In compliance with the law, the Board of County Commissioners advertised for bids on the property from any interested purchasers. The land was sold to Lakewood Realty Co. and the deed from the County to the Company will carry a restriction that the land will be used for no purpose other than a golf course. The Board of Connty Commissioners contacted the various organizations of residents in Lakewood Park and found all of them looking with favor on the proposed golf course. Mr. and Mrs. Wm. E. Ryon, Mrs. Adele Turek and Wilford M. Dodge, adjacent property owners attending the ~ea~ing , spoke in favor of the petition. Mrs. Ryon asked if the access roads would be taken care of by the developers of the golf course and stated they are also interested in the traffic resulting from the golf course. However, is in favor of the golf course itself. There was no opposition. By a unanimous vote the Planning and Zoning Commission recommended approval of the petition to the Board of County Commissioners because there is need for this recreational facility in the County and there was no opposition fromthe residents of Lakewood Park. PETITION OF MERRIWEATHER INVESTMENT CO., INC. Mr. Peoni present, saying he had nothing to add to statements he made at the public hearing June 26, 1969. When the chairman ia~ed those supporting the petition to speak, there was no response. James Sneed, Jr. spoke on behalf of his mother-in-law, Mrs. Florence Enders. He repeated the information previously given about Mrs. Enders' property, expressing his opinion that mulii-family houses on small lots would be detrimental to surrounding property. Mr. Jack Scott, representing his mother, said Mrs. Scott objects on the same basis as Mrs. Enders -- that here is 150 acres, more or less, of almost undeveloped land except for some very old houses, with rapid access to the City, which is ideal for high-type residential development. Mr. Jennings stated he feels Mr. Peoni should be given consideration because he is ready to proceed with construction, while Mrs. Enders and Mrs. Scott have only hopes and aspirations. Mr. Peoni asked permission to show a replatting of the Subdivision which provides larger lots. The Subdivision has a total of 96 lots, as platted, but he plans only 56 structures, the least expensive to sell for $13,900 and he further stated this section is not suitable for more expensive homes. He referred to existing houses on 25th St. and Cortez Blvd. to prove his point. Mr. Peoni con- firmed that he has not filed a replat of the Subdivision. He has already built some single homes but has had requests for duplexes which is the reason for his petition. _~-~ Mr. Scott said he is not objecting to the lot si~es because he feels they a~adequate and that the houses constructed are adequate, but is objecting to 2-family and multi-family structures. The Regional Planner advised the Land Use Plan shows this area planned for low density residential use. Mr. Combs said he inspected Merriweather S/D t6day and it to be in the general area of several new schools. Felt zoning ahould not be changed from R-lC because ten years from now duplexes might blight the area. Reference was made to the R-2 zoning immediately North, adjacent to 25th and Cortez which was recommended by the P & Z Commission several years ago. The Board indicated they felt this to have been a mistake. Mr. Peoni stated he considered buying to the North, on 29th Street, but the land there is too low for septic tanks. Moved by Mr. Weatherington, seconded byMr. Hogue, that the petition be denied because R-2 zoning for Merriweather Subdivision does not appear to be in the best interests of the community and petition can continue development with single family dwellings. PUBLIC HEARING Petition of the Planning and Zoning Commission of St. Lucie County, Florida, to amend the Comprehensive Zoning Resolution, as follows: Amend Paragraph 2 of Section 11 "OFFSTREET PARKING AND LOADING" to read: 2. Offstreet Parking Regulations. For the purpose of this resolution, the term "Off- street Parking Space" shall consist of a minimum net area of 10 ft. x 20 ft. for the parking of an automobile, exclusive of access drives or aisles thereto. Offstreet parking facilities, including access drives and aisles shall be paved according to standard county specifications. The parking area shall be marked, either by painted lines, precast curbs or in a similar equal fashion to indicate the individual parking spaces. All required offstreet parking facilities shall be drained so as not to cause any nuisance to adjacent private or public property. A Certificate of Occupancy for the given structure or premises shall be prohibited until the required parking area has been improved, inspected and approved. e Amend Paragraph 3 of Section 11 "OFFSTREET PARKING AND LOADING" to read: 3.. Plans for Offstreet Parkinq Required. A plan shall be submitted with every application for a building permit for any building or use that is required to provide off- street parking. This plan shall, in addition to showing the details of construction, accurately designate the required parking spaces, access aisles and driveways, and the relation of the offstreet parking facilities to the uses or structures such facilities are designed to serve. Said plan shall be approved by the County Engineer prior to the issuance of a building permit-. Amend Paragraph 5d of Section 13 "MOBILE HOMES AND MOBILE HO~R PARKS" to read: de Each mobile home site shall abut on a driveway having a right of way of not less th~n 30 feet. Such driveway shall be paved according to stand- ard County specifications and shall be adequately lighted. The County now has specifications for paving parking facilities and the above proposed amendments incorporate the requirement to meet these specifications. Moved by Mr. Gates, seconded by Mr. Jennings, that recommendation for approval of this petition be made to the Board of County Commissioners as being in the best interests of the community. Philip Nourse, Attorney, replied that nothing about segregation is mentioned in the Charter. The School will be run by a Board of Directors of eleven people who pass on'all admissions. The School is planned to provided quality education. Mr. O'Laughlin asked if negros will be admitted to which Mr. Nousse and Pr. Price replied that none has applied; that if a negro does apply the application will be considered on the basis used' for any other application. Mr. O'Laughlin asked what kind ~f building will be erected. Dr. Price answered that it will be concrete block construction, with 10 rooms, one of the rooms being used as an office, and the other nine as classrooms. It will be a rather plain structure, but will be well-constructed and will house the children safely. Mr. O'Laughlin inquired how the school is funded and he was told it will be funded by tuition, like any other private school. Mr. Stebbins, chairman, observed that some of Mr. O'Laughlin's questions do not apply to zoning. Mr. O'Laughlin said he thinks they do, since a 10 room shhool building among.~20,000 homes is being discussed, and what'~ppens should the school fail. To Mr. O'Laughlin's questions about plans for the building, Dr. Price replied that the architect will complete plans very soon. Mr. O'Laughlin stressed the point that this neighborhood is given entirely to residential uses and that the area should remain purely residential, especially since so many of the homes are rather expensive. Mr. Nourse presented an aerial photograph showing homes, groves, etc. which was referred to freque~tl~2~throughout the remainder of the meeting. Mr. Gorham inquired as to arrangements for water, sewer and access. Mr. Irvin jFrank, Attorney, replied that the School has consulted with the Health Depart- ment, and they have been advised of the type and size of septic tanks required, type of water filters needed, etc. Access at the present time will be via Tedder Road and pupils must furnish their own transportation. Pupils will not be permitted to ~e motor bikes. Tedder Road is not paved but hppe this can be arranged. The Chairman asked Dr. Price where the School would be located on the ten acres. Dr. Price stated probably to the right of center line, since this is the best location to assure good drainage and provide playing fields for the children. The building would be approximately 400 ft. from the property line. It will be a long building, with a central hallway, located North-South to Tedder Road. In reply to Mr. Gorham's question, Dr. Price said that Mr. Harold Helseth, ViceTPresident of the Board of Directors, who is a grove man, assures them drainage will not be a pro~iem. This is a Pine ridge and not really low land. Mr. Roland Schmidt personally opposed the p~fii~bDn, fe~ling the area should remain solely residential. Mr. Williams agreed there were a few nice homes nearby, and then referred to a number of undesirable things in the neighborhood. Mrs. Williams asked how many people present were in favor of the requested rezoning and almost all of the 50 or 60 present indicated their support by raising their hands. Mr. O'Laughlin asked when construction would start, if rezoning is granted. Dr. Price said they hope to start the day after final approval is received. Mr. Jennings inquired if grades 1 - 9 will be accredited so that pupils can transfer to another School. Dr. Price replied that the students will be given a more complete and thorough education than they can get in public school because the pupil load will be much less. Any student will be able to transfer in the same, or a higher, grade. In answer to Mr. ~ennings question Dr. Price said ~there is enough land to ake care of future growth of the school and playing fields. It is not planned that the school will ever be big; what they want is as few students and as many teachers as they can afford. There are plans to clear out all the brush which now covers the property, plant grass and fence it across the front. Mr. Pippin was joined in this petition by Mr. Moseley to provide sufficient area to request rezoning. Mr. Pippin who operates a tractor and equipment business on the property described, stated-~e is asking for B-4 zoning in order to be able to provide more space. This type of business is non-conforming in B-3 zoning and expansion of a non-conforming business is not permitted. His tractor salesand repairs and office are all housed in one building. He proposes an addition to the structure on the West to be used for an office. He would then utilize present office space for other business activities. At one time he moved his office to Vero Beach but, when his quarters there became crowded., he moved it back to Fort Pierce and the space it now occupies is entire £hadequate. Mr. Thomas, Zoning Director., explained that it would be permissible for Mr. Pippin to construct a separate building for office use because this is a permitted use in B-3 zoning. However, thera is a legal technicality as to whether moving p~t~ of his ~ractOr business into the sapce now occupied by the office would constitute expansion of the non-conforming business. This had been discussed with the County Attorney, resulting in the decision to petition for B-4 zoning. Gerald James, Attorney, ~epres~nting Mr. J. C. Brunen, owner of Seminole Trailer Park, which adjoins the property for ~nich rezoning is requested on the North and East, stated the Trailer Park is most attractive, well managed and well kept, and occupied mostly by retired people. He opposed the petition for Mr. Brunen and the tenants in the Park. Mr. James presented a petition bearing 42 signatures, including those of some adjacent property owners and tenants of the Park, objecting to the petition being granted. Mr. James added that since B-4 zoning permits some rather undesirable businesses, to grant the petition would change the character of the area. Agreed, however, that Mr. Pippin is in a difficult situation but the interests of other people must be con- sidered also. Mr. Alvin Rosenbergidentified himself as owner and operator of Manny's Fruit Stand, which lies adjacent to the property described to the South. Mr. Rosenberg objected to the cemetery coming closer to his property than it alraady is. ~omplained of people parking in his parking lot while attending funerals. Also, his home is next to the fruit stand and he doesn't feel it right that he should be required "to look at the cemetery". Mr. Livesay showed Mr. Rosenberg a plat of the property. Stated he cannot understand why there should be any parking at Manny's fOr funerals since there is plenty of parking in the cemetery. All funerals are escorted by the police who lead the'cortage directly to the cemetery. The entrace to the cemetery is 282.6 ft. North of Manny's. Mr. Pasteur noted that Hillcrest Memorial Gardens is developed on the basis of a master plan. For the present the property for which rezoning is asked would be merely landscaped, which would improve its present appearance. Referred to present development, where land along the highway is not used for burial purposes but is merely beautified. Mr. Gorham commented it is his understanding that cemeteries severely decrease the value of adjoining property for residential use. Industry is increasingly providing mobile accomodations for .travelling vacationers and a highly expanding industry is the providing of service establishments for accomodations favorable to water bound mobile family tourist vacationers. With private development raPidly occuring, the facilities of utilities are fast spreading to Hutchinson Island. Gulf States provides water, Florida Power, electricity and Southern Bell offers telephone service. The Island is easily accessible through State Road A1A from Ft. Pierce South Beach to either Jensen Beach or Stuart. As more property is developed, insects should become less evident. Local residents of the three-county area have found on spasmodic occasions that sail-boating and power-boating are of great sport; that since A1A has been opened a particular section of this Island known as Herman's Bay is quite conducive to sailboat contests. Mr. Weatherington will prepare an ownership map, and the legal ramifications of the committee's final recommendations must be looked into. Mr. Hogue has talked with Larry Hodges who is active with the local sailboat group. The sailboat people use-the area of Hem~an's Bay more than they use Jaycee Park because the water is deeper. Can ~et a boat with the centerboard down within 50 ft. of the shoreline at Herman's Bay. Mr. Hodges suggested a launching ramp, running ~ater, sanitary facilities and picnic shelters and a few simple grills. Also a speed limit in the area on A1A. However, consideration must also be given to adjacent homes. Mr. Scott, Commission member, asked Mr. Pressler if he objected to Pyramid's present operation. Mr. Pressler replied that he did not, nor did he object to the new building made possible by the action of the Board of Adjustment. Mr. Scott then said that there seems to be little objection to the present operation and because of this he felt the petition should be granted. On the other hand, Pyramid could dispose of the property and soneone else could use it in a manner which would be harmful to the neighbors. Mr. Jennings asked Mr. Pressler he would abject to the M-2 zoning, if an area immediately adjacent to his Subdivision would remain B-4 - perhaps 40 ft or 50 ft. Mr. Pressler said he would go along with this. Mr. Jennings then asked petitioner if rezoning were granted for the property, except for the East 40 or 50 ft., would this be an acceptable arrangement. Mr. Scott then gave a detailed account of his previous experience with zoning, saying he is now at the same place he was in July 14, 1969 and quoted from a letter written by the Zoning Director at that time advising C-1 zoning. Mr. Thomas again commented on the situation in 1959, saying it was in the beginning of zoning and the error was easy to ~mke because everyone was unfamiliar with the problems and procedures. Mr. Jennings summarized the situation: (1) In 1959, in error, Pyramid had been advised to apply for, and received, a zoning classification which rendered the business non-conforming; (2) Pyramid has applied for, and been granted, a Variance by the B of A which will permit them to proceed with construction of one more building to meet their growing needs; (3) Pryamid has applied for M-2 zoning which will per- mit them to freely make long-range plans for their growing business; (4) the adjacent property owner, most affected, has agreed not to object to rezoning, if said rezon~ng does not i~clude the East 50 ft. of the property. Moved by Mr. Weatherington that the petition be recommended to the Board of County Commissioners for approval. Moved by Mr. Scott to amend Mr. Weatherington's petition to except the East 50 ft. of the premises which would remain in the B-4 classification, which would protect adjacent property and, at the same time, meet the needs of petitioner. Mr. Weatherington seconded Mr. Scott's amended motion. Vote was polled and the amendment and motion carried unanimously. PUBLIC HEARING Petition of the Planning and ZOning Commission to amend the Comprehensive Zoning Resolution and Schedule of District Regulations for St. Lucie County, as follows: (1) Amend PROHIBITED USES AND STRUCTURES in M-2 Industrial District by deleting from the line '~Manufacture of asphalt, brick, tile, cement, lime, plaster, concrete or products thereof" the phrase "products thereof." Mr. Thomas said this amendment should be adopted because the manufacture~ of asphalt, brick, tile, cement, lime, plaster, concret~ should be the M-2 classification, but the manufacture of bird baths, garden is not an objectionable business and feels the proposed change isin the interest of a good Zoning Resolution. Moved by Mr. Weatherington; seconded by Mr. Hayling that the proposed amendment be recommended to the Board of County Commissioners for approval because it is deedmed to be in the best interest of St. Lucie County, Vote waspolled and the motion carried unanimously. He also pointed out that there is a continuging need of housing; that single family houses will meet part of the need but there is a great need for apartment facilities. Mr. Hayling inquired of Dr. Blake whether or not he planned to serve all the people. Dr. Blake replied that he now has an office on Delaware Avenue and it is his intent to keep both offices open. Mr. Hatcher stated he cannot see any purpose to zoning if it is going to change all the time. Mr. Jennings and Mr. Wilson explained some of the philosophy of zoning and why it is by nature a continually changing process. Bill Miller said he too has recently purchased a home in Sherwood Acres and has stagnant Water at his back door. Mrs. Thomas Jay spoke several times. She opposed the petition because of the water problem, as did Mrs. Hershal Staggs. Vincent Daniels expressed objection. Dr. Blake stated he is aware of the drainage situation and has offered an easement to the County for a ditch to drain the entire area. Mrs. L. A. Davenport questioned the success of the ditch proposed by Dr. Blake, saying there is a large drainag~ ditch on Edwards Road which hasn't solved the excess waterproblem for the people living there. Mr. Scott asked Dr. Blake if the So~th 4 acres of the property would be sufficient for his needs, considering there is a house on the SW corner. Dr. Blake replied he Would construct an apartment building, would live in one apartment and also have his office there. Mr. Thomas commented he feels sure an apartment building could not operate on septic tanks and that a sewage disposal plant would be required. The Health Department has indicated that in the event of high density occupation a sewage disposal plant will be required. Mrs. Williams commented that the treated water from the sewage disposal plant would have ko go somewhere. Moved by Mr. Jackson, seconded by Mr. Weatherington, that recommendation be made to the Board of County Commissioners ~hat the pmtition, as amended, be granted because R-3 zoning would maintain the residential character of the neighbor- hood and proper sewage-disposal can be assured through the Health Department. Vote on the motion was polled, as follows: Ayes - Schenandoah, Jackson, Weatherington Nayes - Hogue, Gorham, Scott and Jennings. PUBLIC HEARING Petition of the Planning and Zoning Commission for St. Lucie County, Florida, to amend Section 7 "Suppl'emental District Regulation" of The Comprehensive Zoning Resolution for St. Lucie County by adding Paragraph 18, to read: "18. Temporary Uses. The Board of Adjustment may, after public hearing and subject to appropriate conditions and Safeguards, grant special exceptions for the construction and operation of temporary concrete hatching or transit mix plants and paving plants necessary for the construction of public roads, bridges, and public utility plants of such size as to make the hauling o~ concrete or asphalt from existing plants to the construction site detrimental to the public interest." Mr. Thomas stated there are times when it-is not practical to haul mixed concrete and asphalt long distances to jobs requir&hg large amounts of these materials. The alte~rnmtive is to put up a temporary plant near the job. At present such plants are not possible without rezoning. The proposed amendment would permit a temporary plant by Special Exception granted by the~Board-of Adjust- ment and necessary safegugrds could be-a c~ndition of the Special Exception. The safeguards could include a time limit for ~se of theplant, prohibition of sales to any contractor except as designated ~ the Board of Adjustment, provisions for cleaning up the premises when the plant is removed, etc. John Di~n, representing Ricker, Inc. stated his company hopes to furnish concrete for the construction of the power plant on Hutchinson Island. Thereis a real need for a plant near the construction site. Urged aPproval of the proposed amendment. Mrs. Ruth Freeman objected to the-provision for an asphalt plant. Recognized that under certain conditions temporary asphalt plants might be desirable,-but they are a source of pollution and felt they should be striken from the proposed amendment. Mr. Gorham agreed with Mrs. Freeman. However, he suggested provision should be made in the Zoning Resolution for temporary asphalt plants, probably along the lines of Palm Beach and Dade Counties. Scott, Pyramid Corporation, urging the petition be granted because Skateland would thereby be able to expand; that this facility offers so much to the community by way of a fine recreation, everything possible should be done to assure continued enjoyment of it. Chester Griffin, Attorney, stated he represents approximately 95 property owners from within 300 ft. to ~ithin 1/2 mile of the parcels for which rezoning is requested, all of whom oppose the petition. Mr. Griffin recalled that in 1964 Skateland had applied for B-4 zoning and was denied at that time. Further, the area for which rezoning is requested is surrounded by White city, a nice peaceful part of our community and to grant this petition would be a giant step toward the destruction of this status. Ennumerated some of the undesirable things permitted in B-3 zoning. He noted that many of the homes constructed by opponents to the petition are in the 20 - 30 thousand dollar bracket and were constructed by people who believed in the integrity of the present zoning. Mr. Griffin stressed that no one wants to put anyone out of business and they do not want to close up an existing non-conforming use - they merely want things to remain as they are. Fred Kendall said he purchased property in the White City area with the idea of living here. Urged the master plan be considered, on which the area for which rezoning is requested is shown for residential use. John R. Long stated he purchased 7 acres in White city in 1964. now a lot of nice homes on this land and he is opposed to the petition. There are James Roberts said he purchased land from Mr. Long for his home; is a business man and has his business on Orange Avenue because he wants his home and business separate. Mrs. Paul Frere, adjacent property owner, said some of the people present who want the rezoning are friends of hers and she hopes they will remain her friends; however, she opposes the petition because the surrounding community is residential and she feels it should remain so. Mr. Monroe then mentioned the engine work done by Freshwater-Smith, which is 3/8 miles from the Monroe home, and is audible. Mr. Denison replied that the work Freshwater-Smith does would not be permitted in B-3 zoning. (Freshwater-Smith works on Diesel equipment). Charles Rogers, representing Mr. Maheuron, enn~ated the.businesses existing on Weatherbee Road, stating it is not fair to them not to be properly zoned. Marshall Ross, Yvonne Roberts, Bob Hardman, .Roy Daily spoke against the petition. Mrs. Monroe spoke again, referring to the Auction House directly across the street from her home on Weatherbee Road, in an area zoned B-4. About Christmas time there was an announcement that the Auction would be open 7 days a week, which was done. Mrs. Monroe pointed out this could happen in B-3 zoning. Marie Jackson urged consideration be given the ~need for Skateland to enlarge, feeling they should have every opportunity to do this in view of the fine recreation they provide for the young people of the community. Wants to retain personal control of the development and ~ive there himself. Frank Turner, agent for Outdoor Resorts of America, Inc. opposed the petition because his company feels this is not the time for more mobile home and camp sites development on Hutchinson Island because three other developers are presently engaged in this on a condominium basis. Mr. Turner estimated there are now 3000 lots available for this purpose. Did not oppos~bile home and camp site development in principle, but feels the time for it is poor. Mr. Rigel advised he operates a For~ Agency in Kenton, Ohio and it will be about three years before he will be in a position to proceed with his development. However, he wants to secure the proper zoning and necessary Special Exception from the Board of Adjustment so that he will be in a position to proceed with planning. Feels it reasonable to assume the current developers will be sold out in three ye;ars so that his proposed development will not be competitive. He also mentioned that since the Western portion of his property overlooks Nettles Island, part of Outdoor Resorts, it would not lend itself to conventional housing development. Letters from Outdoor Resorts of America, Inc. and Iowa Land & General Develop- ment Corp, Inc. opposing the petition, were noted. Vote was polled and the motion carried unanimously. INDUSTRIAL ZONING - CITY OF PORT ST LUCIE Mr. Jennings stated residents of So. Indian River Drive are very much concerned about plans of the City of Port St. Lucie for development of lands they have zoned for industry, lying between U. S. ~1 and Indian River Drive. These plans include a dump on Walton Road. Wondered if it would be proper for this Commission to confer with Port St. Lucie on this matter. Mr. Wilson said that since Port St. Lucie is an incorporated municipality they have full control of the lands within the municipality. However, we might express out concern about this zoning to officials of Port St. Lucie and it would be within the rights of this commission to request more information as to their plans. Mr. Thomas said he knows the land under discussion is zoned to accommodate a manufacturing and industrial compound and, on paper, they are considering dumping and concrete and asphalt hatching plants. However, the prevailing Easterly wind might make such activity in this area most undesirable. Agreed it would be well to ask for more information. Mrs. Freeman said she understands plans provide for the dump to be separate from other uses. Also, that Larry Shank, Florida Fish and Wildlife division, plans to oppose the proposed development because of its proximity to the Savanna. PUBLIC HEARING - CONTINUED PETITION OF PAUL DENISQ~., ET AL The Secretary reported that all co-petitioners and all adjacent property owners had been notified of this continuation of public hearing. The Secretary reported that since last public hearing, communications were received, as follows: Telegram from Welsy McKinley opposing petition. Letter from Gladys B. Freshwater, Pres. of Freshwater-Smith Machine Co. supporting petition. Letter from Carl L. McCauley, co-petitioner, urging petition be granted. Mr. Denison made a statement based on notes of which he handed a copy to the Secretary prior to this continued hearing, as follows: " In Reference to Weatherbee Road Re-zoning Petition "I would rather have.B-4 zoning same as the auction is spot zoned, but I can conform my business to B-3 which is needed for Skateland. "Much information against this petition has been presented and a lot of it has been misrepresented. I would like to quote just three of these people and show how they misrepresented this information, First, Mrs. Roberts said, and I quote, "What I am really concerned'about is the future, because all the property directly across the street from us is for sale. I can just see, there are no bars down there now and somebody could say 'Boy, that is just the perfect spot, we'll make a killing, put up a bar.'" Now, to correct Mrs. Roberts, the property directly across the street from her home is 3.83 acres and is owned bya Mr. Keen. It is not advertised for sale or up for rezoning. Neither is the next two parcels of land north of this up for rezoning. All of this property will remain under it's present zoning of R-lC, thus no bar could be established. "People spoke saying that if this change in zoning is made it would not be a major step forward. There has not been a hOuse built since 1958 -- 12 years and no new homes. The land is low. Anyone driving down this narrow road would think it is a business street as it is mostly small businesses. There are only three homes fronting on Weatherbee Roa~ that do not have a household business. Of the property owners on wea~herbee ~ Weatherbee 92% are in favor of this rezoning and 8% against. It seems that the distant neighbors are trying to protect the people tha~ live on Weatherbee Road from themselves. "As for Skateland, I would like to say I have enjoyed skating since it opened in 1958. They do not have enough property frontage to be zoned alone, and were offered by the opposition that if they went against me the people would help them get rezoned. I can build and use this shop but Skateland can do nothing because if it expanded to the front it would gain floor space but lose parking space. If they could build to the side as permitted in this new zoning they could use the floor space where the seats areamd be able to skate 50 or 60 more skater.s and allow more children to ska~e and be off the street. The way it is now they skate about 250 and have to turn others away. Where can they go?? Surely they won't go home until i0 or elecven when they should be leaving the rink. The movies, are no longer fit for the childre~ and certainly skating is a fine recreation. The teens are discouraged because the floor is so crowded they are not allowed to free style in the middle of the floor. I would like to be near my business where I can keep an eye on it. Today it is necessary. Skateland has been broken into many times. "It was written in the minutes that Freshwater-Smith works on diesel equipment, that is equipment. They are zoned M-3, heavy industry. I work on grove equipment and engines, not the same as F~shwater-Smith. I would now like to quote the gen~'em~n who said ~that he lived 3/8 mile from Freshwater- Smith. He said "We can hear them beating just as it the were within a few hundred feet of your home. If you don't believe w~ t I'm saying come down March 26, 1970 (cont) to my house in the morning at 7 A.M. and you can hear tk o'clock in the morning just asif they were out in here beating with sledge hammers." Mrs. Hudson Miller, Radio Station WIRA, said ~she works with Mrs. Maheuron; that if there were more places like ~kateland, well supervised and with strict rules everyone would be better off. Mr. Walshon opposed thee peiltion. Mrs. Krum, adjacent property owner, said she lives only a few doors away from Freshwater-Smith and never hears noise from this business. Later, during the meeting, Mr. Krum stated he has never heard noise from Freshwater-Smith at night. Mrs. Paul Denison commented that if rezoning was requested for Elm Ave. or Oleander Avenue it would not be reasonable. However, anyone can see that Weatherbee Road is not an attractive r.esidential area -- it is business and run down, and the concern ~hould be with people on Weatherbee Rd. and not people on Elm Ave. Mr. McCauley asked that his letter, supporting the petition be read. Stated he has lived on weatherbee Road for 20 years ~and wants it rezoned. Then asked Mr. Griffin if the people he is representing are against Mr. Dension, against people on Weatherbee Road, against rezoning entirely, or is it they are against what they think may come in in later yea~s. Said he thinks they are against future progress for the area. Mentioned the number of beer cans along Weatherbee Road, saying the count was high. Noted that in the last 20 years only 4 homes have been built on this section of Weatherbee Road, none since zoning. Pointed out that Skateland, the Bee Business and the Auction all started before zoning. The Auction has been rezoned to B=4 and feels it isn't right the other business places should not be properly zoned for their purposes. Mrs. D.oris Day stated she lives in River Park and came to this hearing to urge that something be done for Skateland. She has three childr.~n and they have all enjoyed this facility Where she feels safe to send them. John Scott said he represents three little girls in his house. Skateland'has provided good recreation for them. Hopes somehow this business can be permitted to expand. Mentioned that he has to live close to the railroad which bothers him each night; however, there would be many people without things were it not for the Railroad. Mr. Griffin stated there is n~othing in the petition that will affect the operation of Skateland; that some people seem to be under the impression that if the petition is denied Skateland will have to close down. This is not true. Mr. Denison pointed out they would non have to close, but ~ei~her can they increase the size of the building, which they need to do to meet the needs of the community. Mrs. A. D. Reese, 4580 Elm Ave said she doesn't want Mr. Denison's shop on Weatherbee Road and if Skateland is having trouble they should buy Mr. Dension's property and expand. Mr.. Thomas explained again ~that Skateland cannot expand under R-lC zoning, even though they acquired Mr. Denison's property. However, under B-.3 zoning they could enlarge their present building, which is what the Matheuron's want to do. Mrs. Davis said if Skateland wants to expand and get re.zoning to do so, she would be for it; that she is for Skateland, as are most people. Mr. James Roberts that the noise from Skateland can be heard and there are young people on the road late at night. Mrs. Edna Collett, 4570 Elm Ave., opposed the petition because of the possibility of a bar being established. Mr. Thomas explained this would not be possible, because a bar must be 2500 ft. from a church, nearly 1/2 mile. Mr. Dickson said he has been in the area for 24 years; it is a quiet neighborhood and he wants it to stay that way. B. Jackson, Jack Gotham and Charles Hayling. Also present: Ralph B. Wilson, County Attorney and Miriam Diem, Secretary. Proof of Publication was presented, showing the public hearings to be held at this time were duly advertised. CONTINUATION OF PUBLIC HEARING - PETITION OF EDNA H. EUDY Mr. Petrie was present on behalf of Mrs. Eudy. Stated the prospective p~chaser plans to construct a large building from which to conduct the business of sale and rental of heavy equipment. Any repair work which is done would be done inside the structure. Mr. Koppenhoeffer said he feels it is in his interest to purchase the rear portion of the Eudy property since the prospective purchaser seems to have no use for it in the operation of the business he wants to carry on. This would give him an opportunity to protect the occupants of the mobile homes in his mobile home park. Mr. Petrie advised that the had asked the prospective purchaser if he would sell the back portion of the land to Mr. Koppenhoeffer but he waB not interested in the amOunt Mr. Koppenhoeffer offered. Mr. Gorham called attention to the Fact the Planning and Zoning Commission cannot interest itself in any real estate transactions; that the Commission's only interest is in good zoning. Mrs. Sheasley, adjacent property owner, stated she has her house adjacent on the North and wants to sell it, and a heavy equipment business could be harmful to her chances of selling. Moved by Mr. Weatherington, seconded by Mr. Gorham that it be recommended to the Board of County Commissioners that the petition be denied, because this would be an instance of spot zoning and not in the best interest of the community. Vote was polled and the motion carried unanimously. PUBLIC HEARING Petition of Ransom R. ROAD SIGNS - SOUTH INDIAN RIVER DRIVE Mr. Jennings reported the residents of South Indian River Drive would like to have signs reading "You Are Now Leaving The City of Port St. Lucie" at appropriate locations on the Drive, and approached him with the request that the Planning and Zoning Commission do anything they could to bring about the placement of these signs. After discussion, the Commission agreed the request be referred to the Board of County Commissioners with a recommendation that everything possible be done to comply with it. Mr. Francis Malinchalk, adjacent property owner, supported the petition, saying he thinks keeping some horses and cows there is a good idea; that this~ is still open country and should not be too restricted.
