LUCIE COUNTY, FLORIDA WHEREAS, the Board of County Commissioners of St. Lucie County, Florida, has made the following determinations: 1. Bluefield Sand Company by Agent Steven Barnes presented a petition for a change in zoning from AG (Agricultural) to IX (Industrial, Extraction) for the property described below. 2. The St. Lucie County Planning and Zoning Commission, held a public hearing on the petition, after publishing notice at least fifteen (15) days prior to the hearing and notifying by mail owners of property within five hundred feet (500') of the subject property, and has recommended that the Board approve the hereinafter described request for change in zoning classification from AG (Agricultural) to IX (Industrial, Extraction) for the property described below. 3. On June 26, 1986, the Planning and Zoning Commission voted 7-2 to recommend that the Board approve the petition. Consistent with Board policy, staff has drafted a resolution approving the proposed zoning change. Lee Starkey, on behalf of Bluefield Sand Company, appeared before the Board to request approval of the change in zoning. Attorney Dan Harrell, on behalf of Clyde Dawson and Ronald and Mary Sales, who own property adjacent to the Bluefield Mine, expressed the concern of his clients relative to the possible adverse affects on future land use and water quality. Ruben Carleton who owns property on Bluefield Road aSked how the sand was going to be removed from the mine. Mr. Starkey stated that it would be transported by rail. The Planning Administrator, in his memorandum to the County Administrator - County Commission dated Ouly 15, 1986, stated that the Planning and Zoning Commission voted 7'to 2 to recommend its approval and further that while Staff recommended approval of the petition, 'the Board should, when it takes the proposed mining petition under consideration on August 12, 1986, include the following conditions: (a) that the developer be held responsible for periodic maiotenance of 81uefield Road to compensate for any damage to its surface as a result of traffic generated by this project; (b) that the developer provide an annual Assessment Report to St. Lucie County and the Treasure Coast Regional Planning Council for the purpose of monitoring whether this project meets the requirements of a Development of Regional Impact; and (c) that the developer implement a water quality monitoring program and be held responsible to ensure that this mining operation does not adversely impact the water table in this area. Based on the above-mentioned considerations, it ~was moved by Com. Trefelner, seconded by Com. Krieger, to adopt Resolution No. 86-150 changing the zoning classification from AG (Agricultural) to IX (Industrial, Extraction) for the property described therein, and, upon roll call, motion carried unanimously. ~ N A ST,. STAFF coMMENTS: Bluefield Sand Company is proposing to operate a 312 acre 4asonry Sand Extraction Facility in Southwestern St. Lucie County. Truck access to this site is to be via Bluefield Road. However, as indicated in the~ attached "Statement of Use", the developer proposes to remove the vast majority (95%) of this material by rail. The developer proposes to construct a rail spur to the Florida East.Coast Railroad tracks, approximately % mile south of this site. Mr. Starkey stated they would only be trucking 1 - 2 loads a day. Mr. Carmen asked Mr. Murphy about Staff comments regarding use of Bluefield Road. Mr. Starkey stated they would be happy to grade that road, however, they did not feel they would cause deterioration of the road. Attorney Dan Harrell on behalf of~Mr- Clyde Dawson and Mr. Ronald Sales and Mrs. Mary Sales addressed the Board. Mr. Dawson and the Sales own property in Martin County adjacent to Bluefield Ranch. Mr. Harrell stated they were not really in opposition but concerned about potential adverse effeCts on their future land use. He requested that the recommendation be made that mining not take place within 1200 feet of the property line. He also stated they were concerned about adverse effects on water quality. In line with that. Mr. Murphy, Planner, stated that Staff shared some of the same concerns regarding water quality and hope that Bluefield'adheres very closely to the conditions set forth in Staff's comments. Mr. Sciturro asked if anyone else was in opposition to the petition. There was none. Mr. Sciturro then closed the public portion of the meeting. A motion was made by Mr. Carman to approve the petition, with the recommendation to the County Commissioners that Bluefield Sand be responsible for the grading of Bluefi~ld Road. Pierce, Florida 33482-5652 Gentlemen: We are in receipt of a notice of a petition to rezone part of Section 35, T37S, R37E from AG to IX to permit a mining operation. With our subsidiary, Ellsworth Groves, Inc., we own approximately 10,000 acres of citrus grove and pasture in St. Lucie and Martin Counties in close proximity to the proposed mining site. You are aware that the only vehicular access to the property is South from S.R. 70 via Bluefield Road, which is an unpaved graded road approximately two and a quarter miles in length. Under present use, Bluefield Road is not in good condition and increased use by heavily loaded vehicles by the mining operator and suppliers of materials, supplies and equipment to the operator would, in our opinion, cause the further degredation and conceivably the destruction of the road. Unless Bluefield Road is improved (paved), we would strenuously object to the proposed rezoning requested by Bluefield Sand Company.
