The purpose of the variance petition is to allow a 12 month extension of Variance BA-93-012 to permit the petitioner to pursue his final PUD approval which is expected to be heard by the Board of County Commissioners during the month of July or August of 1994; and to permit for the consideration of developing a proportionally reasonable open space for a PUD with a total size of 1.24 acres. The strict adherence to the 1 acre contiguous open space requirement for PUDs with a minimum size of 10 acres would cause a hardship to the petitioner, since this would only leave 0.24 acres Of the parcel to be available 'for development of 5 single family homes. b. This site is bounded by two physical constraints, a finger-canal to the north' and a large mangrove wetland to the south. To the west lies s~ilar undeveloped upland: It is one of~ the last remaining un.developed parcels ha~g frontage on a man-made canal in this area of North Hutchinson Island. During the final review stages of this project, specifically its conformity with the open space requirements, it was discovered that the Code requires all PUDs to provide a minimum open space of 1 acre, regardless of the' size of the PUD. The total size of this'PUD is 1.24 acres. Provision of one acre of open space would result in only 0.24 acre (20 %) of the project being available for buildings, infrastructure etc. The Code usually requires 'a minimum size for PUDs of 10 acres. 2.
