Dear Local Government Official:
Provisions for the amendment of local comprehensive plans
under Section 163.3187, Florida Statutes, provide that plan
amendments may be made no more than two times per calendar year
unless it is an allowed exception.
The 1986 Legislature amended these provisions to allow local
governments to exempt "small scale development" amendments. It
also required that each local government submit a semiannual
report on small scale amendments.
To meet this requirement, please indicate on the enclosed
form the requested information regarding each of the plan
amendments that were processed as small scale development
exemptions ~uring the period from January 1, 1987 through June
30, 1987. If no small scale development amendments were
processed during this period, please indicate "Not Applicable" on
the form. However, if it is your policy to not utilize the small
scale development exemption, please indicate this on the form.
In accordance with the statute a completed report is due to
the Department by July 1, 1987. However since your report must
document any amendments through June 30 the report forms will be
accepted by the Department until July 30, 1987 and should be
sent to: '

amend the future land use classification set forth in the St.
Lucie County Growth Management Plan from RL (Low Densit~

hereby authorized and directed to cause the changes to be made on
the OffiCial Zoning~Map of St. Lucie County, Florida, and to make
notation of reference to the date of adoption of this ordinance.
D. CONFLICTING PROVISIONS.
Special acts of the Florida le§islature applicable only
to unincorporated areas of St. Lucie County, County ordinances
and County resolutions, or parts thereof, in conflict with this
ordinance are hereby superseded by this ordinance to the extent
of such conflict.
E. SEVERABILITY.
If any portion of this ordinance is for any reason held
or declared to be unconstitutional, inoperative or void, such
holding shall not affect the remaining portions of this
ordinance. If this ordinance or any provision thereof shall be
held to be inapplicable to any person, property or circumstances,
such holding shall not affect its applicability to any other
person, property or circumstances.
F. APPLICABILITY OF ORDINANCE.
This ordinance shall be apPlicable as stated in
Paragraph A.
G. FILING WITH THE DEPARTMENT OF STATE.
The Clerk be and hereby is directed forthwith to send a

Cecil K. and Mil~dred M. Geiger have petitioned to amend the
future land use classification set forth in the St. Lucie County
Growth Management Policy Plan from RL (Low Density Residential
DeVelopment) to CG (General Commercial Development) and for a
change in zoning from RS-4 (Residential, Single Family -4 du/ac)
to CG (Commercial, General) for certain property located
approximately 1000' east of Sunshine Parkway Feeder .Road (Kings
Highway) on the north side of Indrio Road. On April 23, 1987,
the Local Planning Agency voted 8 to 1 to recommend that the
Board amend the future land use classification set forth in the
St. Lucie County Growth Management Policy Plan. Also on April
23, 1987, the Planning and Zoning Commission voted 8 to 1 to
recommend that the Board approve the rezoning petition.
Consistent with Board policy, staff has drafted an ordinance
amending the future land use classification set forth in the St.
Lucie County Growth Management Policy Plan and a resolution
approving the proposed zoning change.

WHEREAS, the Board of County Commissioners of St.-Lucie
County, Florida, has made the following determinations:

Dear Mr. Terpening:
I have the notice of the proposed rezoning of property on Indrio
Road across from my home from residential to commercial general.
When the shopping center was first proposed for the northwest
corner of Indrio Road and Kings Highway, I met at some length
with the developer.
I was obviously concerned about the encroachment of commercial
zoning into an area that was zoned entirely for single family
residential, and agreed not to oppose that rezoning on the assur-
ance that the commercial zoning would be extended no farther east
along Indrio Road.
I would like to register an objection to this proposed rezoning
as it would effectively eliminate any buffer between the existing
single family residential zoning and the shopping×~.enter/~ite..

Chairman Terpening reminded the Board that this petition required
action by the Local Planning Agency.
Mrs. Mildred G. Geiger presented the petition. She said that
their parcel in this area is the only parcel that is not commer-
cial. At this point Chairman Terpening informed the Board that
there was one letter in opposition to the petition from Mr.
Richard Neill. Mrs. Geiger explained that Mr. Neill's prgperty
is considerably distant to the east, being on the opposite side
of the road, from the subject property. She explained that they
planned to move their home to Lakewood Park.
Hearing no further public comment in favor of or in opposition to
the petition, Chairman Terpening closed the public portion of the
hearing.
Mr. Murphy, representing Staff, informed the Board that this
petition is very similar to that of the previous petition of'
Thomas Garlando. He said the granting of this petition would
square out the quarter/quarter section for commercial develop-
ment. Staff had reviewed the petition, and recommended approval.
Mr. Sciturro made a motion that the Local Planning Agency deter-
mine that the proposed petition of Cecil K. and Mildred G. Geiger
is consistent with the Growth Management Policy Pland and that
the Local Planning Agency recommend that the Board of County
Commissioners grant'the petition of Cecil K. and Mildred G.
Geiger to amend the future land use maps of the St. Lucie County
Growth Management Policy Plan from RL (Low Density Residential)
to CG (Commercial, General). Mrs. King seconded the motion, and
upon roll call Mrs. Ferrick, Mrs. Fawsett, Mrs.-Harris'~Mrs.
King, Messrs. Carman, Sciturro, Myers, and Terpening voted in
favor of the motion. Mr. Russakis voted against the motion.
This resulted in eight votes in favor of and one against the
motion. Chairman Terpening informed the petitioner that the
petition would be forwarded to the Board of County C~mmissioners
of approval.
