HomeMy WebLinkAboutCallaway Land & Cattle Co (6)FILE NO.: RZ-89-014 A RESOLUTION GRANTI~-FRE~ARY DEVELOPEMNT PLAN APPROVAL FOR~ECTION II ~F THE RESERVE WHEREAS, the Board of County Commissioners of St. Lucie County, Florida, has made the following determinations: 1. On April 27, 1989, the St. Lucie County Planning and Z~ning Commission held a public hearing of which due public notice was published in the Ft. Pierce News Tribune and mailed to all property owners within 500 feet at least 15 days prior to the hearing, and recommended to this Board that Preliminary Development Plan approval for Section II of The Reserve - Planned Unit Development be granted. 2. This Board held a public hearing on May 23, 1989, of which due public notice was published in the Ft. Pierce News Tribune on May 3, 1989 and mailed notice was sent to all property owners within 500 feet. 3. The proposed project is consistent with general purpose; goals, objectives and standards of the St. Lucie County Zoning Ordinance, the St. Lucie County Growth Management Policy Plan and the Code of Ordinance of St. Lucie CountY. 4. The proposed project will not have an undue adverse effect on adjacent property, the character of the neighborhood, traffic 6 3 92/,i. 5 conditions, utility facilities or other matters affecting the parking health, safety and general welfare, if subject to the conditions as outlined in Section A below. 5. The proposed project will be consistent with the character of existing land uses in the area. 6. The proposed project will; not interfere with the development and use of neighboring property, if subject to the conditions as outlined in Section A below. 7. The proposed project will not contravene any applicable portions of the St. Lucie County Growth Management Policy Plan, if subject to the conditions as outlined in Section A below. NOW, THEREFORE BE IT RESOLVED, Commissioners of St. Lucie County by the Board of County A. Pursuant to Section 3. 3. 121 of the St. Lucie County Zoning Ordinance, Preliminary Development Plan approval for Section II of The Reserve - Planned Unit Development be, and the same is hereby, approved as shown on the drawings for the project prepared by Team Plan Inc. & Karner & Associates, Sheets 1 thru 17, dated September 1988, and date stamped received by the Department of Community Development on March 23, 1989, and as further described in the accompanying submissions prepared by Karner and Associates and attached as Exhibit B, subject to the following conditions: THE RESERVE SECTION II SPECIAL CONDITIONS ALL TERMS AND CONDITIONS OF ST. LUCIE COUNTY RESOLUTION 89-73, THE DEVELOPMENT ORDER FOR THE DEVELOPMENT .OF REGIONAL IMPACT KNOWN AS THE RESER~-~-~; ARE INCORPORATED BY REFE~NCE AND SHALL BE COMPLIED WITH, AS REQUIRED THEREIN. PRIOR TO THE ISSUANCE OF ANY DEVELOPMENT AUTHORIZATIONS FOR ANY ACTIVITY WITHIN THE AREA DESCRIBED AS THE RESERVE - SECTION II, INCLUDING ROAD, GOLF COURSE AND DRAINAGE NETWORK CONSTRUCTION, FINAL APPROVAL FOR THOSE AREAS IN WHICH THE ACTIVITY IS PROPOSED MUST BE SECURED IN ACCORDANCE WI TH THE PROVISIONS OF SECTION 3. 2. 121, ST. LUCIE COUNTY ZONING ORDINANCE. EACH APPLICATION FOR FINAL DEVELOPMENT PLAN APPROVAL MUST INCLUDE A DETAILED SITE PLAN FOR THE SUBPARCEL, INCLUDING ALL THE ENGINEERING AND ARCHI TECTURAL I NFORMATI ON. EACH APPLICATION FOR FINAL PARCEL APPROVAL MUST BE ACCOMPANIED BY THE REQUIRED APPLICATION FEE OF $600, WHICH IS USED TO DEFRAY THE COSTS ASSOCIATED WITH PROJECT REVIEWS AND PUBLIC HEARING PROCESSING. THIS APPLICATION FEE MAY BE AMENDED FROM TIME TO TIME, CONSISTENT WITH THE STANDARD FEE SCHEDULES OF THE DEPARTMENT OF COMMUNITY DEVELOPMENT, WITHOUT AMENDING THIS RESOLUTION. The application for rezoning is a part of the Planned Unit Development approval process for the development known as The Reserve. County staff has reviewed this petition and determined it consistent with the Land Development Policies of the St. Lucie County Growth Management Policy Plan, if subject to those conditions as outlined in the attached Resolution 89-143. On Thursday, April 27, 1989, the St. Lucie County Planning and Zoning Commission held a public hearing on this petition, and following some discussion on the terms of the recommended conditions of approval, unanimously voted to recommend approval to this development project. Ms. Regina Karner presented the petition. She chose to stand on her comments made in the previous petition, File No. RZ-89-014. Regarding Staff comments, Mr. Murphy referenced Staff's comments made in the previous petition, File No. RZ-89-014, and stated that Staff has reviewed the proposed development plan and -determined it consistent with the approved Development Order for The Reserve Development. of Regional~ Impact, and recommended approval of the .petition subject to the inclusion of the recommended conditions, as amended with Staff's concurrence. Permitted Uses Any use permitted in the Residential, Single-Family_ 2 (RS-2); Residential, Estate (RE-2); Residential,Single_Family_3 (RS-3); Residential, Single-Family_4 (RS-4) (RS-5); Residential; Residential,Single_Family_5 , Mobile Home (RMH-5); Residential, Multiple-Family_il (RM-11); and Residential, Mult£ple-Family_18 (RM-18) zoning districts of thls Ordinance may be permitted in a Planned Unit Development district for a variety of residential densities. Uses of the types permitted in the Commercial, Neighborhood (CN) District are also permitted up to an amount not to exceed three (3) percent of the gross arsa of the Planned Unit Development. In addition, playgrounds, public and non-public parks, golf courses, country club bicycle paths, racquet sports facili~'cles, ridingS' stables, marinas, clubhouses, and lodges may be permitted in a Planned Unit Development District. On North and South Hutchinson Island, the provisions of Section 3.3.122(7) and (8) shall govern. Area, Yard~ and Height Requirements Area, yard, and height requirements shall be determined at the time of Preliminary and Final Development Plan approval. Public Facilities The Planned Unit Development shall be designed and located so there w111 be no net public cost for the provision of water lines, sewage lines, storm and surface drainage systems and other utility systems. , Traffic and Pedestrian Circulation (i) Every dwelling unit, or other use permitted in the Planned Unit Development shall have access to a public street either directly or through an approved private road, a pedestrian way, or other area dedicated to public or private use. 129 (i) (i) Offstreet parking and loading areas shall be arranged so as to prevent through traffic to other parking areas. (ii) No more than fifteen (15) parking spaces shall be permitted in a continuous row without being intecrupted by landscaping. (iii) Offstreet parking and loading areas shall be screened from adjacent roads and pedes- trian watkways with hedges, dense planting, or changes in grades or walls. All lighting facilities shall be arranged in such a manner so as to prevent direct glare or hazardous interference of any kind to adjoining streets or properties. (J) ~nd Natural Features (i) Native trees and vegetation and other natural features shall be preserved to the extent practicable. (ii) Ali sensitive environmental vegetation, trees and areas shall be preserved to the extent practicable. (iii) Landscaping for offstreet parking and loading areas shall meet the minimum requirements of Section 3.2.600. (k) Open Space Standards (i) A minimum of thirty (30) percent of the gross area of land to be committed to a Planned Unit Development must be for use as parks, recreation areas, marinas, swim- ming beaches, open space, planting, or other public purposes other than rights- of-way, utility easements, and parking areas. At least fifteen (15) percent of the total area of the Planned Unit Devel- opment shall be common open space for recreation or park use. At the request of the developer and subject to the approval of the 8card of County Commissioners, use of recreational facilities may be offered to the general public. (iii) Notification of the Board of County Com- missioners, decision shall be mailed to all parties and filed in the Office of the Oevelopment Coordinator, in accordance with Section 5.1.200(5). (iv) Approval of the Final Development Plan by the Board of County Commissioners, togeth- er with the acceptance of all conditions associated with that approval, shall con- stitute a certified Final Development Plan. (v) Upon certification by the Chairman of Board of County Commissioners, three (3) copies of the Final Oevelopment Plan shall be signed and one (i) copy returned to the applicant with two (2) copies being re- tained by the Development Coordinator as a part of the public record. Development of the Planned Unit Development shall not be carried out until the applicant has secured all other per- mits and approvals required by the County. Limitation of Final Plan Approval Within one (I) year after Final Development Plan approval, or such shorter time as may be established by the development schedule approved by the Board of County Commissioners, construction shall commence in accordance with the approved Final Development Plan. Failure to commence construction within that period shall, unless an extension shall have been granted by the Board of County Commissioners, automatically render null and void Final Oevetopment Plan 141 (8) approval, the Preliminary Development Plan approval upon which Final Development Plan approval depends, and alt county permits based on such approvals. Adjustments to an Approved Final Oevelopment Plan During Oevelopment During development of an approved Planned Development, adjus~ents to the approved Development Plan may be permitted as follows: (a) Minor Adjustments Unit Final The Development Coordinator may authorize minor adjustments to the approved Final Development Plan. Such minor adjustments shall be consis- tent with the intent and purpose of the St. Lucie County Comprehensive Plan, this Ordi- nance, and the Planned Unit Development as approved, and shall be the minimum necessary to overcome the particular difficulty. Such minor adjustments shall be limited to the following: (i) Increasing any dimension of any one (1) structure by not more khan ten (10) percent. (ii) Altering the location of any one (1) structure or group of structures by not more than fifty (50) feet. (iii) Altering stage or percent. the net density of any one (1) phase by more than ten (10) (iv) Altering the location of any circulation element by not more than fifty (50) feet. (v) Altering the location of any open space by not more than fifty (50) feet. (vi) Reducing the total amount of open space by not more than five (5) percent or reduclng the yard area or open space associated with any single structure by not more than five (5) percent. (vii) Altering the location, type, or quality of landscaping elements. Notice of the authorization of such minor ad- justments shall be provided to the 8card of County Commissioners. 142 (lO) (11) welfare, take any such necessary action to stop such noncompliance. (c) Action by Board of County Commissioners Within thirty (30) days following notification by the Development Coordinator, the Board of County Commissioners shall determine whether development of the Planned Unit Development is proceeding in accordance with the approved Final Development Plan. If the Board of County Commissioners finds the development is not proceeding in accordance with the approved Final Development Plan, it shall either revoke the Planned Unit Development approval or compel compliance. Inspections A{~-er Development (a) Inspections by Development Coordinator Following completion of the development of a Planned Unit Development, the Development Coor- dinator shall review the development as com- pleted and determine if it complies with the approved Final Development Plan. (b) Action by Development Coordinator If the Development Coordinator finds that the development as completed fails in any respect to comply with the Final Development Plan as approved, he shall immediately notify the 8card of County Commissioners of such fact. (c) Action by the Board of County Commissioners Within thirty (30) days following notification by the Development Coordinator, the 8card of County Commissioners shall determine whether the completed Planned Unit Development fails in any respect to follow the approved Final Devel- opment Plan. If the Board of County Commis- sioners finds the completed Planned Unit Devel- opment fails in any respect to comply with the Final Development Plan, it shall either revoke the Planned Unit Development, or take the necessary action to compel compliance.
