APPROVAL OF PLANNING AND ZONING COMMISSION MINUTES OF REGULAR
MEETING OF ~EPTEMBER 24, 1992.
Ms. Calabrese made a motion that the~Planning and Zoning Commission
approve the minutes of the Regular Meeting of September 2_4, 1992.
Mr. Sattler seconded the motion, and upon roll call, the Board
voted in favor of the motion.

~'. Luis Serna presented staff co~ents. He stated that this
petition is for pretim~ Planned Unit Development approval for
a project to be ~o~ as Ocean. The property proposed for the
development is a 30 acre parcel located on the east side of State
Road A-l-A, directly south of the ~ddle Cove Beach Access. He
stated that the plan for Ocean PUD is for. a 100 unit residential
development. The applidants are proposing 95 single f~ily
residential units and six multi-f~ly residential-units to be
located within a single four-sto~ structure in the center of the
pro~ect.
Mr. Serna stated that the applicant has agreed to dedica~ the

Mr. Serna stated tha~'staff has reviewed this petition based on the
concept presented in the site plan and its potentialimpacts on the
environment, surrounding properties and upon public facilities. He
stated that this ~etition is consistent with all applicable
Standards of Review established in the Land Development Code.
Mr. Serna stated that the draft Resolution that was included in the
Commissioners- packets, which would grant preliminary.PUD approval
to the proj6c%, had been revised to detail the parcels~which were
to have been dedicated'to the County as part of the petitioner,s
prior permit approvals.
Bill Miller, Planning Directorpresented each Commissioner with a
revised copy of draft Resolution No. 92-238.
Mr. Serna stated that staff recommends that this petition be
forwarded to the Board of County Commissioners with the
recommendation of approval, subject to the following conditions:

Mr. Klein asked Mr. Serna for clarification regarding the 300 feet
the petitioner would be donating to the County.
Mr.. Serna s%a%ed that it would be the south 300 feet of Government
Lot 1.

Mr. Serna stated yes, that the dedication of land on the West side
of State Road A-1-A was a condition that was placed upon a
previously approved project on the same property.
Mr- Carman asked whether or not it was all low lands.
Mr. Serna stated yes, the parcels are primarily mangrove areas.
Mr.buildable.Klein asked whether or not any of the dedicated land would be

Mr.. Serna stated if the'wetland areas were filled in it could be.
Mr. Serna stated that the dedication of land to the County will
mitigate the alteration of the wetland and dune areas.
Mr. Klein asked whether or not the dedication of the 300 feet of
property necessary to' meet concurrency regarding parks.
Mr. Serna stated no, that this is not a concurrency issue.

acres are classified as mangrove areas and 13.38 acres are
classified as land. The 13.38 acres classified as land are not
particularly useable, it is basically what was left over when the
State Road A~I-A right-of-way was widened. This land is currently
under the management of the St. Lucie County Mosquito Control
District. The developer has installed seven culverts and a 6,000
gallon per minute permitted pump on site.

Petition of James P. Brown for relief from the requirements of Section
11.02.09.(A)(4) of the St. Lucie County Land Development Code -
Transportation Impact Report, For the Planned Unit Development Known as
'OCEAN PUD.
The developer of.the project to be known as Ocean, a 101-unit residential Planned
-Unit~. Development 16~ated on South Hutchinson Island, is requesting that this Board
authorize relief from the requirements of Section 11.02.09(A)(4) of the St. Lucie County
Land Development Code. The provisions of this Section require that all site plans for
development located on Hutchinson Island submit a report which assess the impacts of that
development upon the Island's transportation facilities~ The Code specifies that a waiver of
this report may be granted by this Board upon the demonstration by the developer that the
information foregone by such relief is not needed to determine the impacts of' the proposed
development.
This request for a waiver of the Traffic Impact RepOrt is based on generation rates
wlfich, according to the developer, are unique to the Ocean project. The developer has
indicated that this project, which is composed of 95 single-family and 6 multi-family
residential units, will be a resort community accommodating primarily seasonal residents:.
This sort of development is expected to generate fewer vehicular trips per day than would
a development which accommodates permanent residents.--
Staff has reviewed a request for a waiver of this report, including a site plan and
other documentation supporting the expected traffic generation rates, and has determined
that the submission of an Transportation Impact Report is not necessary to determine the
impacts of the proposed development upon the traffic facilities in this area.
Staff notes that this development will not result in a reduction in the Level of Service
along S.tL A-l-A, and recommends that this request for relief of the requirements of Section
11.02.09(A)(4) be approved.

MINUTES
BOARD MEMBERS PRESENT: Robert Carman, Robert Klein, Doug Skidmore,
Jo Ann Allen, .Donna Calabrese, Dixon McCain, J.p. Terpening, Ralph
Flowers (late 7:06 P~M.), and Ken Sattler (left at 8:00 P.M.).
BOARD MEMBERS ABSENT: NONE
OTHERS PRESENT: Dan McIntyre, County Attorney; Dennis Murphy, Land
Development Manager; Bill Miller, Planning Director; David Kelly,
Planner III, Luis Serna, Planner II, and Charline Burgess,

APPROVAL OF PLANNING AND ZONING COMMISSION MINUTES OF REGULAR
MEETING OF SEPTFJ4BER 24, 1992.
Ms. Calabrese made a motion that the Planning and Zoning CommiSsion
approve the minutes of the Regular Meeting of September 24, 1992.
Mr. S~tler seconded the motion, and upon roll call, the Board
voted in favor of the motion.
PUBLIC HEARING - JAMES p. BROWN
FILE NO. RZ-92-006
Chairman Terpening stated that his firm is professionally involved
with the development of this project and therefore excused himself
from the Board and passed the gavel to Vice Chairman Skidmore.
Mr. Luis Serna presented staff comments. He stated that this
petition is for preliminary Planned Unit Development approval for
a project to be known as Ocean. The property proposed for the
development is a 30 acre parcel located on the east side of State
Road A-l-A, directly south of the Middle Cove Beach Access. He
stated that the plan for Ocean PUD is for a 100 unit residential
development. The applicants are proposing 95 single family
residential units and six multi-family residential units to be
located within a single four-story structure in the center of the
project.
Mr. Serna stated that the applicant has agreed to dedicate the
north 300 feet of the subject property to' St. Luci

· mprovements will restore th~ primary dune to a more natural state,
reducing the potential for further dune over-wash an

Mr. Serna stated that staff has reviewed this petition based on the
concept presented in the site plan and its potential impacts on the
environment, surrounding properties and upon public facilities. He
stated that this petition is consistent with all applicable
Standards of Review established in the Land Development Code.
Mr. Serna stated that the draft Resolution that was included in the
Commissioners, packets, which wouldgrant preliminary PUD approval
to the project, had been revised to detail the parcels which were
to have been dedicated to the County as part of the petitioner,s
prior permit approvals.
Bill Miller, Planning Director presented each Commissioner with a
revised copy of draft Resolution No. 92-238.
Mr. Serna stated that staff recommends that this petition be
forwarded to the Board of County Commissioners with the
recommendation of approval, subject to the following conditions:
1. Prior to the granting of Final-Planned Unit
Development approval, the developer shall have
completed the dedication of the north 300 feet
of the petitioned property to St. Lucie County
for the expansion of the Middle Cove Beach
Access facility. Said dedication shall be in
a manner and form acceptable to the St. Lucie
County Attorney; and
Prior to the issuance 'of any building permits
for any portion of the project development
site referenced in the resolution, the
developer shall have dedicated to St. Lucie
County, or another public entity acceptable to
St. Lucie COunty, those properties lying west
of S.R. A-l-A, and described with the
following property tax identification
number(s): 2532-211-0020-000/4, 2532-211-
0050-000/3, 2532-311-0001-000/2, 2532-311-
0002-000/3, 2532-314-0001-000/1, 2532-341-
0001-000/5, 2532-341-0002-000/2, 2532-344-
0001-000/4 that were to be conveyed as a part
of this development's prior permit approvals;
and .
3. Ail structures used for residential purposes
within this project site shall be equipped
with automatic sprinkler systems, or other
approved fire suppression systems; and
4. All one-way road sections within this project
shall include a minimum four (4) foot
compacted area on each side of the pavement
surface. Ail compaction ratios shall be in
accordance with minimum St. Lucie County
public works standards in effect at the time
of construction permitting.
Mr. Klein asked Mr. Serna for clarification regarding the 300 feet
the petitioner would be donating to the County.
Mr. Serna stated that it would be the south 300 feet of Government
Lot 1.

of State Road A-1-A was a condition that was placed upon ~a
previously approved project on the same property.
Mr. Carman asked whether or not it was all low lands.
Hr. Serna stated yes, the parcels are primarily mangrove areas.
Mr. Klein asked whether or not any of the dedicated land would be
buildable.

Mr. Serna stated it would require a lot of fill so practically-
speaking they could not be developed. '
Mr. McCain asked whether or not the north 300 feet of the dedicated
property would be buildable.
Mr. Serna stated if the wetland areas were filled in it could be.
Mr. Serna stated that the dedication of land to the County will
mitigate the alteration of the wetland and dune areas.
Mr. Klein asked whether or not the dedication of the 300 feet of
property necessary to meet concurrency regarding parks.
Mr. Serna stated no, that this is not a concurrency issue.
There was a general discussion among Mr. McCain and Mr. Serna
regarding the dedication of property as a means of mitigating
development of the subject property.
Mr. Klein asked Mr. Serna whether or not an amendment of the Land
Development Code for the monument sign is being initiated.
Mr. Serna stated that the sign committee is currently looking into
revising the Land Development Code, and should they revise it in
such a way to allow a second ground sign, the developer would be
able to erect it. If the code is not so amended, the second sign
would not be permissible.
Mr. Klein asked whether or not such a notation on the site plan
wouldDevelopment indicate Code. that there would be an amendment to the Land
Dan McIntyre, County Attorney, stated that he had not seen the
notation, but the sign committee is in the process of completing
their recommendations, which will have to first be approved by the
Planning and Zoning Commission and then will require two public
hearings before the Board of County Commissioners.
Mr. James Brown, the petitioner, appeared before the Commission. He
stated that he would like to address the concerns regarding the
land west of State Road A-1-A. According to the County maps this
land consists of a total of 41.33 acres. He stated that the 27.95
acres are classified as mangrove areas and 13.38 acres are
classified as land. The 13.38 acres classified as land are not
particularly useable, it is basically what was left over when the
State Road A-1-A right-of-way was widened. This land is currently
under the management of the St. Lucie County Mosquito Control
District. The developer has installed seven culverts and a 6,000
gallon per minute Permitted pump on site.

Mr. Brown stated that the eastern side is approximately 3,100 feet
in total length, so 300 feet would be roughly the northern 10%. He
stated that the initial site plan is for the south 1,900 feet. This
particular site had permits issued at one time by the Corp of
Engineers and the Department of Natural Resources. An extension of
those permits have been filed with both of those agencies. The
Department of Environmental Regulation does not have a permit
pending at this time. He stated that, at this time, he is %r~ing

that as part of the mitigation the developer will
remove eleven acres of Australian pines and rebuild the dune line
to a more natural state.
Mr. Klein stated that there was some confusion between the revised
resolution and the references to the site plan prepared by David
Miller&300 feet. Associates and what seems to be intended for the dedicated

so it was not shown on the site plan. The cross-hatched area on the
plan is where the construction will take place.
There was a general discussion between Mr. Klein, Chairman Skidmore
and Mr. Brown regarding the site plan.
Mr. Klein asked Mr. Brown whether or not he had any objections to
changing the language regarding the sign.
Mr. Brown stated he would not have any objections to the change.
Hearing no further comment in favor or in opposition to the
petition, Chairman Skidmore closed the public portion of the
hearing.
After considering the testimony presented during the public
hearing, including staff comments, and t'he Standards of Review as
set forth in Section 11.06.03, St. Lucie County Land Development
Code, Ms. Calabrese made a motion that the P ·
