Bailey to rezone property at 11516 Okeechobee Road from AG to RS-2. The Petitioner is seeking this rezoning to allow the construction of a second dwelling unit on this one acre parcel. On January 23, 1986 and again on April 30, 1986, the St. Lucie County Planning and Zoning Commission voted to recommend approval of this Petition. County .Staff, in its comments of January 20, 1986, found that it could not recommend in favor of this Petition. This recommendation was based on the fact that the proposed rezoning constitutes nothing more than a singular spot zone for the purpose of obtaining additional residential density. During the previous public hearings on this matter, it was brought up what would be hurt if this rezoning were granted. Staff conceeded that in this particular case, probably nothing.' However, Staff does have serious reservations over the potential precedent that would be set by this Board if this Petition is approved. Staff recommends that in order to provide maximum protection tp the integrity of the St. Lucie County Zoning Ordinance this Petition be denied. Attached please find copies of the original staff reports and minutes of previous discussions on this issue. Petition #17 M EM ORAND UM TO: FROM: DATE: SUBJECT .- Planning and Zoning Commission Planning Administrator~, January 20, 1986 Petition of Leo F. Bailey for change in zoning from AG (Agriculture) to RS-2 (Residential, Single Family - 2 d.u./acre) LOCATION: EXISTING ZONING: PROPOSED ZONING: EXISTING G.M.P.~. LAND USE: PROPOSED USE: PARCEL SIZE: SURROUNDING ZONING: SURROUNDING LAND USE: FIRE PROTECTION: WATER/SEWER SERVICES: 11516 Okeechobee Road (North side of Okeechobee Road approximately 1/8 mile west of 11 Mile Road) AG (Agriculture) RS-2 (Residential, Single Family - 2 d.u./acre) SU (Semi-Urban) The Petitioner proposes to construct a s'econd home on this site and maintain the existing home as a guest home. 1.01 acres AG Properties to the east and southeast are presently being used for groves. The parcels to the north and west are being used residentially. The parcels to the southwest are being used for large lot residential purposes. Fort Pierce Central Fire Station is approximately 6 miles away. There is no public water or sewer service to this site. CO~L~ENTS: In filing this petition, the applicant has indicated that he wishes to construct a second home on his property for use as either a guest home or as rental property for his family. Under his present Land Use and Zoning Classification, ~t is not possible to construct more than one single family home on this site, regardless of its expressed use. County Staff cannot, at this time, recommend approval of this petition for the following reason: The St. Lucie County Growth Management Policy Plan indicates this area as being Semi-Urban or of generally very low density for residential development° Low density in this district is one unit per acre. If approved, this petition would be a classic spot zone and be inviolations of the Growth Management Policy Plan's Land Development Guidelines. cc: County Attorney
