If this is passed tonight then there is a.' 2 year limi t. Corn. Green asked a condition be made of the development order that the buffer zone has to be maintained. This is situation that has come back 'to haunt this commission and he cannot see any alterna-tiVe-~.but to approve the petiti.on. Com. Com. Barnes asked a condition be aided to read that all required landscaping include, trees, nat~ ye drought tolerant species and Bohia ~rass. Com. Green asked the condition be added regarding all required permits ~be obtained. ~ The COunty Attorney clarified the last condition made by Com. Green, and requested it re'ad, to require the applicant to obtain all applicable permits or easements necessary to construct the project. I t was draft moved by Com. resolution no. LUCIE COUNTY, AND I~B~ KILLDAY, through their undersigned counsel sue ST. LUCIE COUNTY and BART HACKLEY and allege: NATURE OF ACTION . 1. TMs is an action for declaratory and injunctive relief under the Gro~ Management Act, Chapter 163, Part II, Florida Statutes (1995), challenging a final development order issued by St. Lucie County for Barr's Bay because the order is inconsistent with the St. Lucie County Comprehensive Plan and materially alters the intensity of use on the property. The r~lief' requested is invalidation oft he development order. BACKGROUN!~_ 2. Defendant, BART HACKLEY, is the owner of a pared of land proposed to be developed as Ban's Bay located in St. Lucie County, Hofida, more particularly described as: 'The Easterly 467.90 feet of the Westerly 637.28 feet of Tract "C" of Coastal Coves, Unit 1, according to the Plat thereof~ as recorded in Plat Book 10, at Page 71, of the public records of St. Lucie County, Florida. Ban's Bay, as approved on May 21, 1996, consists of a six single-family home Planned Unit Development on 1.23 acres total, including setbacks, drainage, and road. The site is on a narrow strip of filled land bordered by a state owned mangrove salt marsh (Aquatic Preserve, Outstanding Florida Waters) to the south and an approximately 40 years old manmade canal with established mangroves on the north. A portion 0fthe property, may consist of illegally filled wetlands. An investigation is being undertaken by the Army C°rp of Engineers and the Florida Department of Environmental Protection to determine whether enforcement will be necessary. The Development Order aflows for storm water discharge through an outflow pipe directly into the Indian River Aquatic Preserve, which is classified as OUtStanding Florida wat'~rs. The plan allows for 71% impervious area with a 13.5 foot setback from the. Indian River Lagoon on the north side and only a 5 to 10 foot setback from the Indian River Lagoon on the south side. STANDING/P/~RTm~e 3. The Plaintiff; .IC BRIAN KiLLDAY, owns property and resides in a single family home located at 923 Jackson Way, Fort Pierce, Florida. The PlaintiWs residence is located across the canal from Ban's Bay. 4. Plaintifl~ NORTH BEACH ASSOCIATION OF ST. LUCIE COUNTY, INC., is a corporation existing under Florida law which represents persons who own property on North Hutchinson Island and in the immediate vicinity ofBart's Bay. . 5. Plaintiffs are aggrieved or adversely affected parties as defined in Section 163.3215, Florida Statutes, because they :or the persons they represent will attfer adverse effects to interests protected or fiuxhered by the adopted St. Lucie County Compreh~~e Plan, as amended, including but not limited to interest related to health and safety, intensities of development, or environmental or natural resources. o These interests are shared in common with other members of the community at large but exceed in degree the general interest, in community good shared by all persons because of the circumstances of the Platn' tit~. 7. Defendant, ST. LIJc~ COI~TY, is a political subdivision of the State of Florida. Through its County Commission, agencies and employees, the County is responsible for implementing the requirements oft. he Local Government Comprehensive Planning and Land Development Regulation Act, Chapter 163, Part II, Florida Statutes (1995'), including the statutory requirement to ensure that all development orders approved by the County, and its agencies and employees, are consistent with its adopted comprehensive plan. 8. Defendant, BART .HACKLEY, is the owner of the property which is the subject of this Suit. Defendant, BART HACKLEY, is the applicant for the Planned Unit Development known as Bart's Bay. · ~--~ ~--'ii_ -~' 9. Plaintiffs-bring this action against the County pursuant to Section 163.3215, Florida Statutes (1995), which authorizes actions for injunctive relief. Venue of this action lies in St. Lucie County because the project is located there and the order was issued by St. Lucie County. ~ LOCAL C~VERNMENT COMPREHENSIVE 10. Chapter 163, Part Il, Florida Statutes, the Local Government ' Comprehensive Planning and Land Development Regulation Act ("Act"), requires each 'local government in Florida to prepare and adopt a local comprehensive plan containing mandatory elements that address important issues such as land use, traffic circulation, conservation, coastal zone management and the adequacy of fac'flities and infrastructure. 11. After a local government has .adopted its comprehensive x' plan, section 163..3194(1Xa) of the Act requires that all actions taken'by the local government in regard to development orders be Consistent. with the adopted local comprehensive phn. 12. The Act provides for citizen enforcement of the consistency requirement. Section 163.3215(1) provides that "any ~aggrieved or adversely affected party" may bring a cml action for injunctive or other relief against ~any local government to prevent the local government "from taking any action on a development order. . which materially alters the use or density or intensity of use'' On the tract °fproPerty in a manner that is nOt consistent with tho. ~,,,~, m~ ~..op,.a ~ocal comprehensive plan. 14. As a condition precedent to seeking jUdicial reliefpursuant to section 163.3215(1), an aggrieved or adverSely affected party must, in accordance with section 163.3215(4), file a verified complaint with the local government. The verified complaint must be filed within thirty (30) days at, er the local government has.taken the allegedly inconsistent action regarding a development order. The local government ~en has thirty (30) days within which to respond to the verified complaint af[er which time the aggrieved or adversely affected party must institute its court action within thirty (30) days. 15. Pursuant to the requirements of the Act, the County adopted the St. Lucie County Comprehensive Plan ('~ ompreh~~e.i Plan"). 16. The parts of the adopted St. Lucie County .Plan, as amended, with which the development order for Bart's Bay as approved on May 21, 1996, are inconstant include but are not limited to the plan provisiOns discussed at public hearings on this applicatiOn before the Board of County Commissioners and Pl~g and Zoning Board, including provisions in the plan which are designed and intended to, and do: A. Ensure a high quality living environment through a mixture of land uses that will .enhance St. Lucie County's natural and manmade resources while minimizing any threat to the · health, safety, and welfare of the county's citizens through incompatible land uses.and environmental degradation. B. Regulate the use of land and water consistent with aH elements of the St. Lucie County Comprehensive Plan, to ensure the compatibility of adjacent land uses and provide for adequate open space. Protect remaining native plant communities within the County. Protect and preserve wetland and upland habitat. Require that necessary environmental assessments be submitted in .writing to the Board of County Commissioners for review prior to their making a determination regarding any proposed development. Iq Require that all. development concepts that propose to impact wetland habitat shall be consistent with all applicable Federal. State and County regulations. L. Provide that existing on-site native upland habitat be incorporated into required site' plans as a part of open space areas, required landscaping or as a part of minimum yard areas so that as much of the identified habitat as is practicable is maintained. M. Eliminate or reduce uses inconsistent with the provisions of the Comprehensive Plan unless otherwise referenced through the vesting of development fights, N. Require a 10' landscaping strip on the perimeter of the property adjacent to public rights-of-way. O. Provide for a storm water drainage and management system that meets existing and future needs of the commtmity. P. Regulate development to protect land use and the functions of natural groundwater recharge areas. Q. Restrict development activities where such activities would damage or destroy coastal resources, endanger human life, and increase public expenditures in areas that are subject to destruction by'natural disasters. Protect, conserve, or enhance the natural resources of the coastal area and the . C. Protect those areas designated for Conservation purposes or that contain other special environmental habitat as identified in the Future Land Use and Other elements of the St. Lucie County Comprehensive Plan. D. Regulate areas subject to seasonal and periodic flooding and provide for drainage and storm water management. E. 'Ensure safe and convenient on-site tra~c flow and vehicle Parking needs. F. Require through the County's Land Development Regulations, that aH new development be compatible with surrounding land uses, both existing and future. G. Conserve open space and environmentally sensitive areas through: 1. The establishment of minimum acreage requirements necessary to support a viable mixed use commtmity proving sttfficient design flexibility to aHoTM innovation and creativity in all forms of planned unity developments. Planned Um't DevelOpments require a minimum often (10) contiguous acres of land under common ownership or control. Thirty-five (35) percent of the gross area of land must be used as parks, recreation areas, marinas, swimming beaches, open space, planting, or other public purposes other than right-of-way, above ground utilities, and parking areas. 2. The establishment of minimum open space standards and ratios of 30% or greater in aH planned unit developments assurances on the part of the developer that such areas will remain as open 'space to protect, existing native habitat, to provide for minimum setback needs from adjacent uses, and to provide active and passive recreational as well as visual amenities. 3. Impacts on public facilities generated by the proposed six single family residences are expected to be less than impacts generated by the approved twelve multi-family units. 3. The variance granted is the minimum variance that will make possible the reasonable use of the land, building or structures. The requested variance is the minimum variance needed to apply for a rezoning to PUD. 4. The variance desi. red will not be opposed to the general spirit and intent of this Code or the St. Lucie County Comprehensive Plan. The proposed variance is consistent with the'intent of the St. Lucie County Land Development Code and the Comprehensive Plan. PUD zoning is often a preferred type of development proposal because the flexible design standards in conjunction with a stricter approval process can be used to protect the natural features of th~ property. Development along SR A-1-A involves sensitive environmental areas where original landscape should be retained as much as possible. The granting of a PUD would allow development of this property in a manner which 'is conSi, stent with the Code and the Comprehensive Plan instead of implementinq existing site plan approval which is not consistent ~ith current Code requirements.
