The St. Lucie County Local Planning Agency, after holding a public hearing on January 28, 1988, of which due notice was published at least seven (7) days prior to said hearing and all owners of property within five hundred (500') feet were notified by mat1 of said hearing, has recommended that the Board amend the future land use classification set forth in the St. Lucie County Growth .Management Policy Plan from SU (Semi Urban) to CG (Commercial General) for the property described below. oo 577 908 3. Special acts of the Florida Legislature applicable only to unincorporated areas of St. Lucie County, County Ordinances and County Resolutions, or parts thereof, in conflict with this Ordinance are hereby superseded by this ordinance to the extent of such conflict. E. SEVERABILITY. If any portion of this ordinance is for any reason held or declared to be unconstitutional, inoperative or void, such holding shall not effect the remaining portions of this ordinance. If this ordinance or any provision thereof shall be held to be inapplicable to any person, property, or circumstances, such holding shall not effect its applicability to any other person, property or circumstances. F. APPLICABILITY OF ORDINANCE. This ordinance shall be applicable throughout the unincorporated area of St. Lucie County. G. FILING WIT~ THE DEPARTM~NT OF STATE. ' On Thursday, January 28, 1988, the St. Lucie County Local Planning Agency voted unanimously to recommend approval of this petition. 'County staff has reviewed this petition and determined it consistent with the land development policies of the St. Lucie County Growth Management Policy Plan and this Board, in regard to development around the St. Lucie County International airport. Attached you will find a copy of the original staff report and minutes of the January 28th meeting. In addition, attached is a copy of Draft Ordinance #88-35 which would grant approval to this requested change in land use. County staff recommends approval of Draft Ordinance #88-35. Mrs. Ferrick questioned Staff about future plans for stacking lanes. Mrs. Scanlon responded that at the time of site plan review, traffic studies will be required. Mr. Murphy interjected Kings Highway is also State Road 713 and is maintained by the State. The County currently does not have any improvement plans in that area. If left and right turn lanes are required, this issue will be addressed at the time of construction. Hearing no public comment in favor of or in opposition to the petition, Chairman Terpenin9 closed the public portion of the hearin9. After considering the testimony presented durin§ the public hear- ing, including Staff comments, and the Standards of Review as set out in Section 5.3.300 of the St. Lucie County Zoning Ordinance, Mrs. King made a motion that the Local Planning Agency recommend that the St. Lucie County Board of County Commissioners grant approval to the petition of Joseph and Lucille Heintz for a change in land use from SU (Semi Urban) to CG (Commercial, General). Mr. Sciturro seconded the motion, and upon roll call, the Board voted unanimously in favor of the motion. Chairman Terpening informed the petitioner's agent that the peti- tion will be forwarded to the Board of County Commissioners with a recommendation of approval.
