1985, the Board of County Commissioners approved your
petition for a Conditional Use to use an existing storaDe
buildinD for storage and warehousing of material and equip-

RESOLUTION NO. 85-65
A RESOLUTION GRANTING A CONDITIONAL
USE PER~IT FOR A PROJECT KNOWN
AS BRIAN ANDKATHLEEN CHARBON~U PETITION
W~EREAS, the Board of County Commissioners of St. Lucie
County, Florida, has made the following determinations:
1. A warehousing and storage of agricultural equipment
project has been proposed for location on Gentile Road between
Okeechobee and Picos Roads, which project is to be known as Brian
and Kathleen Charboneau Petition.
2. The Site Plan Technical Review Committee has reviewed
the conditional use permit application for the proposed project
and has found it to meet all technical requirements, and to be
consistent with both the existing zoning and with the future land
use maps from the St. Lucie County Growth Management Policy Plan,
if subject to the conditions set forth in Section A of this
resolution°
3. The proposed conditional use does not require the
preparation of a transportation impact report.
4. On February 28, 1985, the St. Lucie County Planning and
Zoning Commission held a public hearing on the proposed
conditional use, after publishing notice in the Fort Pierce News
Tribune and notifying by mail all owners of property within 500
feet of the project at least 15 days prior to such hearing, and
recommended that the permit be approved.

objectives, and Standards, of the St. Lucie County Zan
Ordinance, the St. Lucie County Growth Management Policy
and the Code of Ordinances of St. Lucie County.
7. The proposed conditional use will not have an undue
adverse effect on adjacent or nearby property, and is compatible
with the existing or planned character of the neighborhood lin
which it Would be located.

Fort Pierce Fire Prevention Bureau written confirmation that
water supply, evacuation facilities, and emergency access are
satisfactory to provide adequate fire protection.

of the St. Lucie County Zoning Ordinance authorizing such use and
any other requirement of the Code of Ordinances of St. Lucie
County.
NOW, T~EREFORE, BE IT RESOLVED by the Board of County
Commissioners of St. Lucie County, Florida:
A. Pursuant to Section 5.4.000 of the St. Lucie County
Zoning Ordinance, a conditional use permit for the proposed
project to be known as Brian and Kathleen Charboneau Petition be,
and the same is hereby, approved as shown on the site plan
drawings for the project prepared by Gerald Weatherington, dated
November 1, 1984, and date stamped received by the St. Lucie
County Development Coordinator on February 26, 1985, subject to
the following conditions:
1. The developer shall install, prior to the issuance of
any Zoning Compliances for this structure, 16 paved parking
spaces and appropriate access aisles in accordance with all
applicable St. Lucie County Regulations.
2. The developer shall maintain an appropriate driveway
right-of-way reservation of not less than 60 feet wide from
Gentile Road to the existing building area for the purpose of
constructing a driveway to this facility, should it be necessary.
This driveway shall be constructed to all applicable St. Lucie
County standards at the time of construction.
B. The conditions set forth in Section A are an integral
and nonseverable part of the conditional use permit granted by
this resolution. If any condition set forth in Section A is
determined to be invalid or unenforceable for any reason and the
developer declines to comply voluntarily with that condition, the
conditional use permit granted by this resolution shall become
null and void.
C. A copy of this resolution shall be attached to the site
plan drawings described in Section A, which plan shall be placed
on file with the St. Lucie County Development Coordinator.

This petition was presented to the St. Lucie County
Planning & Zoning Commission on February 28, 1985,
and APPROVED unanimously. At that time, the petitioners
counsel, Mr. Charles R. P. Brown, presented a copy of
letter to Mr. David Kelly, Planning Administrator, that
outlined several commitments that they agreed to. A
copy of this letter is included in your site plan mater-
ials. The Committee recommends tha~ the following
conditions be incorporated into any Approval Resolution
for this petition:

Petition of Brian L. Charboneau for Conditional Use
Approval to Conduct Warehousing and Storage in the
Agricultural (AG) District
LOCATION: Located on the west side of Gentile Road, between
Okeechobee Road and Picos Road
COMMENTS: The 8000 square foot structure is finished. Initially,
the proposed use for the facility was to be a nursery
operation. The applicant has agreed to construct suf-
ficient paved parking to facilitate the warehousing
operation. This will be 16 parking spaces with a mini-
mum 26 foot parking access aisle.
