GROWTH MANAGEMENT POLICY PLAN, ORDINANCE
NO. 86-01 BY CHANGING THE LAND USE DESIGNATION
OF THE PROPERTY LOCATED ALONG'THE NORTH SIDE OF
ORANGE AVENUE, 1/2 MILE WEST OF HARTMAN ROAD
(MORE PARTICULARLY DESCRIBED HEREIN) FROM
CG (COMMERCIAL, GENERAL) AND RL (LOW DENSITY
RESIDENTIAL) TO IL (INDUSTRIAL, LIGHT);
MAKING FINDINGS; PROVIDING FOR MAKING THE NECESSARY
CHANGES ON THE OFFICIAL ZONING MAP OF ST. LUCIE COUNT~;

WHEREAS, the Board of County Commissioners of St. Lucie
County, Florida, has made the following determinations:
1. Rose E. Baumker presented a petition to amend the future
land use classification set forth in the St. Lucie County Growth
Management Policy Plan from CG (Commercial, General) and (RL (Low
Density Residential) to IL (Industrial, Light) for t~e property
described below.
2. The St. Luci e Counter Local P1 anning Agency, after
holding a public hearing on December 10, 1986 of which due notice
was published at least seven (7) days prior to said hearing and
all owners of property, within five hundred feet (500') were
notified by mail of said hearing, has recommended that the Board
amend the future land use classification set forth in the St.
Lucie County Growth Management Plan from CG (Commercial, General)
and RL (Low Density Residential) to IL (Industrial, Light) for
the property described below.

3. The Board held a public hearing on DeCember 18, 1986,
after publishing a notice of such hearing in the Fort Pierce News
Tribune on December 9 and December 10, 1986.
NOW, ~HEREFORE BE IT ORDAINED by the Board of County
Commissioners of St. Lucie County, Florida:
A. CHANGE IN FUTURE T. AND USE CLASSIFICATIOn'.
The future land use classification set forth in the St.
Lucie County Growth Management Policy Plan for that property
described as follows:

B. FINDING OF CONSISTENCY.
This Board specifically determines that the approved
change in future land use plan is consistent with the policies
and obj ec~ives contained in the St. Luci e County Growth
Management Policy Plan.
C. CHANGES TO ZONING MAP.
The St. Lucie County Community Development Director is
hereby authorized and directed to cause the changes to be made on
the Official Zoning Map of St. Lucie CoUnty, Florida, and to make
notation of ~ reference , to .the,date of adoption of thi~.ordina:nce~
D. CONFLICTING PROVISIONS.
Special acts of the Florida legislature applicable only
to unincorporated areas of St. Lucie County, County ordinances
and County resolutions, or parts thereof, in conflict with this
ordinance are hereby superseded by this ordinance to the extent
of such conflict.
E. ~EVERAB ILITY.
If any portion of this .ordinance is for any reason held
or declared to be unconstitutional, inoperative or void, such
holding shall not affect the remaining portions of this
ordinance." If this ordinance or any provision thereof shall be
held to be inapplicable to any person, property or circumstances,
such holding shall not affect its applicability to any other
person, property or circumstances.
F. APPLICABILITY OF ORDINANCE.
This ordinance shall be applicable as stated in
Paragraph A.

The Clerk be and hereby is directed forthwith to send a
certified copy of this ordinance to the Bureau of Laws,

Attorney John Guerrero appeared before the Board on behalf of his
client to request Board approval of the proposed change in land
use. .
Based on the recommendations of the Local Planning Agency and the
Pianning and Zoning Commission, and the recommendation of Staff,
it was moved by Com. Krieger, seconded by Com. Fenn, to adopt
Ordinance No. 86-9I amending the St. Lucie County Growth
Management:Poiicy Pian, Ordinance No. 86-01 by changing the land
use designation of'the property iocated aIong ~the north side _of
Orange Avenue, I/2 mile west of Hartman Road from CG and RL to
IL; making findings; providing for making the necessary changes
on the officiai zoning map of St. Lucie County; and, upon roIi
caIi, motion unanimously carried.
In this same connection, the Board directed Staff to prepare a
iand use study of the area north of Orange Avenue, between Fort
Pierce and 1-95, for future industriai deveiopment, and return
the same to the Board for consideration.

Petition of Rose E. Baumker to amend the Future

On Thursday, December 18, 1986, you will be asked to
review a petition on behalf of Rose E. Baumker to amend the
Future Land Use Maps of the St. Lucie County Growth Management
Policy Rlan from RL and CG to IL, for property located along the
north side of Orange Avenue, next to Stamm Equipment. This peti-
tion was presented to the St. Lucie County Local Planning Agency
for review on December lC, 1986, at which time, this Agency voted
5 to 0 to recommend approval of this petition. In offering this
recommendation of approval, this Agency determined that the pro-
oosed petition is consistent with the Policies and Objectives of
'the St. Lucie County Growth Management Rolicy Rlan.
As required under Chapter 163, Florida Statutes, County
Staff has transmitted this amendment request to the Florida
Department of Community Affairs for interagency review. In com-
ments received back from the Department, concern was expressed
about the compatibility of this petition with the Residential and
]industrial Development Rolicies of the Growth Management Roliey
Plan. On September 22, 1986, the Treasure Coast Regional Rlanning
Council reported that this proposed amendment did not conflict
with any regional plan or policy.
Attached for your review is a copy of the original staff
comments on this petition, transmitted to you on August l, 1986,
and the most recent memorandum transmitted to the St. Lucie
County Local Planning Agency on December 2, 1986. By separate
memorandum, the County Attorney,s Office will be providing a
Draft Ordinance denying this petition.

On August 7, 1986, the St. Lucie County Board of County
Commissioners held a public hearing for the purpose of
auth. orizing the transmittal ofthis petition to the Florida
Department of Community Affairs' as required under Chapter
163.3184,.:Florida Statute. As of this date, my office has not
received any return comments from t~eDepartment about this
petition. On September 22, 1986, t~e Treasure Coast Regional
Planning Council held a hearing on the proposed petition, and
reported that the proposal did not conflict with any adopted
Council plans or policies.

COMMENTS: On 3une 26, 1986, the St. Lucie County Local Planning
Agency heId a pubiic hearing on this petition. As this Board wiii
forrecaI1 in March of this year, you were approached by representatives
of Ms. herBaumkerpropertyandtorequestediL ¢ to initiate a rezoning and Plan amendment
.Industrial, Light). At that time, the Board
declined to initiate such a petition on Ms. Baumker,s behaIf since it
was not apparent any error in cIassification had been made by this
Board.
,- ...... As the Board will. recall, during the last amendment-cycle a
petition on behalf of Oohnny Stamm was heard and approved that
reclassified the 4.5 acres of land West of this site to IL
(Industrial, Light). The reasons cited for this approval were the
granting in the late l~70's of a rezoning request to B-4 for this
property and its subsequent recIassification to ResidentiaI and
Commercial in 198I (Land Use Plan) and 1984 (Rezoning). In
researching this petition, it has been de.termined that prior to 1981
-the subject property was originally zoned 8-3 (General Business) for a
depth of 200 feet off Orange Avenue and the remainder of the site was
zoned R1-C (Single Family . 4 d.u./ac). In 1984 these zoning lines
were redefined so that the commercial zoning now extended for a depth
of 600 feet-and the balance of the property remained zoned Single
Family, Residential _ 4 d.u./ac. County Staff cannot support this
petition for the following reasons:
Uniike Other petitions in this area, this property was
not previousIy zoned for a more intense use prior to
1~84. In fact, this Property actually benefited from
the rezonfngs of i~84 in that its commercial depth was
increased.
Staff is of the opinion that the Continued sporadic-
parcel by parcel Plan Amendment/Rezonlng of properties
in this area, without a complete=understanding of the
impact and needs of this development, is not a sound
planning practice.
On June 26, 1986, the Local Planning Agency voted 5-4 to
recommend approval of this petition.

Dear Commissioner Fenn:
Pursua~nt-to section 163.3184, Florida Statutes, the Department
of Community Affairs has conducte~ a review of the proposed amend-
ments to the St. Lucie County Growth Management Policy Plan.
Our review'indicated that the August 11, 1986, proposed plan
amendments were generally-consistent with the statutory requirements
except as noted in the attached comments. The Department believes
the County should continue to monitor the cumulative impact of such
plan amendments to ensure the internal consistency of the adopted
Growth Management Policy Plan pursuant to s.163.3177(2), Florida
Statutes. Additional comments from the Treasure Coast Regional
Planning Council and the Indian River County Board of County
Commissioners~have been at~ached for Your review and possible use
during the comprehensive plan amendment process.
Once the adoption process is complete, the Department
requests a copy of the amended comprehensive plan as required by
s.163.3187(3), ~lorida Statutes.

Pursuant to the requirements of the Local Government Comprehensive Planning
and Land Develor~ment Regulation Act, Chapter 163, Florida Statutes, 'J:he
Treasure Coast Regional Planning Council reviewed the amendments ~to the St.
Lucie County land use element at its regular meeting on September"22, 1986.
The following comments were approved by Council for transmittal to the
State Department of Community Affairs pursuant to Sections 163.3184(1)(c)
and (2), Florida Statutes, for consideration by the County prior to
adoption of the .document.
Evaluation
The
proposed
amendments to the Land Use Element have been reviewed in
accordance with the requirements of Chaoter 163, Florida Statutes,
Council's revi.ew procedures,_ and Council's adopted plans_, and_ policies. The
following comments are offered as a result of that r~view.
The proposed amendments are not in conflict or inc~)nsistent with
adopted Council plans or policies. Proposals to convert large
tracts of agricultural lands to semi-urban uses (e.o., Item 20)
are of some concern, however, and should not be considered prior

The property described by Item 1 is close to the sites of the
Treasure Coast Square Mall and the proposed Vista Plantation
development in Martin County. The ability of U.S. 1 to
accommodate additional traffic generated by Item 1 must be
ensured. AdeQuate right-of-way should be dedicated for future
expansion of the roadway network prior to the development of this
parcel.
Considering the proximity of Item 16 to the St. Lucie County
Airport, the current land use designation of Liaht Industrial may
be more appropriate than the proposed Residential land use
designation. Consideration should be given to plans for future
expansion of the airport facilities and increased levels of air
traffic, as well as noise and safety issues ....
The property described by Item 18 contains many acres of
wetlands known as the Norothern Savannas. Care should be taken
to minimize the impacts of any development on this
environmentally sensitiw area.
The property described by Item 20 is located on the border of
Indian River' County and is near the interface of the St. Johns
River Water Management District and South Florida Water
Management District. Since a development of such size in this
location may have far reaching impacts, it is recommended that
the land use amendment not be approved until both St. Lucie
County and Indian River',County aqree that such an action would
not adversely affect the ability of ~ither county to realize
growth management and planning objectives. A primary concern is
the relationship of the project with the existing
urban/agricultural boundary. Development of the property as
residential may create compatibility problems with existing
agricultural development. Prior to considering any chanae in
land use, the County should carefully consider its long range
plans for this area, provision of infrastructure and services,,
and the -impacts of residential development on agricultural
activities in the area. Additionally, a project of the size of
this proposal would be a DRI. Final consideration of the
proposed land use change should, perhaps, wait until a report
and recommendations can be developed that evaluate regional
issues.

Pursuant to. section 163.3184, Florida Statutes, the Department
-of Community Affairs-has conducted a review of' the proposed amend-
ments to the St. Lucie County Growth Management Policy Plan.
Our review indicated that the August 11, 1986, proposed plan
amendments were generally consistent with the statutory requirements
except as noted in the attached comments. The Department believes
the County should continue to monitor the cumulative impact of such
plan amendments to ensure the internal consistency of the adopted
Growth Management Policy Plan pursuant to s.163.3177(2), Florida
Statutes. Additional comments from the Treasure Coast Regional
Planning Council and the Indian River County Board of County
Commissioners have been attached for your review and possible use
during the comprehensive plan amendment process.
Once the adoption process is complete, the Department
requests a copy of the amended comprehensive plan as required by

Pursuant to the requirements of the Local Government Comprehensive Planning
and Land Development Regulation Act, Chapter 163, Florida Statutes, the
Treasure Coast Regional Planning Council reviewed the amendments to the St.
tucie County land use element at its regular meeting on Sepikember 22, 1986.
The following comments were approvpd by Council for transmittal to the
State Department of Community Affairs pursuant to Sections 163.3184(1)(c)
and (2), Florida Statutes, for consideration by the County prior to
adoption of the document.
Evaluation
The proposed amendments to the Land Use Element have been reviewed in
accordance with the requirements of Chapter 163, Florida Statutes,
Council's review procedures, and Council's adopted plans and policies. The
following comments are offered as a result of that rpview.
The proposed amendments are not in conflict or inconsistent with
adopted Council plans or policies. Proposals to convert large
tracts of agricultural lands to semi-urban uses (e.g., Item 20)
are of some concern, however, and should not be considered prior
to a comprehensive reevaluation of the County's goals and
objectives for the entire area (see attached letter).
Prior to the approval of the land use amendments, the proposed
changes should be tested aaainst the St. Lucie County
