the Boaro of County Commissioners following review of a proposeo

considered as consistent with the spirit and intent of the

DEPARTMENT OF STATE; EFFECTIVE DATE-
ADOPTION; AND CODIFICATION '
WHEREAS, the Board of County Commissioners of St. Lucie
County, Florida, has made the following determinations:
1. Article VIII, Section l(f), Florida Constitution, and
Section 125.01(1)(h), Florida Statutes, authorizes and empowers
this Board to establish, coordinate, and enforce zoning
regulations as are necessary for the protection of the public.
2. In order for electrical repair services, radio and
television repair services, and watch, clock and jewelry repair
services to be allowed as permitted uses in CN Commercial,
Neighborhood zoning districts; and in order for household
appliances and radios, televisions and music supplies to be
allowed under retail trade as permitted uses in CN Commercial,
Neighborhood zoning districts, it is necessary to amend Section
3.3.110(2) of the St. Lucie County Zoning Orinance (Appendix A of
the St. Lucie County Code of Ordinances).

hearing, due notice of which had been published at least fifteen
(15) days in advance, to consider amending the text of the St.
Lucie County Zoning Ordinance, as set out in this ordinance.

Lucie County Planning and Zoning Commission have recommended that
the Board approve the proposed amendment.

Special acts of the Florida legislature applicable only to
unincorporated areas of St. Lucie County, and adopted prior to
January 1, 1969, County ordinances and County resolutions, or
parts thereof, in c~onflict with this ordinance are
superseded by this ordinance to the extent of. such conflict.
PART C. SEVERABILITY AND APPLICABILiTy.
If any portion of this ordinance is for any reason held or
declared to be unconstitutional, inoperative, or void, such
holding shall not affect the remaining portions of this
ordinance. If this ordinance or any provision thereof shall be
held to be inapplicable to any person, property, or circumstance,
such holding shall not affect its applicability to any other
person, property, or circumstance.
PART D. FILING WITH THE DEPARTMENT OF STATE.
The Clerk is hereby directed forthwith to send a certified
copy of this ordinance to the Bureau of Administrative Code and
Laws, Department of State, The Capitol, Tal!ahassee, Florida,
32304.
PART E. EFFECTIVE DATE.
This ordinance shall take effect upon receipt of official
acknowledgement from the Office of the Secretary of State that
this ordinance has been filed in that office.

Dear Local Government Official:
Provisions for the amendment of local comprehensive plans
under Section 163.3187, Florida Statutes, provide that plan
amendments may be made no more than two times per calendar year
unless it is an allowed exception.
The 1986 Legislature amended these provisions to allow local
goverrments to exempt "smalJ. scale development,, amendments. It
also required that each local government submit a semiannual
report on small scale amendments.
To meet this requirement, please indicate on the enclosed
form the requested information regarding each of the plan
amendments that were processed as small scale development
exemptions ~uring the period from January 1, 1987 through June
30, 1987. If no small scale development amendments were
processed during this period, please indicate "Not Applicable- on
the form. However, if it is Your policy to not utilize the small
scale development exemption, please indicate this on the form.
In accordance with the statute a completed report is due to
the Department by July 1, 1987. However since Your report must
do=nment any amendments through June 30 the report forms will be
accepted by the Department until July 30 1987, and should be

BACKGROUND:
Frank Sperduto has petitioned for a change in zoning from CN
(Commercial, Neighborhood) to CG (Commercial, General) and to
amend the future land use classification set forth in the St.
Lucie County Growth Management Policy Plan from RL (Low Density
Residential Development) to CG (Commercial, General) for certain
property located ~at 5208, 5210, and 5212, Sunshine State Parkway
Feeder Road. On May 28, 1987, the Planning and Zoning Commission
voted 5 to 1 to, recommend that the Board deny the petition. Also
o~n May 28, 1987, the Local Planning Agency voted five to one to
recommend that the Board deny the amendment to the future land
use classification set forth in the St. Lucie County Growth
Management Plan. Consistent with Board polic~, staff has drafted
a resolution approving the proposed zoning change and an
ordinance amending the future land use classification set forth
in the St. Lucie County Growth Management Plan.
RECOMMENDATION/CONCLUSION:
Staff recommends that the Board deny the attached Resolution
and Ordinance.

WHEREAS, the Board of County Commissioners of St. Lucie
County, Florida, has made the following determinations:
1. Frank~ Sperduto presented a petition for a change in
zoning from CN (Commercial, Neighborhood) to CG (Commercial,
General) for the property described below.
2. The St. Lucie County Planning and Zoning Commission,
held a public hearing on the petition, after publishing notice at

On Thursday, May 28, 1987, tne Local Plannlng Agency held a
puDllc nearlng on tnls petition. At that nearlng, several
residents of the LakewooO Park area spoke in opposition to the
petition. Following discussion on tnls lssue and citlng the
StanOarOs of Revlew contained in our staff memorandum of May 20,
1987, the Local Plannlng Agency voted 5 to 1 to recommend Oenlal
of this petition.

COIiMENTS
The petitioner, Frank SperOuto, is proposing to amend the
Land Use designation of the property on which the existlng
Lakewooo Park Plaza is Iocated. The petitioner is proposing to
ameno this Land Use designation so that a wider variety of
tenants may use this center.
During the 1984 comprehensive rezoning reviews, staff lOOked
at this area for possible designation as Commercial General' (CG)
use. When presented to the 8card of County Commissioners, ano
after taking into account the concerns of the Lakewooo Park
Homeowners Association, the Board Declined to initiate a Plan
AmenDment petitlon for this area to Commercial General. Board
comments, at tnat time, were that they wOUld rather see this area
used for low intensity Commercial uses, such as permitted in the
Commercial Neighborhood zoning district. Staff is not aware of
any changed physical conditions in this area for some time.
