A RESOLUTION CHANGING THE ZONING CLASSIFICATION
OF CERTAIN PROPERTY IN ST. LUCIE COUNT~, FI~)RIDA
W~EREAS, the Board of County Commissioners of St. Lucie
County, Florida, has made the following determinations:
1. Annegret E. Apitz presented a petition for a change in
zoning from CT (commercial, tourist) to CG (commercial, general)
for the property described below.
2. The St. Lucie County Planning and Zoning Commission,
held a public hearing on the petition, after publishing notice at
least fifteen (15) days prior to the hearing and notifying by
mail owners of property within five hundred feet (500') of the
subject property, and has recommended that the Board grant the
hereinafter described request for change in zoning classification
from CT (commercial, tourist) to CG (commercial, general) for the
property described below.
3. On August 6, 1985, this Board held a public hearing on
the petition, after publishing a notice of such hearing in the
Fort Pierce News Tribune on July 19, 1985, and notifying by mail
all owners of property within 500 feet of the subject property.

PUBLIC HEARING:
Petition of Annegret E. Apitz for a change in zoning from CT
(commercial, tourist) to CG (commercial, general) for property
located on the west side of U.S. # 1, directly across from the City
Limits of St. Lucie Village.
Mrs. Apitz said she has a house on north U.S. # 1 that is surrounded
by a motel. She would like to leave the motel zoned CT and zone the
house to CG so it can be used as a Mexican gift shop. She said she
has it rented but when the tenants went to get an occupational license
they were told they could not operate a gift shop there unless it
was zoned CG. She said she couldn't understand that because in Miami
there are always gift shops-in motels.
Mr. Carman said he could not understand Staff's comments.

gift shops and he would like to see gift shops added to CT zoning.
Mr. Carman asked Mrs. Apitz if she understood that what she
is requesting could be added to the zoning when it is reviewed. She
said when she applied she was told no, in the mean time she wanted
to know what to do about her tenant.
A motion was made to approve the petition by Mr. Carman, it was
seconded by Mrs. Fawsett and upon vote unanimously approved by the
Board.

Approximately .50 acres
The property in question is currently part of a
complex of rental cottages. In fact, this particular
parcel is surrounded by cottages and appears to be
used in conjunction with the motel use. Staff would
recommend that, due to the self-contained nature of
the existing development and the proximity of the
parcel in reference to the rental units, this petition
should be denied thus leaving the property with the
more appropriate CT zoning and preventing more
intensive General Commercial uses from locating in
such close proximity to motel/residential uses.
