Bailey to Amend the Future Land Use Maps of the St. Lucia County Growth Management Policy Plan from SU (Semi-Urban) to RL (Residential, Low) On May 13, 1986, you will be asked to review a Petition on behalf of Leo. E. Bailey to reclassify property located at 11516 Okeeohobee Road from SU to RL. The Petitioner is seeking an Amendment to the Land Use Plan to permit him to construct a second home on this one acre parcel. On Oanuary 23, 1986, the St. Lucie County Planning and Zoning Commission voted to recommend approval of this Petition. On April 30, 1986, .the St. Lucie County Local Planning Agency voted to recOmmend approval of this Petition. County Staff, in its comments of 3anuary 20, 1986, found that it must recommend against this Petition. This recommendation was based -on the fact that the proposed Amendment constitutes nothing more than a spot zone for the purpose of acquiring additional density. During the previous public hearings on this item, it was brought up that what would granting this Amendment hurt? This Amendment, in and or itself, would probably not hurt anything. However, Staff has very serious reservations about the precedent that continued spot zoning has on both the GrOwth Management Policy Plan and the St. Lucie County Zoning Ordinance. Therefore, County Staff recommends that Draft Resolution 86- 30 be denied. Bailey to amend the Future Land Use Maps of the St. Lucie County Growth Management Policy Plan from SU (Semi- Urban) to RL (Residential, Low) for property located on the north ,,side of Okeechobee Road, between McCarty Road and Eleven Mile Road. MEMORANDUM~ On January 23, 1986, this Agency sitting as the St. Lucie County Planning and Zoning Commission, heard a request on behalf of Leo F. Bailey to amend the Future Land Use Maps of the St. Lucie County Growth Management Policy Plan from SU to RL for property located on the north side of Okeechobee Road, between McCarty Road and Eleven Mile Road. At that time, this Commission voted 6 to 3 to recommend approval of this petition. County Staff cannot support this petition for the reasons cited in our memorandum of January 20, 1986. We, at this time, urge this Agency to recommend that this petition be denied. ' Mr. Bailey appeared at the meeting and said that he was re- questing the change of land use and zoning to enable him to con- struct a second house on his property. He added that at the pres- ent time, the land use is SU (Semi-Urban) and the zoning is AG (Agriculture), and it only allows one unit per acre. He felt that there was plenty of room for two houses on the property, and added that it was very secluded, and he had no prob- lem with the neighbors. Mr. Sciturro asked if anyone else wished to speak in favor of the petition. He then asked if anyone wished to speak in opposition to the petition. Mr. Murphy referred to Staff's Memorandum dated January 20, 1986, with regard to their concerns with this petition. He said that while this proposed plan amendment wouldn't in- withcreaSespotthezoning.density in any major way, it would present a problem Based primarily on that concern, we recommend this Commission deny the petition in an effort to restrict spot zoning, which is in violation of policies within the Growth Management Policy Plan. Mr. Sciturro asked what the zoning was on the surrounding Mr. Murphy said that the properties surrounding the subject pr~rty are zoned AG (Agricultural). He added that there was on~ small parcel that was spot plan amended prior to the adoption of the new zoning ordinance, for the specific purpose of obtaining a ~ailding permit to construct a house. It was not rezoned at the time. SU (Semi-Urban) land use permits one unit per acre, and RL (Residential, Low) land use permits up to five units per acre for building purposes, as long as all a~licable requirements are met. Mabel Fawsett made the observation that if Mr. Bailey's Plan Amendment Petition and Rezoning Petition ware denied, he wouldn't be able to build a second house o~ the property. He would have to tear dow~ the old house before he could build a new house, in order to comply with the one unit per acre recruited under AG zoning and SU land use. Mr. Sciturro felt that the location made a big difference, and since this property was zoned Agricultural, was residential and secluded, then he was in favor of the petition. Mr. Sciturro closed the meeting to the public. Mr. Wetherington made a motion to approve the petition. The mOtion was seconded by Mrs. King. The Board voted 3 against and 5 in favor of the petition. The petition was approved by a majority vote. Mr. Sciturro stated that the petition would be sent to the Board of County Commissioners with a recommendation for approval.
