A RESOLUTION GRANTING A SIX MONTH
EXTENSION TO THE pRELIMINARY DEVELOPMENT PLAN
APPROVAL FOR THE PROJECT KNOWN AS
OCEAN PUD
WHEREAS, the Board of County Commissioners of St. Lucie
County, Florida, has made the following determinations:
On November 24, 1992, this Board, through ResOlution 92-
238, granted Preliminary Planned Unit Development (PUD)
Plan approval for the project known as Ocean PUD, a 101
unit residential development, located on South Hutchinson
Island, just south of the Middle Cove Beach Access point.
Under the terms of Resolution 92-238, the Preliminary
Planned Unit development Plan approval for Ocean PUD is
scheduled to expire on Nogember 24, 199.3, unless Final
Planned Unit development approval has been obtained or an
extension applied for, and granted~ under the provisions
o~ Section 11.02.06(B)(3), St. Lucie County Land
Development Code
The developer of Ocean PUD has requested that the
Preliminary Planned Unit Development (PUD) plan approval
for this project be extended for a six (6) month period,
which would expire on May'24, 1994.
On December 14, 1993, this Board held a public hearing, on
the petition, after publishing a notice of such hearing
in the Port St. Lucie News on November 23, 1993 and
notifying bymail all owners of property within 500 feet
of the subject property.
NOW, THEREFORE, BE IT RESOLVED by the Boar'd of County
Commissioners of the St. Lucie County, Florida.:.
Pursuant-to Section 11.02.06[B)(3) of the St. Lucie
County Land Development Code, that the Preliminary

Ocean PUD.- Request for six (6) month extension to
the projects Preliminary Development Plans
Attached you will find a copy of Draft Resolution 93-254 which if
approved, would authorize a six (6) month extension' to the
Preliminary Development Plan approval granted to the Ocean PUD
project. If denied, this projects Preliminary Plan Approval would
now expire on May 24, 1993.
Ocean PUD is a proposed 101 unit residential development. Ocean PUD
is located on South Hutchinson Island, just south of the Middle
Cove Beach Access point. Most of-the residential units within this
project, are proposed detached single fam{ly dwellings, with all
development activities taking place between SR A-1-A and the
Atlantic Ocean. .
Attached you will..find a copy of the specific request for PUD
extension submitted to this office. The applicant has cited the
reasons why this request should be granted. They are still in the
process of completing final perm{tting with-the State of Florida
and that the County has not yet finally decided on the new South
Hutchinson ISland Waste. Water Treatment Facility.
County staff has reviewed-this request for consistency with the
County's Comprehensive Plan and Land Development COde.. County staff
has determined that the reasons cited are consistent with previous
Board considerations under similar circumstances. We would further
note that under the provisions of Section ll.02.06(B)(3),-St. Lucie
County Land Development Code, the developer is entitled to receive
an extension to this plan.for up to 12 months from the original
date of expiration. Any extension, beyond that 12 month period will

Pursuant to paragraph C. of the above referenced resolution and paragraph 11.02:06.B.3 ofthe
St. Lucie County Land Development Code, request is hereby made for extension of the
Preliminary Development Plan approval granted by that resolution on November 24, 1993. The
reasons for the .request for extension are as follows:
1. The owners have not been able to obtain the necessary approvals from the
Department of Environmental Protection and the U.S. Army Corps of Engineers.
Applications were filed and the responses requesting additional information have
been received. The basis of virtually all the questions (other than technical
requirements) revolves around the concept of minimi?ation of impact on the
environmentally sensitive areas - in this case the impounded wetlands between the
back dune area and SR'A-1-A_ In an effort to better utilize the available land the
owners have entered into a contract to purchase one parcel south of the existing
property line, and are entering into a conditional venture agreement with another.
The goal ofthi.q acquisition program is to achieve a layout that has less adverse
impact on the wetlands, and maintains the unit density ofthe existing plarL
Jurisdictional surveys have been performed on the total land area. east of SR
A-l-A, and environmental and planning efforts have begun. In order to complete'
this work and preserve the validity of the pending applications, we request an
extension of the preliminmy approval.
2. Recent negotiations between St. Lucie County, the South Hutchinson Island
Waste Water 'Treatment District, and several landowners have raised questions
regarding sendce to the land north of the FPL Plant. I have attended several
meeting and have been asked by the County Administrator and County AttorneYto
work with the Camp Dresser-& McKee consultants to determine what type of -
program might be structured for these owners, and to estimate the financial impact
on these properties from 'Joining" the district. The answers and the decisions made
by other owners will.have a significant effect on our development parameters,
especially with the recent decision to locate the plant further south. We therefore
need additional time to .complete the engineering analysis and work with other land
owners in the area that are similarly affected.

The extension request and other studies being performed in no way are intended to reduce or
eliminate any of the provisions agreed to as a part of the resolution. The owners recently obtained
an extension of the license agreement to utilize Middle Cove BeaCh Access, and an extension of
the commencement date for the Mangrove Alteration and Trimming Permit, MP-93-01.
(Reference letter of October 10, 1993 from Dennis Murphy, Land Development Manager). Work
has begun on site under these permits and a DNR permit to remove exotic species and perform
dune restoration.
Based upon the mitigation work currently being performed, and the factors outlined above, I
respectfully request a 6 month extension of the Preliminary Plan Approval.
