Planning and Zoning COmmission meeting at 7:00p.m. PLEDGE OF ALLEGIANCE ROLL CALL ANNOUNCEMENTS Mr. David Kelly made an announcement that Dawn Wismer would be the recording secretary for this evening's meeting. Chairman Matthes gave a brief presentation on the procedures and what to expect for tonight's meeting. For those of you who have not been here before, The Planning and Zoning COmmission is an agency that makes recommendations to the Board of County Commissioners. The Staff will present a brief summary of the· project and then make their. recommendation. After which time, the Petitioner will be asked to come forward and state hislhercase for the requested petition. At any time the Board may stop and ask questions of the· Petitiofieror Staff. After that process is completed the Chairman will open the public hearing' for anyone who wishes to speak for or against the petition. The purpQse behind thishearÌ11g is to get input úom the general public. If anyone has somethifig to say, please feel úee to come forward and state it. After eve1Jione'ha$gotten a chance to speak the Chairman will then close the public hearing. The Board will delibera~eaµd then J;Ilake a decision regarqingtl1ejr recommendation,. one way or the other. Once again, I want to remind you that the. PlanningandZonihg Commission only acts in an advisory capacity for the Board of County COmmissioners. The properties to the north and east are zotled:Residential. Staff is recommending that the petition be forwarded to the Board of County Conunissioners with a recommendation of approval, subject to three conditions: 1. This permit is to allow educational services for Grades K-50nly. Any additional educational services would require·a modification to the Proposed Conditional Use Permit. 2. The approved Conditional Use Permit is for the proposed 3.92-acre parcel of land only. Upon development. of the property, west of Dunn road, owned by Liberty Baptist Church, an additional Conditional Use Permit will be required to operate educational services. 3. Any expansion to the square footage for the Liberty Baptist Church facility that will be used for educational purposes will result in modification of the existing site plan and the proposed Conditional Use Permit. Ms. Snay also stated that petitioner has requested to change the request to include Grades K-12 and not just K-5. Chairman Matthes. questioned if the staff recommendation is for Grades K-12. Ms. Snay advised that staff did not feel thatany more traffic would be generated at this time if the petition included Grades K- 12. Mr. Kelly confirmed that he was in agreement. Chairman Matthes asked for comments úom the petitioner. Pastor Wallace Cooley introduced himself and advised that the church's desire was to start educational services in the Fall 2002. He explained that there was a misconununication and that they do wish to include Grades K-12. He advised that the facility would be starting. with dtades K-5and then adding several grades at a time each year. Pastor Cooley further stated that tIle existing facilities and classrooms used for Sunday·. school would be suitable for their Christian school. He thet) asked for. the Planning & Zoning Commission's approval and stated he wduld be happy to answer any questions they may have. Chairman Matthes asked for questions úom the Board. Mr. Grande stated that he had three questions of the petitioner: What they foresaw as the maximum number of students? What the transportation (busing) impact on the roads would be and what would be the impact on the existing septic system? Pastor Cooley answered that over the ftrst few years, they might only have 10-25 students. He also explained that it would be a number of yeats before those. numbers may increase to the level that they have on Sunday's. He stated that they havenp inteµtion of busing any of their students so he feels there should be no impact in that area., He advised that their facility already has · 3 existing septic systems that are sufficiefit for their maximum filled capacity. He does not feel that they will outgrow those facilities any time in the near future. Hearing none,Chairmatt Matth~söpenêd the Public Hearing. Seeing no one in the audience. Chairman Matthes closed the Public'Hearing. Chairman Matthes asked if the Board had any other questions of Staff. Mr. McCurdy asked to see the aerial map and what kind of property is to the north and west. Ms. Snay advised that those areas are both single-family residential homes. Mr. Hearn questioned if condition #3 would be an administrative modification. Ms. Snay stated that if any expansion would needto be done to the building, the petitioner would have to come before the. Board again. Mr. Kelly added that there is an administrative approval for small changes (he believes percentages of square footage etc) to the Conditional. Use. Any major changes would have to come back before the Board. Mr. Hearn stated that after considering the testimony presented during the Public Hearing, including staff comments, and the standards as set forth in Section 11.07.03, St Lucie County Land Development Code,> I hereby move that the Planning and Zoning Commission recommend that the St. Lucie County Board of County COmmissioners grant approval to the application of Liberty Baptist Church for a Conditional UsePerI11Ït to allow eduqational services as an Accessory Use to a religious facility in the I anstitutional)· Zoning District with the 3 conditions stated (including the modified cottditionalløwing Grades K-12 instead of K-$ only) because it seems to be a good additional use totheir existing facility and it would blend in wen with the neighborhood. Chairman Matthes asked· what the proper procedure to follow was regarding the code ordinance discussed at the last meeting, since it was not on the agenda. Mrs. Snay replied that they Were still revising it, so the best thing to do would be to open and close the public hearing because they would have tore~advertise it. Mr. Flores replied that tbere was only one mobile home and a garage. Chairman Matthes asked ·if the petitioner was present. Victoria Mills, the petitioner said that she would . like to build a cement . block home, it would be more economic:al than buying another mobile . home. Chairman Matthes asked if the garage was cement. block and if it will come down. Ms. Mills answered that the garage was woodframe and it will stay. Chairman Matthes asked if there were any questions of the petitioner from the Board. Hearing none, Chairman Matthes opened the Public Hearing. Ms. Becky Miller, 5264 Margaret Ann Lane, was in opposition of replacing a trailer with a home. She suggesteêL that Ms. Mills should build her house somewhere else. Ellen Revero of 5167 Margaret Ann .Lane indicated that the whole community .was a mobile home cOJ11mufiityand wondered if building a house there wasn't going to raise taxes and what it would mean for the owners zoning who want to stay in a mobile home residential area. Chairman Matthes stated that .he couldn't answer to the tax question because he doesn't have any expertise in that. Bufbecause this request was fora change in zOfiing for those ~wo parcels of land and nothing else it doesn't mean that anything else would change. He continued by saying that the Board looks at zoning on a case~by-case basis ~ Chairman Matthes explained to Ms. Revero·that the rezoning would only change the Mills' property. Ms. Jean Grenan, who has lived approximately 16 years in the Green Acres subdivision, opened up by saying that she was in favor of Ms. Mills being allowed to put a house on her property. She asked if they upgrade, ,;vould it have to remain a single..familyhome? Chairman Matthes responded that the rezoning is only fOf>Ms. Mills' property and that once it's rezoned he doesn't. believe that·a mobile home would be allowed to be put back on the property. Mr. Akins asked the staff if they weren't prohibited from spot zoning and was this petition doing that Mr. Flores answered that they were compatible for this area because they were going from a mobile home, which ¡sa residential use to a single family, which is still residential use. Chairman Matthes stated that anytime somebody would do something .that would increase the value of his or her property, he really doesn't have any problem with it He doesn't see it as a bad thing somebody wanting tobuiltsomethingbettetout of what they have,· he doesn't see how this would decrease the value of the sUJTounding area. He saidthe noise on Midway Road would be even more a concern if he were living along there than it would be of the businesses north of Midway Road. With future growth, somethin;g is going ta take·1.lp that space. .He believed that this company has a good reputation for not onl)rmaintaining. the integrity of their property: but also maintaining a fresh atmosphere. He also stated that the landscaping that had been presented to the Board was above and better than what is at the Mobil station on the other comer. Mr. Loundssupports the station. Mr. Grande stated that he could not ·support the petition at this time because commercial is commercial.and he.believes this is not a Commercial, Neighborhood which serves the entire neighborhood, as opposed to commercial supported by the County as a whole. He would like to see this come back as a zoning change to Commercial Property classification that will support a gas station on. its own or use it . fora higher and better commercial use that support the surrouncling community. . Mr. Heamstated he doesn't believe that the Board is protecting property owners' investmentin the community and this might be one· of the. strong reasons why many people are reluctant to invest in the community. They don't feel that they have the protection that they need far their investmf~nt For that reason he· was not going to be· able to support this, reluctantly, because he thought it is a good plan but the intensity of the use that's there, he believed it is not compatible with the sutrounding neighborhood. Mr. Aki11S asked the staff if there were any specific reasons why the petition was presented as Commercial, Neighborhood as· opposed to Commercial, General. Ms. Snay explained that the zoning is Çommercial, Neighborhood and it does allow for convenient stores with gasoline pumps . without the Conditional Use. Commercial, General Zoning would require an amendment to theCo~mprehensive Plan. Mr. Lounds indicated that the area south of thatintersection is going to expand and build despite what is()n Midway Road. Mr. Menitt reiterated that he had the same opinion as Mr. Heam and Mr. GraIlde. Thereìs very little commercial zortingbetween the river and the turnpike and that the gas·station is in the wrong place. The comer isgoing·to be needed for something else that's probably a higher and better use. Chairman Matthes stated he realizes that Midway Road will become one of the major intersectitons in the County. The area·is surrounded to the south by very a large residential area and to the north by areas that are going to change as agriculture changes. He stated that this isn't the appropriate zoning as a Conditional Use but the same situation exists across the street. He doesn't think that the gas station is going to have half the effect as the widening of the Midway Road will have. Mr. Beck stated that he agreed with the staff recommendation. He further stated that due to the location of the North HutcmnsofiJsland Waste Water Treatment Facility and sewage ponds the proposed location was not suitable fora residential home. He went on to explain that a review of the area uses include: a commercia.l center approximately ~.mile south, then apartments and at the comer or Sea Way Drive· and A-I-A, appro~imately 2 miles from the site is a gas station and another small strip center. In hišQpinion, the proposed JþCtition is not considered a spot zoning. . The applicant, Century 21, has plans to construct a building that will resemble alow...rise house with a garage and will be used for office space only. Century 21 is currently located in the strip mall approximately ~ mile south of the proposed location. The current lease will expire within 2 years. Therefore, the proposed building will be constructed before the end of the· current lease~ He then stated he would be happy to answer any questions and asked for the Planning & Zoning Commission's approval. Ms. Snayclarifie<i HIRD bound~es & pointed out that tills problem was addressed in the memo dated July 2$, 2001 from Mr. Kelly in response to Mr.·& Mrs. Simmons' letter. Mr. Simmons went on to state he felt that the proposedproject did not meet the compatibility and neighborhood character test Mr. Trias asked Mr. Simmons what he felt the neighborhood character was and how the proposed property would changethe quality of their living on the island? Mr. Simmons stated that was the responsibility of the applicant to determine the·character of the neighborhood. He was unable to establish what. the current character of the neighborhood is. Mr. Simmons also stated that he feels that if the zoning is changed it will set a precedent· in the area. Mr. Lounds & Mr. Heam had comments regarding the landscaping around the property. Mr. Lounds then clarified the conditions set. Mrs. Sandi Simmons (wife of Walter Simmons) stated that she just wanted to reiterate what her husband· had said and to let the Board· know that she too was against the petition. Mr. Richard Sunderman of3150 North A~l~A, Unit # 903 stated he was opposed to this petition. Mr. Akins asked him what he· would rather see on the· site and Mr. Sunderman responded "weeds" . Mr. Steve Bauer of Sea Palms also stated that he was opposed to this petition. Mr. Lounds asked both of them how long they had lived· on the· Island. Ms. Shirley Burlingham, President of the North Hutchinson Island Home Owners Association, stated that she would much rather·see this 16-foøt tall office building than a 9-story condominium. This would still allow them to enjoy their beautiful view. Her only concern was the sign being illuminåted24 hours a day. She did question thepossibilìtyofpetition:ing for a universal code regarding signs on the Island. Chairman McCurdy closed the Public Hearing.
