LUCIE ~U~Y, ~O~IA WHEREAS, the Board of County Commissioners of St. Lucie County, Florida, has made the following determinations: 1. On August 21, 1984, this Board adopted Resolution No. 84-129 which granted Final Development Plan~ Approval for a portion of the Reserve Planned Unit Developmen~t~- and changed the zoning classification of certain property located in St. Lucie County, Florida. 2. On September 10, 1985, this Board adopted Resolution No. 85-194 which amended condition number two (2), Paragraph A of Resolution No. 84-129. 3. On OctoberT 28, 1986, this Board held a public hearing, of which due notice was published in the Fort Pierce News Tribune and mailed to all property owners within 500 .feet at least 15 days prior to the hearing, to consider amending condition number three (3) , Paragraph A of Resolution No. 84-129 to permit a maximum of 406 units in that area North of Reserve Boulevard, more particularly described in Section C of Resolution No. 84- 129. NOW, THEREFORE, BE IT RESOLVED by the Board of Co unty Commissioners of St. Lucie County, Florida: A. Condition three (3) of Paragraph A of Resolution No. 84- 129 is hereby amended' to read as follows: 3.) the developer shall not apply for or be entitled to receive any final parcel approvals, building permits or certificates of occupancy that would cause the total number of approved, permitted or occupied units in the area identified in Section C of Resolution No. 84-129 to exceed 406, until such time as a complete Development of Regional Impact Application has been reviewed and approved by the Treasure Coast Regional Planning Council through the issuance of a recommended Development Order pursuant to Chapter 380.06, Florida Statutes. B. At that time, several conditions of approval were placed on this project including a restriction that the developer,and his sucssors, would not be eligible to apply for or receive any building permits beyond that area identified as Phase I on the preliminary plan. This restriction would be released upon the developer seeking approval of this project as a Development of Regional Impact un,er Section 380.06, Florida Statutes. This condition was made with the full knowleGge and understanding of the developer. At. this time, the devel-oper is requesting that condition Number 3=, Section A, Resolution 84-129, be amenGed to allow them to receive final approvals for up to 406 units in that area north of Reserve Boulevard.~ This figure was derived from staff discussions with the developer that effectively limit this project to a maximum of 750 units until the completion of the Development of Regional Impact process. The remaining 344 units would be located in that area south of Res'erve Boulevard generally known as "Sable Creek" and "Plantation at The Reserve". The specific wording of Condition Number 3, Section A, Resolution 84-12~ would now be: the developer shall not apply for or be entitled to receive any final parcel approvals, building permits or certificates of occupancy that would cause the total number of approved, permitted or occupied units in the area identified in Section C to exceed 486, until such time as a complete Development of Regional Impact Application has been reviewed and approved by the Treasure Coast Regional Planning Council through the issuance a recommended Development Order pursuant to Chapter 380.06, Floirda Statutes.
