WHEREAS, the Board of COunty Commissioners of St. Lucie
County, Florida, has made the following determinations:
1. Andrew CaSai presented a petition for a change in zoning
f=om RS-2 (Residential, Single Family - 2) 'to CN (Commercial,
Neighborhood) for the property described as follows:
Lot 8 & 9, Block 33, Indian River Estates
Unit 4
(Located-on the north side of White City Road
and 200 feet west of White City Road and
Silver Oak Drive Intersection).
2. The St. Lucie County Planning and Zoning Commission,
held a public hearing on the petition, after publishing notice at
least fifteen (15) days prior to the hearing and notifying by
mail owners of property within five hundred feet (500') of the
subject property, and has recommended that the Board deny the
hereinafter described request for change in zoning classification
from RS-2 (Residential, Single Family - 2) to CN (Commercial,
Neighborhood) for the property described above.
3. On June 24, 1986, this Board held a public hearing on
the petition, after publishing a notice of such hearing in the
Fort Pierce News Tribune on June 4, 1986, and notifying by mail
all owners of proPerty within 500 feet of the subject property.
4. The proposed change in zoning classification would be in
violation of the commercial locational requirements as identified
in the St. Lucie County Growth Management Policy Plan.
NOW, THEREFORE, BE IT RESOLVED by the Board of -County
Commissioners of St. Lucie County, Florida:
The petition for a zoning change filed by Andrew Casai is
hereby denied.

The Planning and Zoning Commission recommended to the Board of
County Commissioners denial of the petition of Andrew Casai
from RS-2 (Residential, Single Family - 2)
for a chang in zoning
to CN (Commercial, Neighborhood) for the following described property:

Estates Unit 4
(Located on the north side of White City Road and 200 feet west of

The Board of County Commissioners will hold a public hearing on
this petition at 1:30 P.M. on Tuesday, June 24, 1986, in Room 101,

MINUTES - MAY 22, 1986
PUBLIC HEARING:
Petition of Andrew Casai for a change in zoning from
RS-2 (Residential, Single Family - 2) to CN (Commercial,
Neighborhood) for property located on the north side
of White City Road, and 200 feet west of White City
Road and Silver Oak Drive intersection.
STAFF COMMENTS: County Staff has completed
its review of this petition, and finds, at this
time, it must recommend against this requests.
The reasons for this recommendation are as follows:
1. Specific policies within the Growth Manage-
ment PoliCy Plan indicate that Neighborhood
Commercial development should only take place
in those areas that afford a reasonable clustering
of uses. Strip or spot rezonings within resi-
dential areas should be avoided.
2. Staff has consistently recommended against
the introduction of any commercial zoning along
this portion of East Midway Road in order to
preserve as much of the residential character
of the area as .possible.
Mr. Sciturro asked if anyone was present to speak
for the petition.
Dennis Murphy said:
Mr. Chairman, and members of the Board, Mr. Casai
was sent notice of this hearing. He also received
Staff's comments, which is normal procedure. However,
all those letters and notices were returned, "Address
Unknown" The address was the one given us by Mr.
Casai on his petition application.
Our office has not been contacted by Mr. Casai,
or anyone representing him.
Mr. Terpening asked Krista Storey, Assistant County
Attorney, if it was permissible to hear the petition
without the Petitioner being present.
Krista Storey said that it was the Petitioner's
choice to attend, or not to attend the hearing.
That since the Planning Staff had advertised the
petition and hearing date in the newspaper, attempted
to notify the .Petitioner by letter with the inclusion
of Staff's Comments; that all notice requirements
had been fulfilled. Ms. Storey said that she didn't
see any reason why the Board should not hear the
petition.

should only take place in those areas that afford a
reasonable clustering of uses. Strip or spot rezonings
within residential areas should be avoided.
2. Staff has consistently recommended against the
introduction of any commercial zoning along this portion
of East Midway Road in order to preserve as much of the
residential character of the area as possible.

On Tueisday, 3une.24, 1986, you will be asked to review a
Rezoning P~tition on behalf of. Andrew Casai for property on East
Midway Roadi and'Magnolia Drive. On Thursday, May 22, 1986, this
Petition was presented to the Rlanning and Zoning Commission for
review. A~ this.meeting, no one came forward to speak on behalf
of this P~tition. Notice of this hearing was sent to the
Retitioner. However, it was returned due to an insufficient
address. The address used was that indicated on the application.
At this hearing, a Petition was submitted by the residents of
Indian River Estates containing 43 signatures, as well as,
another Petition reportedly containing 356 signatures opposing
this Retition. At this meeting,~ the Rlanning and Zoning
Commission i voted unanimously to recommend denial of this
Retition. iAttached you will find copies of the original Staff
Report onthis item .and the minutes of the May 22, 1986 meeting.

The Planning and Zoning Commission recommended to the Board of
County Commissioners denial of the petition of Andrew Casai
for a change in zoning from RS-2 (Residential, Single Family - 2)
to CN (Commercial, ~Neighborhood) for the following described property:
Lot 8 & 9, Block 33, Indian River
Estates Unit 4
(Located on the north side of White City Road and 200 feet west of
White City Road and Silver Oak Drive Intersection).
The Board of County Commissioners will hold a public hearing on
this petition at 1:30 P.M. on Tuesday, June 24, 1986, in Room 101,
St. Lucie County Administration Building, 2300 Virginia Avenue,
Fort Pierce, Florida. All interested persons will be given an
opportunity to be heard at that time.

With refer.ence to the above, as owners of residential P~. Lot~5, ~o~ B~Y~w~emy wife
Louise and I a~e definitely opposed to Mr. Casai~s petition for such a change.
To grant such a drastic change in the zoning law would not only violate St. Lucie
County's growth and policy plan, but would definitely decrease our property value as
well as all other taxpayer,s property values within the neighborhood.
Therefore, why should one taxpayer be allowed to substantially increase the value
of his property(just recently acquired) and as a consequence adversely affect the
value of so many Single residence property owners? In my opinion, to grant such
a request would be outright discrimination.
Therefore~ prior to making a decision relative to such an important matter, we
request that each of you vote with the,thought in mind as to how you would vote
should this same situation be happening in your own back yard or within your
neighborhood.
We regret that we cannot be present at the public hearing Thursday, May 22, 1986
to personally voice our opposition to Mr. Casai~s unreasonable request, but due
to our being out of town on that date, .it will be impossible to attend the meeting.
Therefor, we request that this letter be read during the meeting and be in-
