A RESOLUTION DENYING A PETITION TO A~END THE
FUTURE LAND USE CLASSIFICATION OF T~E
GROWTH HANAGE~ENTPOLICYPLAN
WHEREAS, the Board of County Commissioners of St. Lucie
County, Florida, has made the following determinations:
1. Fort Pierce Contracting Corporation and C.E. and
Sylvaleen Hanner (by Agent Spencer Gilbert) presented a petition
to amend the ~uture land use classification set forth in the St.
Lucie County Growth. Management Policy Plan from SU (semi-urban)
to IL (industrial, light) for the property described as follows:
The North one-half of the Southwest one-
quarter of the Southeast one-quarter of
Section 30, Township 35 South, Range 40 East,
less the North 50 feet and less and excepting
right-of-way for Ralls Road, St. Lucie
County, Florida.
(Located on the South side of Ralls Road,
approximately 1250 feet West of Selvitz
Road.)
2. The St. Lucie County Planning and Zoning Commission,
after holding the public hearing of which due notice was
published at least thirty (30) days prior to said hearing and all
owners of property within five hundred feet (500') were notified
by mail of said hearing, has recommended that the Board approve
the future land use classification set forth in the St. Lucie
County Growth Management Plan from SU (semi-urban) to IL
(industrial, light) for the property described above.
3. The Board held a public hearing on December 17, 1985,
after publishing a notice of such hearing in the FOrt Pierce News
Tribune on December 11, 1985.
4. The proposed amendment to the Growth Management Policy
]?lan is inappropriate because the properties do not have direct
access to improved public rights-of-way and this property would
jut further into an existing residentially zoned area and could
encourage additional rezoning and Plan Amendment requests.
NOW, THEREFORE, BE IT RESOLVED by the Board of County
Commissioners of St. Lucie County, Florida:
The petition to amend the Growth Management Policy Plan
filed by Fort Pierce Contracting Corporation and C. E. and
Sylvaleen Hanner (by Agent Spencer Gilbert) is hereby denied.
After motion and second, the vote on this resolution was as

petition of Fort Pierce Contracting Corporation
and C. E. and Sylvaleen Harmer (by Agent Spencer
Gilbert) to amend the Future Land Use
Classification Maps of the St. Lucie County Growth
Management Policy Plan from SU (Semi-Urban) to IL
(Industrial, Light).
On Tuesday, December 17, 1985, you will be asked to review
a petition of Fort Pierce Contracting to designate an 18.5+ acre
parcel IL (Industrial, Light) on the Future Land Use Maps of the
Growth Management Policy Plan. The.St. Lucie County Planning and
Zoning Commission on August 22, 1985,'voted 6-2 to recommend that
this petition be approved.
In re-evaluating this petition, County Staff has
reconsidered its original position and has determined that it
must recommend denial of'the petition. This reconsideration is
predicated on the fact that although this
reclassification/rezoning can be considered a mere extension of
the existing industrial development, there are several valid
reasons why this petition,should not be accepted.
1.) As cited on several recent occasions, Staff
cannot support new industrial development on
those properties that do not have direct
access to improved public rights-of-way.
Access to this particular parcel is via an
unimproved roadway and is approximately
, one-half mile from Selvitz Road.
2.) If approved, this property would jut further
into an-existing residentially zoned area.
This "finger" could encourage additional
rezoning and Plan Amendment requests that
staff could not support.
Attached you will find copies of the Original staff report
trasmitted to the Planning and Zoning Commission and copies of
the minutes of that meeting.

Dear Mr. Pearson:
It is our understanding that Fort Pierce Contracting
Corporation and C. E. Hanner have petitioned the St. Lucie
County Commission for a change in the zoning classifica-
tion of the Hanner property from low density residential
to.light industrial. As you may know, the fourteen acres
at the corner of Ralls Road and Selvitz Road is owned by
the writer, while the property to the north of Ralls Road
is owned by the Savinelli family.
The reason for writing to you, Mr. Pearson, is to lend
my support to your petition for the change in zoning of
the Hanner property. Ralls Road is a natural boundary for
separating low density residential from light industrial.
Furthermore, as the property zoned light industrial to the
south of Ralls Road is developed, it is likely that Ralls
Road itself will be improved from the current status of a
dirt road to one that is paved. This would certainly re-
duce the dust and dirt which now blows up every time trucks
pass over this road as they remove sand from the borrow
somewhat to the west. -
Should you find it of help to you, please feel free to
use this letter in your petition to the St. Lucie County
Commission with the understanding that I am speaking only
as the property holder of the fourteen acres at the corner
of Ralls and Selvitz Roads.

As I understand it, there is plenty of vacant property in
St. Lucie County, including property alonG Glades Road cut-off,
that is presently zoned for industrial use. It would seem that
under these circumstances there is no need to further expand
industrial zoninG in ~his area of St. Lucie County which has the
potential of developinG into one of the nicer residential areas
of the County.
If you have the time, I invite you to visit River Oaks. subdivision
which is located between Edwards Road and Ten Mile Creek west of
Selvitz Road. After your visit, I believe you will agree with me
that it is a very nice area in which a number of residents have
made substantial investments in their'homes relyinG upon no further
expansion of the Glades Road cut-off industrial area. In fact,
only recently I expended a considerable sum remodelinG my home
which I intend to be my permanent residence. I would not have
made these improvements if I thought there would be further
encroachments of industrial areas toward Ten Mile Creek.
I sincerely hope that you will vote "no" when this zoninG

Dear Commissioners:
We reside in the River Oaks Subdivision located just north
of Ten Mile Creek. Across Ten Mile Creek is a small grove
and just south of that grove is Ralls Road and the C. E.
Hanner property. Fort Pierce Contracting Corporation together
with Mr. and Mrs. Hanner are trying to have this property
rezoned from residentia! to light industrial.
We oppose this action and would like you to help us keep the
Ten Mile Creek area residential. Who would want to build a
nice home in an area inundated with warehouses.
Please protect our nice residential area by voting "no" when
the Hanner application for rezoning comes before you later

We have recently learned of the application for rezoning
property on Ralls Road owned by Mr. and Mrs. C. E. Hanner to
light industrial so that they can sell their property to the
asphalt plant owner, Ft. Pierce Contracting Company. Naturally,
as residents of the area, we are concerned about the expansion
of industrial property near Ten Mile Creek and our home.
The area in question is one which is developing into one
of the nicest residential areas in the county, and we fear that
further industrial expansion will be harmful to the residential
use we already put to our property.
There are hundreds of acres of industrially zoned property
on Glades Cutoff Road that are undeveloped, and we ask that you
reject the application for change of land use and zoning from
residential to light industrial.

Dear Sirs:
Please vote "no" on the request of Mr. and Mrs. Hanner
for rezoning their property on Ralls Road just south of Ten
Mile Creek to permit light industrial use of their property
in the future.
We own our own home just north of Ten Mile Creek and fear
that if warehouses are permitted to be built on the south side
of Ralls Road the people who own the property on the north side
of Ralls Road will never be able to sell their land for resi-
dential use and will be back to you for changing their zoning
to industrial use, thereby ending the use of this nice area for
residential purposes.
While we think that light industry is fine for our county,
we do not think it belongs on a narrow dirt road such as Ralls
Road, in an area which is rapidly becoming one of the finest
residential areas of our county.
Please help us protect this nice residential area.

It is my understanding that within a week or so you Will
be holding a hearing to decide whether or not to change the
zoning and use of property OWned by Mr. and Mrs. C. E.
on Ralls Road from residential to light industrial.
My wife and I live on Oak Hammock Lane which is just North of
Ten ~ile Creek, south of Edwards Road and East of Selvitz
.Road. We also own a track of land Which is more than 200 feet on
Ten Mile Creek east of the bridge which Crosses Ten Mile Creek
on Selvitz Road. As a property OWner and resident of this
area, I want to express my COncern Over any additional indu
trial rezoning in the area. I am Sure that you are aware o
the fact that there are certain areas for industrial use in
St. LUcie County which are available and do not require zoni
and land use changes. I feel that the

Dear Sirs:
We have recently found out that a Mr. Hanner and Fort Pierce Contracting
Corporation are attempting to obtain a rezoning and land use change for
Mr. and Mrs. Hanner's property just south of Ralls Road from residential
use to permit light industrial use. Ralls Road is just a few hundred feet
from Ten Mile Creek, and I live in River Oaks just north of Ten Mile Creek
and own approximately 15 acres just north of Ten Mile Creek and west of
River Oaks which I have immediate plans to develop into a high type resi-
dential subdivision such as River Oaks.
I was distressed, to say the least, to find that there is an application
for a hearing in mid-December for the Hanner property to be rezoned for
light industrial which would mean industrial use coming farther north than
it already is and closer to where I live and where I plan to subdivide.
This area is rapidly beccm/ng one of the nicest residential areas in St.
Lucie County and further northward encroachment into the residentially suited
property on either side of Ten Mile Creek must be stopped.
A~ soon as I find out what night the hearing is going to be on in mid-
December, I plan to be in attendance to speak in opposition to the petition
of the parties seeking the change in land use and zoning. If I am not able
to be there for one reason or another, please consider this my request to you
to turn down the application 'for light industrial use.

Gentlemen:
My wife and I own and live on property diagonally across
the street from Mr. and Mrs. C. E. Hanner's property which they
are seeking to have re-zoned from residential to light industrial.
We plan to attend the zoning hearing in mid-December when
we find out exactly which day it is to be held on in order to
express our personal concerns about the requested re-zoning.
We are in opposition to any change in Mr. Hanner's property's
z~ning which would permit any industrial use of the property
since our present use of our property is personal residential,
and in our opinion the future use of our property will also be
residential since it is bordered by Ten Mile Creek on the north
and Ralls Road on the south.
Please deny the requested change for land use and zoning
of the Harmer property to light industrial.

Twenty acre tract situate on the south side of Ralls
Road
Gentlemen:
Z reside at 3109 River Drive in River Oaks subdivision which is
located between Edwards Road and Ten Mile Creek just west of
Selvitz Road. I am very concerned with the above application
since it represents an extension northward of the existing
industrial area along Glades Cut-off Road. In my opinion, there
are a number of reasons why this application should be rejected,
such as:
use. a. Adjacent properties are zoned for low density resdential
b. Ralls Road is a dirt road which is not suitable for
traffic that will be generated by light industrial use.
c. The property drains directly into Ten Mile Creek.
During the recent period of heavy rains, I personally inspected
the subject property and found Ralls Road to be washed out in one
section and further found heavy drainage from the property to Ten
Mile Creek.

d. There is adequate industrial property to meet the needs
of the county fOr the foreseeable future. In fact, Fort Pierce
Contracting Corp. purchased a twenty acre tract of land several
months ago which is presently zoned heavy industrial and is not
being utilized.
e. .The area in the vacinity of Ten Mile Creek has the
potential for developing into one of the nicest low denisity
residential areas in St. Lucie County. In my opinion, this type
(low density residential) development should be encouraged. The
rezoning of the subject property to light industrial would
discourage such development.
I sincerely hope that you will see fit to deny the referenced
petition. I, among others, purchased a'home in River Oaks

not presently utilized. River Oaks subdivision at this time.is a
very desirable area in which to live and the subdivision makes a
substantial contribution to the tax rolls. Any expansion of the
industrial area along Glades Cut-off Road will result in a
depreciation of property values and a decline in the
neighborhOod.

the value of the residential property in this area and having

It is our understanding that Fort Pierce Contracting
Corporation and C. E. Hanner have petitioned the St. Lucie
County Commission for a change in the zoning classifica-
tion of the Hanner property from low density residential
to.light industrial. As you may know, the fourteen acres
at the corner of Ralls Road and Selvitz Road is owned by
the writer, while the property to the north of Ralls Road
is owned by the Savinelli family.
The reason for writing to you, Mr. Pearson, is to lend
my support to your petition for the change in zoning of
the Hanner property. Ralls Road is a natural boundary for
separating low density residential from light industrial.
Furthermore, as the property zoned light industrial to the
south of Ralls Road is developed, it is likely that Ralls
Road itself will be improved from the current status of a
dirt road to one that is paved. This would certainly re-
duce the dust and dirt which now blows up every time trucks
pass over this road as they remove sand from the borrow
somewhat to the west.
Should you find it of help to you, please feel free to
use this letter in your petition to the St. Lucie County
Commission with the understanding that I am speaking only
as the property holder of the fourteen acres at the corner
of Ralls and Selvitz Roads.

I reside at 3105 Life Oaks Lane in River Oaks subdivision. I
recently learned that Fort Pierce Contractin~ Corp. and C. E.
Hanner are attemptinG to re~one a 20-acre tract of land situate on
Ralls Road from residential to light industrial. I am opposed to
this requested change of zoninG as I believe that any expansion of
t]~e existing Glades Road cut-off industrial area will ultimately
result in the depreciation of residential properties in the area,
includinG properties in River Oaks subdivision.
As I understand it, there is plenty of vacant property in
St. Lucie County, includinG property alonG Glades Road cut-off,
that is presently zoned for industrial use. It would seem that
under these circumstances there is no need to further expand
industrial zoning in this area of St. Lucie COunty which has the
potential of developinG into one of the nicer residential areas
of the County.
If you have the time, I invite you to visit River Oaks subdivision
which is located between Edwards Road and Ten Mile Creek west of
Selvitz Road. After your visit, I believe you will a~ree with me
that it is a very nice area in which a number of residents have
made substantial investments in their homes relyinG upon no further
expansion of the Glades Road Cut-off industrial area. In fact,
only recently I expended a considerable sum remodelinG my home
which I intend to be my permanent residence. I would not have
made these improvements if I thought there would be further
encroachments of industrial areas toward Ten Mile Creek.
I sincerely hope that you will vote "no" when this zoninG
application-comes before you for consideration.

Gentlemen:
I reside at 3109 River Drive in River Oaks subdivision which is
located between Edwards Road and Ten Mile Creek just west of
Selvitz Road. I am very concerned with the above application
since it represents an extension northward of the existing
industrial area along Glades Cut-off Road. In my opinion, there
are a number of reasons why this application should be rejected
such as: ·
use. a. Adjacent properties are zoned for low density resdential
b. Ralls Road is a dirt road which is not suitable for
traffic that will be generated by light industrial use.
c. The property drains directly into Ten Mile Creek.
During the recent period of heavy rains, I personally inspected
the subject property and found Ralls Road to be washed out in one
section and further found heavy drainage from the property to Ten
Mile Creek. .

d. There is adequate industrial property to meet the needs
of the county for the foreseeable future In fact, Fort Pierce
Contracting COrp. purchased a twenty acre tract of land several
months ago which is presently zoned heavy industrial and is not
being utilized.
e, The area in the vacinity of Ten Mile Creek has the
potential for developing into one of the nicest low denisity
residential areas in St. Lucie County. In my opinion, this type
(low density residential) development should be encouraged. The
rezoning of the subjeCt property to light industrial would
discourage such development.
I sincerely hope that you will see fit to deny the referenced
petition. I, among others, purchased a home in River Oaks
subdivision relying upon no fUrther expansion of the existing
industrial area alOng Glades Cut-off Road, most of which area is
not presently utilized. River Oaks subdivision at this time .is a
very desirable area in which to live and the subdivision makes a
sUbstantial contribution to the tax rolls, Any expansion of the
industrial area along Glades Cut-off Road Will result in a
depreciation of property values and a decline in the
neighborhood.

The parcel in question is bounded on the sOuth by
Heavy Industrial zoning, on the west by an existing
Sand mining Operation, and Otherwise 2s SUrrounded by
Vacant property. This appears to be a natural
extension of existing industrial zoning northward to
Ralls Road and Could be Considered a light industrial
buffer for the IH zoning to the south. This
Particular rezoning poses no Problem to adjacent
future land Uses but the Board must be wary of any
attempts to rezone to industrial additional Property
to the north of Ralls Road. Such rezonings could
infringe upon existing and future residential
development.
Attorney Robert Lloyd spoke in opposition to the petition.
He said he lives in River Oaks and is opposed to any further
expansion of industrial zoning in the area. He said he can
hear the fork lift noises a half mile away.

White City Improvement Club also spoke in opposition to the
petition. Mr. Beech said there is a sho~ing cente~ going in at U.S.
# 1 and Midway Road .and an express way going in through a
residential area south of Midway and he thought that was enough.
Mr. Gene Pearson, Vice President of Fort Pierce Contracting
said the reason they want to acquire this land is they are trying
to protect themselves from what has happened on the last petition.
He said their plant is 4,000 to 4,500 feet from any house on Oak
Terrace. Fort Pierce is developing very radiply and in the future
people will be looking for a piece of light industrial property.

years or more and this would not make any more noise than is already
there. Again, he said, they do not expect to use the property for
some time and when they do utilize the property it would be for
warehousing or some other light industrial use.
Mrs. Evelyn Shatterly said she is Mr. and Mrs. Hanner's
daughter and on two separate occasions she lived in the house
located on this property and it is not desirable for residential
use, which is why her parents moved away. The fertilizer plants
and asphalt plant have definitely made this an industrial area.
Mr. F. H. Conrad said he has know Mr. Harmer for a number
of years and he thought Mr. Hanner donated the property for Ralls
Road to the County. He said Mr. Hanner did have to move because
of his allergies. There is Ralls Road, a large grove and a creek
between this property and those houses and he thought that should
be enough buffer. As far as the shopping center on U.S. # 1 and
Midway, he said he didn't know what that had to do with this. The
County could benefit from some light industrial business, Mr.
Conrad saidv it would provide jobs, but in order for it to. locate
in St. Lucie County, there will have to be some light industrial
property.
Mr. C. E. Hanner said he is just requesting light industrial
zoning, not heavy industrial. He said his property has been used
for a buffer for a number of years. He said he not only donated
the property to the County Ralls Road is on, he donated property
to the County for Glades Cut-off Road too. The value of the total
value of the property he has given the County is around $70,000
on todays market, he said. He said he did not think it was fair
for his property to be a buffer for the man across the river and
he felt he had been a good citizen long enough.
Mr. Carman said Staff has said this rezoning would pose no
problem to the adjacent property. He asked what they considered
sufficient buffer.
Mr. Vannoy said sufficient buffer would be light industrial
as opposed to heavy industrial. Mr. Lloyd's comments made reference
to the last petition as being similar. From a planning stand point
it is very, very different, which is the reason for Staff's comments.
In the last petition you had industrial zoning surrounded by resi-
dential. In this case you have heavy industrial to the south,
light industrial would be an appropriate buffer between that and
the vacant land to the east and the industrial extraction to the west.
Mr. Carman complained about the maps and Mr. Slayback assured
him they would improve.
Mr. Sciturro said this is good planning, we like to buffer
heavy industrial with light industrial, that has worked very well
in the past. He said he had no problem with this, he thought Ralls
Road would make a good buffer and hopefully future zoning will take
that into consideration.
Mr. Coulson said if this is granted will the people on the
north side of Ralls Road want to
to industrial, come and rezone their property
Mrs. King said that is not likely, Mr. Savinelli is deceased
grove,his heirs live in New York and are happy with the income from the'
Mr. Terpening said he sees a need for industrial zoning in
this County. He doesn't think it is a cancer and something to be
avoided. The Go-team is out trying to attract business to this
area, trying to get industry to provide jobs. From a planning
stand point he said he agreed with Staff.
Mr. Carman made a motion to approve the petition. The motion
was seconded by Mrs. King and upon vote approved with Mr. Sciturr0~
Mr. Ralph Wetherington, Mrs. King, Mr. Carman, Mr. Terpening and
Mrs. Harris voting in favor of approval. Mrs. Fawsett and Mr.
Coulson voted against approval of the petition.
