Julia Economys, as Trustee of the Helen Politis Revocable Trust presented a petition to amend the future land use classification set forth in the St. Lucie County Growth Management Policy Plan from RL (Residential, Low) to RM (Residential, Medium) for Parcel A and from CG (Commercial, General) to RM (Residential, Medium) for Parcel B as described below. The St. Lucie County Local Planning Agency, after holding a public hearing on May 1, 1986, of which due notice was published at least seven (7) days prior to said hearing and all owners of property within five hundred feet (500') were notified by mail of said hearing, has recommended that the Board deny the future land use classification set forth in the St. Lucie County Growth Management Plan from RL (Residential, Low) to RM (Residential, Medium) for Parcel A and from CG (Commercial, 651 General) to RM (Residential, Medium) for Parcel B as described below. 3. The Board held a public hearing on May 14, 1986, after publishing a notice of such hearing in the Fort Pierce News Tribune on May 6, 1986. Executive Center Circle, East Tallahassee, Florida 32301 Subject: Local G_oye~nment Comprehensive Plan-Documents Dear Mr. Hook: Pursuant to the requirements of the Local Government Comprehensive Planning and Land Development Regulation Act, Chapter 163, Florida Statutes, the Treasure Coast Regional Planning Council reviewed the Amendments to St. Lucie County Future Land Use Element at its regular meeting o~ February 21, 1986. ~'The following comments were-appro~ed by Council for transmittal to the State Departmlent of Community Affairs pursuant to Sections 163.3184(I)(c) and (2), Florida Statutes, for consideration by the County prior to adoption of the document. Eval uati on The proposed aJnendments to the Future Land Use Elem~dt have been reviewed in accordance with the requirements of Chaoter 163, Florida Statutes, Council 's-review procedures, and Council's adopted plans and policies. It should be noted that this is the first occasion which Council has been asked to provide comments on proposed individual changes to a Future Land Use_-Element Map. These proposed changes cumulatively represent less than five percent of the land area within the local government's jurisdiction. Prior to amendments to Chapter 163, F.S. by the 1985 Legislature, local governments were not required to submit Land Use Plan amendments which rep- resented less .than five percent of the land area. The five percent thresh- old was deleted and Council will now review all changes'. The following comment is offered as a result of that review. --COM --DIS. S. %1 and Oleander Avenue, and north of West Midway Road. MEMORANDUMf On January 23, 1986, this Agency sitting as the St. Lucie County Planning and Zoning Commission heard a request on behalf of Julia Economys to ~mend the Future Land Use Maps of the St. Lucie County Growth Management Policy Plan from RL to RM for property locat- ed between South U. S. %1 and 0leander Avenue, and~ north of West Midway Road. At that time, the Commission voted 5 to 3 to recommend approval of this petition. As this Body may recall, at the January 23, 1986 meeting, there was considerable discussion about this petition. M~st of the concerns expressed were concentrated in the- areas of drainage and roadways. I-would, at this time, remind this Agency that these items are valid c~nsider- ations when deciding the merits of this proposal. How- ever, I would advise you not to become too concerned with the intricate details of these matters at this point. The ~stions you should be asking yourself are, is the requested use appropriate for the area and can the issues of drainage, roads, and water/sewer service be adequately addressed without ~do adverse impact on the existing neighborhood~ County Staff is of the opinion that this request is acceptable under the poli- cies of the Growth Management Policy Plan, and that the items of roads, drainage, and water/sewer service can be adequately addressed. Therefore, Staff urges you to again forward a recommendation of approval to the Board of County Commissioners. (For further clarification, please refer to the minutes of the January 23, 1986 meeting of the Planning and Zoning Commission). Mr. Sciturro asked if anyone wished to speak in favor of this petition. Mr. Bruce Abernethy, Esq. of the law firm of Neill, Griffin, Jeffries and Lloyd, addressed the Board, saying: I am appearing here this evening on behalf of Julia Economys, who is owner of the tract of land subject to two petitions this evening. Mr. and Mrs. Economys are present in the audience tonight, and Mr. Jack Scott, who is the Architect for this project, is also present. -4- I ho~e you all have had the opportUnity to review the minutes of the January 23, 1986 meeting. I will be happy to answer any questions yo~ have re- garding what~was said at that meeting. ~ The conceptual plan prepared by Mr. Scott is on the easel before you. I would like to point out that there were no negative comments concerning this petition, from either the Department of Community Affairs or the Treasure Coast Regional Planning Council. We feel new and compelling evidence favorable to this petition, is the proposal to Widen Midway Road to four lanes, from U. S. ~1 to Oleander Avenue by 1987, and from Oleander Avenue to South 25 Street by 1988. We think this will aid the flow of traffic from the pro- posed project. I would also like to point out that the Economyq also own property which extends to U. S. ~1, which will also ai~ in the flow of traffic. I would lik9 ~o,reserve some rebuttal time to respond to any.new evidence which may be presented to this Board in opposition to the' petitions. Mrs. Ferrick wanted to know if there were any existing businesses on th~ portion of property currently zoned commercial. Mr. Abe~nethy said that there was a very small used car lot on ~hat portion 9f the.property at the present time. However, it is not compatible with the proposed project, and it would not be allowed to stay there. Mrs. Fawsett wanted to know if the density of the CG (Com- mercial, General) zoned portion of the property was being in- cluded in the overall density of the proposed project. Mr. Abernethy deferred to Mr. Jack Scott, who said no, it WaS not. Mr. Sciturro asked what the time frame Was for construction 'e of the proposed pro3 ct. Mr. Abernethy said, "As soon as it is approved, as the owners are ready to develop this property." Mr. Sciturro asked Dennis Murphy for confirmation that Midway Road would be widened to four lanes, from U. S. ~1 to 0leander Avenue by 1987. Mr. Murphy said he wasn't sure of the specific dates involv- ed, but within the next 3 to 5 years, Midway Road is proposed to be improved to a four-lane section from U. S. ~1, west to 25th Street. It will be done in segments; the first high priority segment is the one between U. S. ~1 and Oleander Avenue. The County has to acquire right-of-way, and design time must be con- sidered. 1987 may~be a littletoo early, but it won't be much beyond that. Many of the same concerns expressed by some members of the Board at this meeting, were the same concerns expressed at the meeting of January' 23, 1986. Mr. Sciturro asked if there was any opposition to the peti- tion. Mr. Herbert Beach, President of the White City Improvement Club, Mrs. Arlene Goodman, F. H. Conrad, Jr. and Mrs. Nancy Smith all spoke in opposition to the petition, eXpressing grave concern with regard to the proposed multi-family housing development, citing in particular the potential heavy traffic congestion; the hazards in trying to evacuate so many people in the event of a nuclear disaster; serious flooding and drainage problems; little or no privacy for the residents of the area, and a density that -5- is too high to be compatible with the surrounding residential area. Mr. Sciturro declared a five minute recess. Mr. Wetherington left the meeting, and did not return. After the five minute recess, the meeting resumed. As no one else came forward to speak in opposition to the petition, Mr. Sciturro closed the meeting to the public. Mr. Carman made a motion to apDrove the petition. The motion was seconded by Mr. TerPening. Upon roll call, Mr. Sciturro, Mr. Carman and Mr. ~rpening voted in favor of the petition; and Mrs. Fawsett, Mrs. and Mrs. Ferrick voted against the peti- tion. ~r. PLANNING ANDZONING COMMISSION JANUARY 23, 1986 PUBLIC HEARING: Petition of Julia Economys as Trustee of the Nelen'Politis Revocable Trust, to amend the future land use classification of the St. Lucie County Growth Management Policy Plan from CG (Commercial, General) and RL (Low Density Residential Development) to RM (Medium Density Residential Development) for property located on the east side of Oleander Avenue between Midway Road and Weatherbee Road. Attorney Bruce Abernethy appeared to represent the petition. He showed the location of the project on the zoning map and said they are planning a 432 unit apartment and condo complex at a density of 9.9 units per acre. He stated Mr. Economys and Mr. Richard Stebbins, architect for the project were present and would answer any questions. Mr. Richard Stebbins came forward to present the conceptual site plan. He said they are proposing 12 two story buildings on 43 acres. They will be U shaped with parking in the center. this would allow for a buffer around the entire area. Entrance to the project would be from U.S. # 1 and Olenader Avenue, with egress to Town South Center. Most of the native~ foliage would be left and there would be retention ponds on the property. Mr. Abernethy said one very important factor is the rezoning does not include all of the land owned by the petitioner. They also own Parcel # 61, which is zoned Commercial, General, it has U.S # 1 frontage and will be used for ingress and egress to the project This would aleviate most of the pressure on Oleander Avenue. He said they felt they have a very postive traffic flow pattern through the project. The project has received very. favorable comments from the Planning Staff. Possibly because the entire area is developing at very high intensity uses. There is RM to the north, churches on two corners zoned Institutional, Commercial, General on U.S. # 1 and a Mobile Nome park to the northeast. There is some residential on Midway and Oleander. City water and sewer is on site and a fire station close by. The project will be buffered and isolated for tlhe surrounding areas. Mr. Sciturro asked Mr. Abernethy if they planned to use all of their U.S. # 1 frontage for ingress and egress. Mr. Abernethy said they have 250 ft. frontage on U.S. # 1, they will use 60 ft. along the northern boundary for the entrance. -17- Mr. Meyer asked Mr. Abernethy if his project intended to annex into the city and Mr. Abernethy said not at this time. Mrs. Ferrick questioned Mr. Abernethy about the ingress to Town South, she.said it appeared retention ponds were located in the same area. Mrs. Fawsett asked Mr. Abernethy what would prevent these roads from becoming a race track. Mr. Abernethy suggested they might use traffic bumps. Mrs. Ferrick also remarked that on the conceptual.drawing the swimming pool and recreation center would be very close to a residence on Oleander Avenue. A letter expressing their approval of the project from Town South Plaza was noted by Mr. Sciturro. Mrs. Arlene Goodman appeared to speak in opposition for a group of White City residents. She also presented letters of opposition from Mr. Arthur Niemoeller, Mr. and Mrs. William Nelson, Mr. Ed Hill and a message for Mr. Fred Ley. Mrs. Goodman expressed concern about drainage problems in White City, flooding during the last rain storm and the fact that White City has always been residential, mostly single family, and they want it to stay that way. She quoted from several newspaper articles. She said Mr. Economys knew what the property was zoned when he purchased it. Mr. Herb Beech, President of the White City Improvement Club, expressed concern that people would use Oleander Avenue for ingress and egress to Town South Plaza by way of this project. He said they were trying to create a nightmare by putting all of those units in an area that was flooded when Merritt Creek overflowed from the heavy rains. He said water was in the houses along Oleander Avenue and when more vetation is removed to build this project, there will be no place at all for the water to go except back into the peoples houses. As to the fire station mentioned earlier, Mr. Beech said ther are only five men on duty there. There is one fire truck and one rescue truck. If one or the other of them is out on a call only one or two men would be left in the fire station, that offers very little protection for this project or White City, he said. He said he felt this was very wrong and asked the Board not to allow this to happen. Mr. Terpening said the rains referred to were very unseasonable rains. If we throw out every petition where land.was flooded~ it would include about 85% of St. Lucie County. Buck Bucklen of 4906 Elm spoke in opposition to the petition. He said he just purchased his house, it is over 60 years old. He was under the impression White City would remain as it always has been. He said he is not against people moving into the area. He also owns a business on U..S. # 1 and Midway and since he has been there three people have been killed there. When we had the floods Mr. Bucklen continued, the retention ponds in Town South Plaza overflowed and flooded Oleander and Elm Avenue and they cut down the old oaks that were over 100 years old and it is really making a mess, now to build condos there is just too much. He said he was against it. Mrs. Nancy Smith spoke in opposition ot the petition, She said she lives next to Institutional zoning that has retention ponds and they have never been dry. During' the last heavy rains they overflowed 'with two and three feet of water over her yard and her mother-in-laws yard that never had flooded before. She said as it was explained to her, White City is in a low spot. The land is high on Indian River Drive and sloops until it gets to St. Lucie River. She said she has been in her house four years and has never seen the ditches cleaned out. Mr. Goodman said the house she lives in does not come up to the crest of the road and if this gentleman is going to build his condos 18 inches above the crest of the road, everyone else on oleander Av'~nue will be flOoded. Sh~' said she worked for 'a- contractor at one time and retention ponds don't mean anything. -18- Mr. Sciturro said Hawley Road certainly was flooded with two and one-half feet of water. Mr. F. H. Conrad spoke in opposition to the petition. He said he lives on South Indian River Drive and it takes him 1/2 hour longer to get tO work, the traffic is backed up 1/4 to 1/2 mile since they put all the turn lanes at Midway and U.S. # 1. As for the water situation, he said he andhis wife grew up in White City. and have seen the water over Midway road and the old w60den bridge at t'he park many times. Since they put that shopping center in that low hole and filled it up and the water runs into what you are calling Merritt Creek. It is just a ditch Old Man Merritt dug, he said he watched him dig it, the ditch is not large enough to take care of all the water from that parking lot, it overflowed and flooded Merritt Monument. If they clear off more land and put in another place, Mrs. Rick's house on Oleander will have two feet of water in it instead of one foot it had last time. The traffic and the water are both bad situations and retention ponds just do not do the job. Mr. Terpening said they are attempting to correct the traffic situation at Midway and U.S. # 1. Mr. Edward June of 4700 Oleander Avenue asked if they were going to tie into the sewer line and if it was adequate. Mr. Carman said they have already contacted the utilities department and it will be more than adequate. Mr. June wanted to know where the excess water is going to go.from the retention ponds. Mr. Carman said this Board isnot here to solve drainage problems. That will come up at Site Plan. That is not within the preview of this Board tonight. It really does not concern us. Mr. Murphy said this Board is only to be concerned with the merits of this project. Specific questions regarding traffic, drainage and everything else will come up if and when a Site Plan is submitted. Mr. Abernethy said one cannot forget the importance of Site Plan to handle drainage problems. Staff and this Board has been made aware of this problem and the developers will have to address it. Mrs. Goodman said GMPP was adopted two years ago and it shouldn't be changed, Mr. Abernethy said, that is the purpose of this Board,' to permit the flexibility in GMPP and zoning. Mrs. Goodman also made the statement White City is all single family residential, Mr. Abernethy said this is not the case, there is a major shopping center and some very large car dealersadjacent to this property. The Board also needs to recognize the fact that they have ingress and egress off U. S. # 1 and Oleander, there is no Midway access. The question of fire service that has been raised will be addressed at Site Plan. Mr. Carman made a motion to approve the petition and Mr. Terpening seconded it. Mrs. Fawsett said she was afraid she would have to vote against the petition. She thought it was far too high a density in this area. There may be high density along U.S. #1 but there are many single family homes in the area and she did not think they needed that high density in the area. Mr. Wetherington said he called some of the neighbors he knew in the area and asked about their feelings on the petition. It is unfortunate the White City Improvement Club objects to most every thing. When Mrs. Goodman came up for her petition, thms same group opposed her.
