Dear Mr. Hagood:
Aquaculture facilities are now recognized as agriculture operations pursuant to Chapter No. 96-
247. Furthermore this legislative act relating to aquaculture includes the following:
Clarifies the definition of agriculture to include aquaculture, thus giving aquaculture and its
products the same rights and privileges as any other farming commodity.
Declares the legislative intent to promote aquaculture production and development.
Exempts certain marine aquaculture products from resource management rules.
Revises the powers and duties of the Department of Agriculture and Consumer Services to
establish an aquaculture certification program.
Provides for the identification, labeling, and sale of aquaculture products.
Consolidates and streamlines the permitting process and
Imposes penalties for theft of aquaculture products from Certified aquaculture facilities.
These are several of the more significant changes adopted, in Chapter No. 96-247, during the last
legislative session that are designed to encourage the growth and development of Florida aquaculture.
This act becomes effective October 1, 1996. If. you need clarification or any additional information,

Wl~REAS, the Board of County Commissioners of St. Lucie County, Florida, has
made the following determinations:
The Board of County Commissioners presented a petition for a change in
zoning from AR-1 (Agricultural, Residential - 1 du/ac) to AG-1 (Agricultural -
I du/ac) for the property described below.
On August 17, 1995, the St. Lucie County Planning and Zoning Commission
held a public hearing on the petition, after publishing notice at least 15 days
prior to the hearing and notifying by mail all owners of property, w/thin 500
feet of the subject property, and recommended that the Board of County
Commissioners approve the hereinafter described request for a change in

Petition of The Board of County Commissioners for a Change in Zoning from
AR-1 (Agricultural, Residential - 1 du/ac) Zoning District to AG-1
(Agricultural -1 alu/ac) Zoning District.
On September 19, 1995, you will be asked to review the above referenced petition for a
change in zoning from AR-1 (Agricultural, Residential - I alu/ac) Zoning District to AG-1
(Agricultural - 1 du/ac) Zoning District. The applicant is requesting this rezoning in order
to use the property for agricultural production.
Atlantic Aquaculture Technologies, Inc. has leased the property from the county with the
intention of oPerating a fish hatchery/farrm Under current ARq zoning agriculture is
allowed as an accessory use to a single family residence. Atlantic Aquaculture Technologies,
Inc. would like to operate their facility as a primary permitted use as would be allowed
under the proposed AG-/zoning.
At its August 17, 1995 hearing on this matter, the St. Lucie County Planning and Zoning
Commission voted 8 to 0 to recommend approval of this petition as .set forth in Draft
Resolution 95-150.
Staff finds-that this petition meets the standards of-review as set'forth in Section 11.06.03
of the St. Lucie County Land Development Code, and is not in conflict with the goals,
objectives, and policies of the St. Lucie County Comprehensive Plan.
Staff recommends the approval of Resolution 95-150.

4 to the north, RM-5 to the northeast, and CG further to the west. He added that Atlantic
Aquaculture Technologies, Inc. would like to operate their facility as a primary permitted
use as would be allowed Under the proposed AG-1 zoning.
Mr. Witmeyer stated that staff finds that this petition is not in conflict with the St Lucie
CoUnty Comprehensive Plan and meets the standards of review in the Land Development
Code.
Mr. Witmeyer stated that staff recommends that this petition be forwarded to the Board of
County Commissioners. with a recommendation of approval.
Hearing no comments in favor or in opposition to the petition, Chairman Calabrese closed
the public portion of the hearing
Chairman Ca!abrese stated that the Commission received a letter of support, from Curtis
King, A/rport Director for St. Lucie County.
After considering the testimony, presented during, the. Public Hearing, including staff
comments, and the Standards of Review as set forth in Section 11.06.03, St. Lucie County
Land Development Code, Mr. Skidmore moved that the Planning and Zoning Commission
recommend that the St. Lucie County Board .of County Commissioners grant approval to the
application of Board of. County Commissioners, for a Change in Zoning from AR-1
(AomScultural, Residential-21 du/ac) to AG-1 (Agricultural - 1 du/ac). Mr. G~bins seconded
the motion, and upon roll call, .the.Commission voted 8 to 0 in favor of the morion.
Chairman Calabrese stated that this petition would be forwarded to the Board of County
Commissioners with a recommendation of approval
Ms. Calabrese passed the gavel back to Chairman Klein.

area. The parcels south of Indrio Road and surrounding the subject parcel
are vacant. North of Indrio Road, the primary use is residential. The St.
Lucie County Airport is located to the southeast. The area is zoned
commercial, general to the far west and agricultUral, residential to the
immediate west and east. To the immediate south, the area is zoned
agricultural, residential as well as industrial, light and industrial, extraction to
either side. The applicant has planned for a significant buffer along Indrio
and Taylor Da/ry Roads.

Conditions have not changed so as to require an amendment.

zoning. Atlantic Aquaculture Technologies, Inc. proposes to have agricultural

agriculture as an accessory use to a single fam~ residence.

COMMENTS
The petitioner, St. Lucie County Board of Commissioners, has requested this change
in zoning from AR-1 (Agricultural, Residential - 1 alu/ac) to AG-1 (Agricultural.- 1 alu/ac)
in order to lease the property for agricultural production. Atlantic Aquaculture
Technologies, Inc. has leased the property from the county with the intention of 'operating
a fish hatchery/farm. Under current AR-1 zoning agriculture is allowed as an accessory use
to a single family.residence. Atlantic Aquaculture Technologies, Inc. would like :to 'operate
their facility as a primary permitted use as would be allowed under the proposed AG-1
zoning.

The proposed zoning is consistent with existing and proposed land uses in this
area. The parcels south of Indrio Road and surrounding the subject parcel
are vacant. North of Indrio Road, the primary use is residential. The St.
Lucie County Airport is located to the southeast. The area is zoned
commercial, general to the far west and agricultural, residential to the
immediate west and east. To the immediate south, the area is zoned
agricultural, residential as well as industrial, light and industrial, extraction to
either side. The applicant has planned for a significant buffer along Indrio
and Taylor Dairy Roads.
Whether there have been changed conditions that require an amendment;
Conditions have not changed so as to require an amendment.
Whether and the extent to which the proposed amendment would result in
demands on public facilities, and whether or to the extent to which the
proposed amendment would exceed the capacity of such public facilities,
including but not limited to transportation facilities, sewage facilities, water
supply, parks, drainage, schools, solid waste, mass transit, and emergency

The intended use for this rezoning is not expected to create significant
additional demands on any public facilities in this area. Any development will
need to demonstrate that there are adequate public facilities in the area to

hq order to lease the property for agricultural production. Atlantic Aquaculture
Technologies, Inc. has leased the property from the county with the intention of operating
a fish hatchery/farm. Under current ARq zoning agriculture is allowed as an accessory use
to a single family residence. Atlantic Aquaculture Technologies, Inc. would like to operate
their facility as a primary permitted use as would be allowed under the proposed AG-1
zoning.
Staff has reviewed this petition and determined that it conforms with the standards
of review as set forth hq the St. Lucie County Land Development Code and the St. Lucie
County Comprehensive Plan. Staff recommends that you forward this petition to the Board
of County Commissioners with a recommendation of approval.

changes and zoning amendments which acknowledges that no public facility capacity will be

$25 fee will apply. A determination of the availability of public facilities capacity will be
made prior to the issuance of a Final Development Order. A Final Development Order
