S. #lel°cated for the establiskment of multiple dwellings on the 4 acre tract. The Planning & Zoning Co~ssion unanimously approved the petition. Mr.~Goeringer was present and asked that the petition, be approved. ~ ~ ~ere was considerable discussion because~the development is to be located 300' East of U. S.. #1-on unpaved Dyer Road, which although is a dedicated public road, has not been accepted for maintenance by the Count~. Cc~. McCain advised that some financial institutions will not ]end money for develop- ments_.on unpaved roads and asked Mr. Goeringer~f he had dis6ussed this with other property owners on 'the road to which Mr. Goeringer replied-that while he did not, he felt others would_be developing in the near future and they~cmight be able to share costs.~ Com. McCain moved t6 approve the petition which died for a lack of a second. ~. Com. Enns came into the Meeting. Com._Green stated-that development on this unpaved road will only escalate problems which_now exist and Com. Price moved to deny the petition, which died for a lack of a second. Com. Park asked if a developer could be required to pave the road at site development time and Atty. Adams advised that the Board could'require this. Com. Green pointed out that there would be about 550' to be paved for site development approval and asked Mr. Goeringer how he felt about it, but Mr. Goeringer said if this was the situation the chances were that others on the road Would be in the same position andtthat probably somethln.g COuld ~e worked out. ~om. Park moved to approve %he petition (included in Resolution No. 79-35) which was seconded by Com. McCain. Goeringer, for a change in zoning classification from A-1 (agriculture) to R-4B (multiple dwellings) for property located on the South side of Dyer Road, 300 ft. East of U. S. #1. Mr. Goeringer stated that the adjacent land on the South side is resi- dential and the other 3 sides is agricultural property. Mr. Scott read a letter from Joel F. Wynne, President of Spanish Lakes, stating they have no objection to the rezoning request provided the area ms properly buffered. Mr. Curtis Whitecar had no real objection to the rezoning request except his thoughts on multiple dwellings is the lack of parking area. He further stated that he has made a proposal to Florida Power and Light for the sal? of his land (330 ft. of Tract 14) for a substation ~ Mr. Ament's comments were read into the public record by Mr. Scott. Motion by Mr. Ebner to approve the petition; seconded by Mr. Tiernan. The Board was po!led and %he motion passed unanimously. The Planning and Zoning Commission will recommend to the Board of County Commissioners approval of this petition. MEMORANDUM TO~ FROM: DATE: SUBJECT: Planning and Zoning Commission County Development Coordinator March 20, 1979 March 22, 19~, Rezoning Public Hearings .(3) GOERINGER (A-1 to R-4B) Existing Land Use: The proposed rezoning is currently vacant, as is land to the east and north. Medium Density Residential development exists to the south of the proposed zoning. Future Land Use: Medium Density Residential. COMMENTS: The proposed rezoning is consistent with future land use plans for the area. The Planning and Zoning Commission should consider, however, that access to this four (4) acre tract wou~d be via un- paved Dyer Road.
