On the same date, the Board of County Commissioners also granted
your petition for the rezoning of the same piece of property.

held a public hearing on the ~tition, after publishing notice at
least fifteen (15) days prior to the hearing and notifying by

WHEREAS, the Board of County Commissioners of St. Lucie

On January 23, 1986, this Commission heard a request on
behalf of Leo F. Bailey for a change in zoning classification
for property at 11516 Okeechobee Road. At that time, this
Commission voted 6-3 to recommend approval of this Retition.
Attached you will find a copy of the original staff
report on this Retition and of the minutes of this meeting.
County Staff cannot support this Retition for those reasons
cited in our memorandum of January 20, 1986. We, at this
time, urge this Commission to reconsider its previous action
and recommend that this Petition be denied.

property located on the north side of Okeechobee Road, between

MEMORaNDUMs On January 23, 1986, this Commission heard
a request on behalf of Leo F. Bailey for a change in
zoning classification from AG to RS-2 for property lo-
cated on the north side of Okeechobee Road, between
McCarty Road and Eleven Mile Road. At that time, this
Commission voted6 to 3 to recommend approval of this
petition.
County Staff cannot support this petition for those
reasons cited in our memorandum of January 20, 1986. We,
at this time, urge this Commission to reconsider its
previous action and recommend that this petition be denied.
Mr. Sciturro asked if everyone.s comments would be the same for
the rezoning petition as they were for the plan amendment petition.
Those that spoke in regard to the previous petition, agreed
that their comments would be the same for the rezoning petition.
Mr. Sciturro closed the meeting to the public.
Mr, Wetherington made a motion to approve the petition. The
motion was seconded by Mrs. King. The Board voted 2 against and
6 in favor of the petition. The~petition was approved by a majority
vote.
Mr. Sciturro stated that the petition would be sent to the
Board of County Commissioners with a recommendation for approval.
There being no further business, the meeting was adjourned.

On May 13, 1986, you will be asked to review a Petition
on behalf of Leo E. Bailey to rezone property at 11516
Okeechobee Road from AG to RS-2. The Petitioner is seeking
this rezoning to allow the construction of a second dwelling
unit on this one acre parcel. On January 23, 1986 and again
on April 30, 1986, the St. Lucie County Planning and Zoning
Commission voted to recommend approval of this Petition.
County .Staff, in its comments of January 20, 1986,
found that it could not recommend in favor of this Petition.
This recommendation was based on the fact that the proposed
rezoning constitutes nothing more than a singular spot zone
for the purpose of obtaining additional residential density.
During the previous public hearings on this matter, it was
brought up what would be hurt if this rezoning were
granted. Staff conceeded that in this particular case,
probably nothing.' However, Staff does have serious
reservations over the potential precedent that would be set
by this Board if this Petition is approved. Staff recommends
that in order to provide maximum protection tp the integrity
of the St. Lucie County Zoning Ordinance this Petition be
denied. Attached please find copies of the original staff
reports and minutes of previous discussions on this issue.

cannot, at this time, recommend approval of this petition for the
following reason:

Petition of Leo E. Bailey for a change in zoning from AG
(Agricultural) to RS-2 (Residential, Single Family -2) for property
located on the south side of Okeechobee Road, between Mc Carry
Road and Eleven Mile Road.
Based on the information heard on the previous petition,
Mrs. Harris made a motion to approve the petition, it was seconded
by Mr. Wetherington. The motion was approved with Mrs. Harris,
Mrs. Ferrick, Mr. Sciturro, Mrs. King, Mr. Meyer and Mr. Wetherington
voting in favor of approval. Mr. Carman, Mrs. Fawsett and Mr.
Terpening voted against the petition.
