I was asked a series of short questions about whether or not a retail business cOuld operate in an industrial district and what my role was in the review of rezoning petitions. This deposition lasted approximately 15 minutes and was concluded. Due to the brevlty of my comments and the fact that we are not a party involved in this matter, I waived reading of the deposition. ~ copy of this deposition will be provided when it is complete. LUCIE COUNTY, FLORIDA WHEREAS, the Board of County Commissioners of St. Lucie County, Florida, has made the following determinations: 1. Edith L. Campbell by Agent Steven Frasier presented a petition for a change in zoning from IL (Industrial, Light) to CG (Commercial, General) for the property described below. 2. The St. Lucie County Planning and Zoning Commission, held a public hearing on the petition, after publishing notice at least fifteen (15) days prior to the hearing and notifying by mail owners of property within five hundred feet (500') of the subject property, and has recommended that the Board approve the hereinafter described request for change in zoning classification from IL (Industrial, Light) to CG (Commercial, General) for the property described below. 3. On July 22, 1986, this Board held a public hearing on the petition, after publishing a notice of such hearing in the Fort Pierce News Tribune on June 30, 1986, and notifying by mail all owners of property within 500 feet of the subject property. 4. The proposed zoning change is consistent with the St. Lucie County Growth Management Policy Plan and has satisfied the standards of review set out in Section 5.3.300 of the St. Lucie County Zoning Ordinance. On June 26, 1986, the Planning and Zoning Commission voted unanimously to recommend that the Board approve the petition. Consistent with Board policy, staff has drafted a resolution approving the proposed zoning change. Attorney Steven Frasier, representing Mr. and Mrs. Travis Campbell, addressed the Board. He stated that several form~? uses of th~ building had been a general commercial nature. Petitioners felt that the best use and adjoining neighborhood uses would call for a general commercial use. They felt the use would be consistent with the neighborhood and that no adverse effects on either the natural environment, adjoining property owners, or logical building' pattern of the surrounding property by making this change to commercial, general. He stated he believed Staff had no objections and due to conditions asked the Board's consideration for a zoning change to General Commercial. Adult establishments subject to the following requirements: (i) An adult establishment shall be at least 1,000 feet from any other adult establishment, established church, public or private school, public playground, public park, or any area in zoning district AR-l, P~E-2, RS-2, RS-3, RS-4, RMH-5, RM-5, RM-11,-- lq.M-18, ltVP, PUD, or HIRD. (ii) For purposes of the distance limitations set forth in subpara- graph (i) above-, '~the measurement shall be made by extendir~ a straight line from the main entrance of the building of the adult establishment to: a. tl~e main entrance of the building occupied by any other adult establishment or any established church, or b. the nearest property line of any school, playground, park, or residential zoning district. ~_c.~.f~ory uses sub_iect to the re.q~Ujr_ements of Section 3..2.300. including: (a) Bakery products - manufacturing.
