HENDRY, III BY AaENT: GENEVIEVE JACKSON TO CHANGE FUTURE LAND USE CLASSIFICATION FROM RH TO CG MEMO RANDUM TO: FROM: DATE: SUBJECT: County Administrator County Commission Planning Administrator November 30, 1987 December 1, 1987, County Commission Review of Growth Management Policy Plan Land Use/Rezoning Amendments As the Board is aware, on Tuesday, December 1, 1987, you are scheduled to review a series of Comprehensive Land Use Plan and Rezoning Amendments as a part oftthe December 1987 review cycle. Under separate cover, you were transmitted copies of the staff reports on these petitions. Attached, you will find a copy of the agenda for this meeting. Since the preparation of these reports/agenda, two items have emerged that staff would like to bring to this Board's attention. First, on the attached agenda, reference is made to a petition on behalf of Ft. Pierce Investors Ltd., for a change in land use and zoning. Please note that at the petitioners request, this pro3ect has been withdrawn from consideration. This request for withdrawal ~ was presented at the November 10, 1987, Local Planning Agency/Planning and Zoning Commission review meeting. Due to the fact that we had already set up advertising for this petition, it was necessary to include this item on the agenda for this meeting. Please note, since this item was withdrawn at the LPA/P~Z meeting and no action was taken on it, this Board should simply acknowledge its withdrawal for the record. Secondly, in regard to petition number i-K, both this office and after further review by the County Attorney we would at this time offer an amended recommendation for this Board's consideration. As you will recall, from reading our comments of November 24, 1987, the petitioner is offering to withdraw from consideration those parts of this petition that would add a commercial land use designation to portions of this property. The petitioner did request, following discussions with staff, that the property along the St. Lucie River originally planned for a commercial designation, be included in the requested amendment from SU to RL. From a strict land planning point of view, staff has no ob3ection to this requested change. November 30, 1987 Page 2 Subject: Plan Amendment Review - Agenda The proposed inclusion of this property as residential would be a lower intensity use than the commercial and generally consistent with previous Board actions in regard to this type request. However, upon further reflection we feel that there may be some question in regard to the consistency with this action. Both the County Attorney and I would be more comfortable, from a challenge perspective, if the properties requested for commercial use were simply dropped and left in their present land use state, and that no action be taken to amend them to something else, unless the appropriate procedures were followed. Staff has reviewed this issue with the petitioner's representative and determined that such an action would not have any adverse effect upon the proposed development plans for this pro3ect. If you have any questions on these two items, staff can provide additional elaboration at the public hearings. If you have any other questions, please let me know. Smith) to amend the Future Land Use Maps of the St. Lucie County Growth Management Policy Plan from RH (High Density Residential Development) to CG (Commercial General). On Tuesday, December 1, 1987, you will be asked to review a petition on behalf of Archie A. Hendr~ III, for a change in Land Use from RH to CG for property located along the west side of South U.S. #1, at the intersection of Savannah Club Boulevard/La Buona Vita Drive and South U.S, #1. The petitioner proposes a future commercial development on this property. On Tuesday, November 10, 1987, this petition was presented to the St. Lucie County Local Planning Agency for review and recommendation. At that hearing no public comment, with the exception of the petitioners representatives, in support or opposition to this petition was received. Following this public hearing, the Local Planning Agency, by unanimous vote, forwarded a recommendation of approval of this petition to the Board of County Commissioners. File No.: PA-8?-010 In addition to Draft Ordinance #87-92, please find attached copies of our original staff report to the Local Planning Agency on this petition, as well as the minutes of that meeting. As required, this petition was reviewed by the Department of Community Affairs and other interested agencies. Comments were received from the South Florida Water Management District in regard to the possible location of on-site isolated wetlands. As indicated in our comments to the Local Planning Agency, review of this site through ~both field inspection and aerial photography does not appear t© indicate the location of any such areas on the petitioned property. However, immediately offsite, there is a large man made wetland area, created as a Dart of the La Buona Vita Mobile Home development and to the southwest is a probable wetland area associated with t~he North Fork of the St. Lucie River. It is not anticipated tkat development on this site will significantly effect either system. However, all applicable storm water management and environmentlal protection regulations must be complied with as development proceeds on this site. Staff recommends approval of. By a unanimous vote, Resolution #85- 281 was approveO granting this request. It was the intention of the petitioner, Peter C. Smit~, to Develop a mixeO commercial/resiDential Development on this- site. These Development plans never came to fruition. When presented to the Board of County Commissioners at the transmittal stage of this amendment process, this petition was under the name of its receiver, First Citizens Feaeral Savings and Loan. Since that time, the property nas been acquireO ny a new oeve.lopment interest ano the petition nad been amenoeo accorOingly to reflect t~is change in ownership. Agency review comments nave been received from the Florloa Department of Community Affairs, the Treasure Coast Regional Planning Council and the South Florida Water'Management District. Staff review~of the property indicates the apparent areas of concern as being along the south property line. Hendry, III, by Agent~ Genevieve Jackson, to amend the Future Land Use Maps of the St. Lucie Co%mty Growth h~anagement Policy Plan from RH (High Density Residential Develop- ment) to CG (General Commercial Development) for property located on the west side of South U.S. 1 at La Buona Vita Drive. Genevieve Jackson presented the petition. She explained that the surrounding existing zonings include CG and CT, and property to the south that is within the city limits of Port St. Lucie is zoned GU (General Use). She said that there are no current Plans for the subject property. The property was zoned CG at one time; however, the former owner petitioned to'have the property zoned RM-18 for a multi-family project which never developed. Hendry purchased the subject property along with property that fronts on U.S. 1 that already had.the CG designation. The peri- tioner wishes to incorporate the properties into th~ s~m~ CG designation to afford more flexibility in develo~snt. Ms. Jackson said that Staff had found that the requested change does not conflict with the intent of the C~4PP, and that it is consistent with the commercial development policies of the G~PP. In response to questioning by Mr. Sciturro, Ms. Jackson replied that Parcels 8 and 9 are strip centers, and the property to the south is owned by General Development Corporation. There is an existing lake to the west of the property~ which surrounds the rear portion of the subject property.
