Dear kiro Dennis:
Please allow this letter to serve as a follow-up, and
explanation, on why my office could not accept your recent
application for building permit for property located on North
Hutchinson Island, that was presumeo to be a part of the
Hutchinson Sea Island Cluo site development plan.
As I am sure yoo are aware, in 1983, Ms. Anna Gates filed
sult agalnst St. Lucle County over the oenlal of a proposed site
development plan for tnls property. In 1985, the St. Lucie County
Board of County Commissioners entered 1ntb a settlement agreement
with Ns. Anna Gates gran.tlng approval to a 157 unlt development
plan for tnls property. Included in thls settlement agreement was
a requirement that the Board of County Commissioners would
lnltlate a petltion to conslOer ohanglng the zoning on a portlon
of this slte from residential to commerclai (Condition #13).
Under the terms of tnls condition, the County was not obligated
to approve thls petition.
In Nay of 1985, the St. Lucie County Board of County
Commissioners held a puOllc nearlng on tnls request. At that
nearlng, and by a unanimous vote, the Board decllned to change
the zonlng on the petitioned property. Attached for your reooros
is a copy of the flnal Board action on tnls petitlon and a map of
the area under consideration for change.
As you can see from the above comments, the property that is
indicated as havlng a potential commercial usage on the slte
plan~ does in reality not nave that portion of tnls plan
approved. In order for a commercial Oullolng to Oe constructed,
the property must be zoned commercial. The property's value for
development Oensity nas already been used, however, it may be
possible to add additional units to this site through a new site
plan approval, subject to all current development codes and
restrLctions.

Please note, the attached map does not indicate any. proposed
commercial areas south of Las Olds Avenue. I believe that your
proposed construction layout indicated parking for these
commercial uses on property that was originally contemplated for
utility site development. Unless .that property is zoned
commercial, which it is not, you may not use this area for
commercial parking. Ail parking associated with a commercial
development must be within a commercially zoned area.
I nope tna~t this letter serves to clear up any questions that
you may nave nad on this matter. I am aware that you were
provioed a change in zoning application for your client's use.
Please be advised that any requests to change the zoning on this
property would be the responsibility of the property owner and
not St. Lucie County. Ail cost associated with this .application
would be borne by the petitioner.

PUBLIC HEARING:
Petition of the Board of County Commissioners for a change in zoning
from HIRD (Hutchinson Island Residential District) to CN (commercial,
neighborhood) for property located on the west side of State Road A-1-A
in Bonita Isles, bounded on the south by revised Los Olas Avenue and
approximately 840 feet south of Reqal Ro~_
Mr. Vannoy said this piece of property was proposed for rezoning
as part of the Sea Island Club Site Plan settlement stipulation. The
Board of County Commissioners instigated the petition.
Mrs. Woods said as part of the settlement stipulation the Board
agreed to !nstigate the petition for the property owner.
Mr. Carman said what that means is when the petition comes back
to them, they will approve it.
Mrs. Woods said that would be illegal, they can not approve it
without a public hearing. This parcel is not part of the Site Plan.
Mr. Joe Cimino asked Mrs. Woods if she was saying this is part
of the settlement agreement and Mrs. Woods said that is not what she
said, she said there was a paragraph in the settlement stipulation
that said the Board of County Commissioners wound instigate the
petition, it did not say how they would vote. This is merely a
petition instigated by the Board of County Commissioners.
Mr. Cimino said he was representing the North Beach Property-
owners Association and they had determined at their general meeting
that this petition would amount to spot zoning. There is no hardship
involved, there are already commercial areas with convenience stores
on the beach and more areas to be developed. The zoning ordinance
was re-wriTten by two committees and adopted by this Board and the
County Commission. This Board is to be commended but if spot zoning
is approved, it will undo every thing that has been done.
Mr. Carman asked Mr. Cimino how many members there are in his
association and he said he represents 150 households with 300 members.
Mrs. Jane Brooks stated she too is opposed to this petition and
considers it spot zoning. She said milk and bread can be Burchased
at the 7-11 already on the beach and she did not see the need for
another shopping center on North Beach. She said she and her neighbors
felt it would downgrade th~' neighborhood.
Larry Batenchoff appeared in opposition for an absent homeowner
and Stan Blum represented R. K. Burch also in opposition. He said
there is a need for commercial zoning around the Red Tail Hawk but
not in this area. He said the convenience stores there are untidy
because of the "Sunseekers" and thzs would bring more of the same.
Mr. Sciturro noted the speakers keep mentioning convenience
stores. He asked. Mr. Ament if this has been established as one of
the proposed businesses in the shoppmng center and Mr. Ament said
it has not. If the proporty is rezoned to CNa Site Plan would be
required. Staff and the consultant for the County feel commercial
development on the island would reduce the number of trips to and
from the island.
Mr. Carman'-~tated he-~'had re,ad M~..Ament's Comments and asked
him if he felt there was sufficient commercial property to serve
the island now, Mr. Ament said he did not.
Mr. Terpening questioned Mr. Ament as to why lots 7 and 8 were
devided on the petition and why Los Olas Avenue was changed.
Mr. Ament said the tentative layout is not part of the settlement
stipulation. He presented drawings for th'e Board's inspection.
The County Commission approved re-alignment of Los Olas Avenue
two or three weeks ago, Mr. Ament said, and the commercial Site
Plan is not included in the reszdential Site Plan. Several parcels
have been sold in Bonita Isles subdivision and one of those property
owners, Linda Van Natta has filed a rezoning petition to Commercial,
Neighborhood also.
Mr. John Brooks asked what else this could be called other than
spot zoning and Mr. Ament said an effort to reduce the number of
trips to and from the mainland.
Mr. Batenchoff said it was his understanding the agreement with
the County Commissioners was only authorized yesterday and wanted to
know when it would be signed.
Mr. Carman asked if signing the document is contingent upon approval
of this.
Attorney Robert J. Garman appeared to represent Linda Van Natta.
He said his client is opposed to the petition and she has applied
to rezone her property because if this is zoned commercial, her single
family zoned property will be useless.
Mrs. Woods said she did not think the property was zoned single family
and suggested the transparency might be incorrectly marked. She said
she thought the entire area was zoned HIRD.
Mr. Sciturro said he understood Miss Van Natta had her property
rezoned to single family residential. Mr. Ament left the room to'check
on the official zoning maps.
Mr. Jorge Dorta-Duque stated he lives on North A-1-A on beautiful
North Hutchinson Island and he was in opposition to the petition. He
said he could not see anything close to good planning in rezoning a
piece of property this small for a small shopping center in the middle
of a residential area. This is bad zoning and terrible planning, Mr.
Dorta-Duque continued, and,he felt this Board had no choice but to
recommend to the Board of County Commissioners denial of this petition.
Mr. Cimlno made mention of the number of people in opposition present
and Mr. Sciturro agreed he did have a good representation.
Mr. Ament returned to the meeting room and stated the zoning was
correct as shown on the transparency, Miss Van Natta's property is
zoned RS-4 (single family -4) and the land use is eleven units per
acre. The question is, Mr. Ame~t continued, would her property be
useless for single family development.
Mr. Garman stated Miss Van Natta felt it would be useless for single
family units, no one would want to put a single family unit on property
surrounded by commercial zoning.
Mr. Ament said if this petition is approved for commercial, neighbor-
hood, Miss Van Natta will have a good chance of getting her property
approved for commercial, neighborhood. If it is not approved, Miss
Van Natta can apply for multiple family zoning.
Mr. Robert Dudley said he has lived on North Beach for a year and one-
half and has been looking for some lots for his children. He is four
blocks from a little shopping center at Holiday Inn and has helped pick
up trash there many times. These small shopping centers do not add to
the attractiveness of the beach, Mr. Dudley said, and he would not like
to see another go in 'there.
The meeting was closed to the public.
Mr. U. B. Wetherington said he was a bit confused and wanted to
know if the County Commissioners had made a promise that this petition
would be passed.
Mr. Sciturro said it was his understanding if this went commercial
they would have a better site plan. '
Mr. Terpening said in general he agreed with Staff's Comments as to
reducing traffic flow but he did have problems with the northern piece
of this property, the lower part has sufficient size to buffer.
Mr. Ament said Plannmng and Zoning could recommend approval of only
the portion marked Trac5 A and recommend against approval of the northern
portion. He said he could understand Mr. Terpening's concern.
Mr. Carman said considering there is already an existing small
commercial area in ~he northern part of Hutchinson Island, zoning this
commercial, neighborhood would be very undesirable.
Mr. Carman made a motion to recommend denial to the County Com-
missioners, the monion was seconded by Mr. U. B. Wetherington.
Mr. Terpenmng said he could support rezoning Tract A but not the
entire area.
Mrs° Woods said in order to split the zoning another motion would
be required.
Mr. Sciturro said he had the same problem Mr. Terpening has with
this petition. He directed the Secretary to call the roll.
Upon vote, Mr. Ralph Wethermng, Mr. Sciturro, Mrs. King, Mr.
'U. B. Wetherington, Mr. Carman, Mrs. Harris and Mr. Coulson voted for
the monion to deny the petition. Mr. Terpening voted against the motion.
Mr. Sciturro stated the petition will be recommended for denial
to the Board of County Commissioners.
Mr. Carman said he appreciated the other Board members and those
people in the audience for trying to keep north beach as clean as
possible. ,

This Petition for Rezoning has been initiated by the
Board of County Commissioners as agreed in a
stipulation settlement approving the "Sea Island Club"
site plan. This neighborhood commercial development
has been shown on the site plan and staff would
support the concept of neighborhood commercial zoning
in this location. It is an accepted hypothesis that
various types of commercial facilities, if constructed
on the island, act to decrease travel between the
mainland and the island by providing needed shopping
and service facilities on the island.
