevelolpment impacts of tnis project, when finally
submitted. Staff nas been in contact witn the appropriate
officials of both communities in assessing this situation and
further contacts wili be made as warrantee. Staff is keenly aware
of the limiting factors on proviaing services in this area aha
will ensure tnat all proper mitigative steps are aooressea.
Both the the SFWMD and DNR nave commented on the possible
environmental impac~ts of this oeveiopment. The petitioner nas
been aoviseO through ail staff contac-ts, that prior to the
issuance of any Oevelopment approvaIs, ail outstanding questions
with regard to impacts upon the North Fork of the St. Lucie River
Aquatic Preserve and ali internai wetland areas must be aooresseo
to the satisfaction of the appropriate permitting eno reguIatory
agencies.

by Mr. Murphy, Mr. Carmody replied that the SU (Semi Urb~/~) land
use classification would remain in the two parcels located west
of Gilson Road. He said the remaining property is intended for a
private marina. Mr. Murphy said that RL is a sufficient land
category for a marina for the private uss of the residents of the
project.
i~c~ited northerly Of the subject parcel and Harbor Ridge is
located to the northwest. General Development Corporation owns
the [~roperty located to the west of Gilson Road. H6 further
st. ated that the petitioner wishes to come back at a later date
wi~h a PUD application, and intends to apply for density of 1. to
2 units per acre° The petitioner is presently negotiating for an
additional parcel of land (approximately 100 acres) located in
Nartin County, 20 acres of which is located in St. Lucia County.
PUD's will be applied for in both counties. Plans will include a
golf community similar to Harbour Ridge.
Regardin~ public services in the area, negotiations are bein~
made for additional services, specifically fire, ambulance ser-
vices, and sewage. These issues may be addressed at the time the
.pUD application is made. Martin Downs Utilities has made appli~
cation to Martin County for an extension into the subject area.
Hartin County has some concern regarding the road system because
the access to the development will be primarily through Martin
County over the Palm City Bridge.
~,~r. Lester Boese, Vice President of Harbor Ridge, Ltd., said that
his organization would like to see the development be handled as
a PUD in the future, as it would conform with surrounding zoning
designations.
~r. Albert Falk, assistant to the President of the Wide Waters
Property Owners Association, said there is concern of future
density being designated for up to 5 units per acre.
t4r. Virgil Smith, President of Greenbriar Village Homeowners
Association at Harbor Ridge, said they would oppose a PUD appli-
ca~ion if it would significantly increase the population density
of the area.

comments made by Messrs. Boese, Falk and Smith.
Regarding Staff comments, IMr. Murphy said Staff has no objection
to the request for land use designation change from SU to

Treasure Coast Regional Planning Council, Dept. of Natural
Resources, and SFWMD indicate general concurrence with Staff's
recommendation of approval.. The project development impacts
would be addressed by both Martin County officials and City of
Port St. Lucia officials due to its unique geographical location.
SFWMD and DNR have expressed concerns regarding potential en-
vironmental impacts at this site. There are extensive wetland
communities throughout' this area, both internal .and adjacent to

the petition, Chairman Terpening closed the public°r inportionOppositiOnof
hearing.
Considering the petitioner's presentation and Staff comments, Mr.
Carman made a motion that Ordinance No. 87-95, adjusting Parcels
1, 2, and 3 for withdrawal from the CG land use designation
request, be forwarded to the Board of County Commissioners with a
reco~mnendation of approval. Mrs. King seconded the motion, and
upon roll call, the Board voted unanimously in favor of the
motion.
Chairman Terpening informed the petitioner that the petition will
be forwarded to the Board of County Commissioners with a recom-
mendation of approval, including the above-mentioned adjustment.
The hearing adjourned at 11:25 P.M.

and Lano Development Regulation Act, Chapter 163, Florida Statutes,
Treasure Coas: Regional Planning Council reviewed the amendments to th~
Lucie County Future Land Use Element at its regular meeting on August
1987.
The following comments were approved by Council for transmittal to
State Department of Community Affairs pursuant to Sections 163,3184(1)

Evaluation
The proposed amenaments to the Future Land Use Element have been revi
in accordance with the requirements of Chapter 163, Florida Statu
Council's review procedures, and Council's adopted comprehensive plan.

.Based on the information provided, the proposed amendments do not
appear to be in conflict or inconsistent with the policies
contained in the Regional Comprehensive Policy Plan.
Prior to the approval of the land use changes associated with
Items A and B, the appropriate analysis should be completed
demonstrating that U.S. I has the available capacity to
accommodate the additional highway trips. The analysis should
al'so" demonstrate that an acceptable level of service can--be
maintained on U.S. 1 at buildout of the area. Also, Indian River
County has expressed concerns over increased strip commercial
development along U'.S. I (see attached letter).
Prior to approving the land use change associated with Item
St. Lucie County should work with the City of Port St. Lucie and
Martin County to assure that all multijurisdictional transpor-
tation impacts are adequately addressed (see the attached letter

adjacent to the North Fork of the St. Lucie River Aquatic
Preserve, development of this property should be consistent with
the Department of Natural Resources (DNR) Management Plan for
this aquatic preserve. A letter from the DNR is attached which
.expressesthis parcel, concerns over the ~ossible development of a marina on

Item F exceeds the DRI threshold. The 100 percent DRI threshold
is 5uO spaces. Because of public objections to the proposed
project (see attached letters) and because regional issues have
not been identified, final consideration of the proposed land use
change to Commercial Tourist should, perhaps, wait until a report
and recommendations can be developed that evaluate regional
issues.
For Item F, some of the regional issues of concern are related to
land use compatibility, the provision of services, and the impact
on water resources. The proposed density of up to 9 units/acre
may not be compatible with the surrounding agricultural land use.
The 76.7 acre parcel does not seem large enough to allow this
density and provide adequate buffers from
noise and pesticides
associated with nearby agricultural activities. Regional
concerns are also warranted with regard to water supply and
sewage disposal. This is especially important when recreational
vehicles are involved, because an overnight visitor to the park
may leave behind several days worth of wastewater and take
several days worth of fresh water when leaving. Finally, this
site is very close to Tenmile Creek which drains into the North
Fork of the St. Lucie River. Depending on the design of the
drainage system and wastewater facilities, a development of this
intensity may have an adverse impact on the quality and quantity
of water entering the North Fork of the St. Lucie River and
Aquatic Preserve.

1. H. Wayne Huizenga, by Agent: Jack Carmody presented a
petition to amend the future land use classification set forth in
the St. Lucie County Growth Management Policy Plan from SU (Semi-
Urban) to RL (Residential Low Density Development) and CG
(Commercial General) for the property described below.
2. The St. Lucie County Local Planning Agency, after
holding a public hearing on November 10, 1987 of which due notice
was published at least seven (7) days prior to said hearing and
all owners of property within five hundred feet (500') .were
notified by mail of said hearing, has recommended that the Board

B. FINDING OF CONSISTENCY.
This Board specifically determines that the approved
change in future land use plan is consistent with the policies
and objectives contained in the St. Lucie County Growth
Management Policy Plan.
C. CHANGES TO ZONING MAP.
The St. Lucie County Community Development Director is
hereby authorized and directed to cause the changes to be made on
the Official Zoning Map of St. Lucie County, Florida, and to make
notation of reference to the date of adoption of this ordinance.
D. CONFLICTING PROVISIONS.
Special acts of the Florida legislature applicable only
to unincorporated areas of St. Lucie County, County ordinances
and County resolutions, or parts thereof, in conflict with this
ordinance are~hereby superseded by this ordinance to the extent
of such conflict.
E. SEUERABILITY.
If any portion of this ordinance is for any reason held
or declared to be unconstitutional, inoperative or void, such
holding shall not affect the remaining portions of this
ordinance. If this ordinance or any provision thereof shall be
held to be inapplicable to any person, property or circumstances,
such holding shall not affect its applicability to any other
person, property or circumstances,

Mr. Jack Carmody, Esquire, presented the petition. He said
although Staff had favorably reviewed
the petition, concerns b~
adjacent property owners relative to the petition's co~ercial~z
request had been brought to his attention. Due to these legit~
ma~e concerns of neighboring properties, ~. Carmody requested ~~
withdraw the CG land use request. Mr. Murphy said this with-
drawal involves Parcels 1, 2, and 3. In response to questioning
by Mr. Murphy, Mr. Carmody replied that the SU (Semi Urban) land
use classification would remain in the two parcels located west
of Gilson Road. He said the remaining property is intended for a
private marina. Mr. Murphy said that RL is a sufficient land us~
' category for a marina for the private use of the residents of the
pro3ect.
Mr. Carmody then explained that the subject property is located
near Harbour Rid~' and Wide Waters subdivisi~~. Wide Waters is
located northerly~f the subject parcel, and~rbor Ridge is
located to the northwest. General Development Corporation owns
the property located to the west of Gilson Road. He further
stated that the petitioner wishes to come back at a later date
w~th a PUD application, and intends to apply for density of 1, to
2 units per acre. The petitioner is presently negotiating for an
additional parcel of land (approximately 100 acres) located in
Martin County, 20 acres of which is located in St. Lucie County.
PUD's will be applied for in both counties. Plans will include a
golf community similar to Harbour Ridge.
Regarding public services in the area, negotiations are being
made for additional services, specifically fire, ambulance ser-
vices, and sewage. These issues may be addressed at the time the
PUD application is made. Martin Downs Utilities has made appli-
cation to Martin County for an extension into the subject area.
Martin County has some concern regarding the road system because
the access to the development will be primarily through Martin
CounTy over the Palm City Bridge.
Mr. Le.ster Boese, Vice President of Harbor Ridge, Ltd., said that
his organization would like to see the development be handled as
a PUD in the future, as it would conform with surrounding zoning
designations. .
Mr. Albert Falk, assistant to the President of the Wide Waters
Property OWners Association, said there is concern of future
density being designated for up to 5 units per acre.
Mr. Virgil Smith, President of Greenbriar Village Homeowners
Association at Harbor Ridge, said they would oppose a PUD appli-
cation if it would significantly increase the population density
of the area.
Mr. William Atterberry, a resident of Gilson Road, reiterated
comments made by Messrs. Boese, Falk and Smith.
Regarding Staff comments, Mr. Murphy said Staff has no objection
to the request for land use designation change from SU to RL.
The granting of this request would offer the petitioner the
opportunity to reappear before this Board with specific develop-
ment plans. Comments from the Dept. of Com~aunity Affairs, the
Treasure Coast Regional Planning Council, Dept. of Natural
Resources, and SFWMD indicate general concurrence with Staff's
recommendation of appreval. The project development impacts
would be addressed by both Martin County officials and City of
Port St. Lucie officials due to its unique geographical location.
SFWMD and DNR have expressed concerns regarding potential en-
vironmental impacts at this site. There are extensive wetland
communities throughout' this area, both internal and adjacent to
the St. ~ucie River. These issues would be addressed at
of final development plan reviews.
}{earing no further public comment in favor of or in opposition
the petition, Chairman Terpening closed the public portion of
hearing.
Considering the petitioner's presentation and Staff comments, Mr
Carman made a motion that Ordinance No. 87-95, adjusting Parcels'
1, 2, and 3 for withdrawal from the CG land use designation
request, be forwarded to the Board of County Commissioners with a
recommendation of approval. Mrs. King seconded the motion, and
upon roll call, the Board voted unanimously in favor of the
motion.

Mr. Jack Carmody, Esquire, presented the petition He said th~
although Staff had favorably reviewed the petition concerns bl~ _~
adjacent property owners relative to the petition's commercial ~
request had been brought to his attention. Due to these legit~
mate concerns of neighboring properties, Mr. Carmody requested ~
withdraw the CG land use request. Mr. Murphy said this with-
drawal involves Parcels 1, 2, and 3. In response to questioning
by Mr. Murphy, Mr. Carmody replied that the SU (Semi Urban) land
use classification would remain in the two parcels located west
of Gilson Road. He said the remaining property is intended for a
private marina. Mr. Murphy said that RL is a sufficient land use
category for a marina for the private use of the residents of the
project.
Mr. Carmody then explained that the subject property is located
near Harbour Ridge and Wide Waters subdivision. Wide Waters is
located northerly of the subject parcel, and Harbor Ridge is
located to the northwest. General Development Corporation owns
the property located to the west of Gilson Road. He further
stated that the petitioner wishes to come back at a later date
with a PUD application, and intends to apply for density of 1 to
2 units per acre. The petitioner is presently~negotiating for an
additional parcel of land (approximately 100 acres) located in
Martin County, 20 acres of which is located in St. Lucie County.
PUD's will be applied for in both counties. Plans will include a
golf community szmilar to Harbour Ridge.
Re~arding public services in the area, negotiations are being
made for additional services, specifically fire, ambulance ser-
vices, and sewage. These issues may be addressed at the .time the
PUD application is made. Martin Downs Utilities has made appli-
cation to Martin County for an extension into the subject area.
Martin County has some concern regarding the road system because
the access to the development will be primarily~through Martin
County over the Palm City Bridge.
Mr. Lester Boese, Vice President of Harbor Ridge, Ltd., said that
his organization would like to see the development be handled as
a PUD in the future, as it would conform with surrounding zoning
designations.
Mr. Albert Falk, assistant to the President of the Wide Waters
Property Owners Association, said there is concern of future
density being designated for up to 5 units per acre.
Mr. Virgil Smith, President of Greenbriar Village Homeowners
Association at Harbor Ridge, said they would oppose a PUD appli-
cation if it would significantly increase the population density
of the area.
Mr. William Atterberry, a resident of Gilson Road, reiterated
comments made by Messrs. BOese, Falk and Smith.
Regarding Staff comments, Mr. Murphy said Staff has no objection
to the request for land use designation change from SU to RL.
The granting of this request would offer the petitioner the
opportunity to reappear before this Board with specific develop-
ment plans. Comments from the Dept. of Community Affairs, the
Treasure Coast Regional Planning Council, Dept. of Natural
Resources, and SFWMD indicate general concurrence with Staff's
recommendation of approval. The project development impacts
would be addressed by both Martin County officials and City of
Port St. Lucie officials due to its unique geographical location.
SFWMD and DNR have expressed concerns regarding potential en-
vironmental impacts at this site. There are extensive wetland
communities throughout this area, both internal and adjacent to

the St. Lucie River. These issues would be addressed at
of f'inal development plan reviews.

the petition, Chairman Terpening closed the public portion of the~

Considering the petitioner's presentation and Staff comments, Mr.
Carman made a mo~ion that Ordinance No. 87-95, adjusting Parcels
1, 2, and 3 for withdrawal from the CG land use designation
request, be forwarded .to the Board of County Commissioners with a
recommendation of approval. Mrs. King secondedi the motion, and
upon roll call, the Board voted unanimously in favor of the
mo~ion.
Chairman ~erpening informed the petitioner that the petition will
be forwarded to the Board of County Commissioners with a recom-
mendation of approval, including the above-mentioned adjustment.
The hearing adjourned at 11:25 P.M.
