BOARD MEMBERS PRESENT: Tom Whitley, Albert Moore, Ed Merritt, Doug Coward,
Stefan Matthes, Diana Wesloski,.Donna Calabrese
OTHERS PRESENT: James Lancaster, Assistant County Attorney; Ray Wazny, Community
Development Director; David Kelly, Planning Manager; Hank Flores, Planner III; and JoAnn
Riley, Administrative Secretary.
PLEDGE O ALLEGIANCE. The Pledge of Allegiance was led by Vice-Chairman Calabrese.
ANNOUNCEMENTS: Vice-Chairman Calabrese stated that Mr. Klein has resigned from the
Planning and Zoning Commission/Local Planning Agency; and as Vice-Chairman, she will act
as Chairman.
ELECTIONS OF OFFICERS:
Chairman Calabrese stated that the first item on the agenda was the election of officers, which
takes place every january. Chairman Calabrese asked if there were any nominations for
Chairman.
Mr. Matthes nominated Ms. Calabrese for Chairwoman. Mr. Matthes stated that with her
experience on the Board; her tenure; she will more than adequately fill the position. Mr. Merritt
seconded the motion. Upon roll call, the motion was unanimously approved.
Mr. Merritt nominated Ms. Wesloski for Vice-Chairman, with Mr. Coward seconding the motion.
Upon roll call, the motion was unanimously approved.
Chairwoman Calabrese stated that Mr. Klein did resign; he served this Board very well for six
years; he worked very hard and did a good job for the community.
Chairwoman Calabrese asked Staff to please invite Mr. Klein back at his earliest convenience so
that the Board can recognize his service.
Mr. Kell?r stated staff will take care of that.
APPROVAL OF PLANNING AND ZONING COMMISSION MEETING MINUTES -
REGUI~AR MEETING OF DECEMBER 17, 1997
Chairwoman Calabrese asked if there were any additions or corrections to the minmes.
There being no further additions or corrections to the minutes of the December 17, 1997 meeting,
Chairwoman Calabrese asked for a motion to approve. Ms, Wesloski made a motion for
approval, and it was seconded by Mr. Coward.
Upon roll call, the motion passed 5-0, with Mr. Merritt and Chairwoman Calabrese abstaining.
PUBLIC~ HEARING
CARTER'S GROCERY, INC.
FILE NO. RZ-98-001
Chairwoman Calabrese asked staff if they would explain the request for a continuance.
Mr. Kelly Stated that he spoke with the petitioners attorney, Edward Becht this morning.
Mr. Becht stated that when he received his copy of the staff report, the legal description did not
include all of the property ' that they wished to'have rozoned and that staff had not been provided
with an accurate legal .descriPtion.
Mr. Kelly advised Mr. Becht that he had two options; go ahead tonight and rezone that portion
that was advertised and file a new petition to rezone the balance; or that if he wished to withdraw
tonight ,ate would amend the petition, re-advertise and then he could come back all at once.
Mr. Becht stated that he would like to withdraw and amend.
Mr, Kelly stated that .Mr. Becht's letter asked for a continuance; we in reality need to pull this
petition; we will readvertise; and likely will be back next month.
Based on Mr. Becht's letter, the consensus of the commission was to allow the withdrawal.
PUBLIC HEARING
HARBOR BRANCH OCEANOGRAPHIC
~STITUTION, INC.
FILE NO. RZ-98-003
Mr. Hank FlOres presented staff comments.
Mr, Flores stated that he was presenting the application of Harbor Branch Oceanographic
Institution for Preliminary Planned Development Site Plan Approval for the project known as
Harbor Branch Oceanographic Institution - PMUD, and a Change in Zoning from the R/C
(Residential/Conservation), AR-1 (Agricultural, Residential - 1 du/acre), RS-2 (Residential,
Single-Family- 2 du/acre), ~-5 (Residential, Multiple-Family - 5 du/acre), CG (Commercial,
General), IL (industrial, Light), IH (Industrial, Heavy) and PMUD (Planned Mixed-Use
Development - Harbor Branch) Zoning Districts to the PMUD (Planned Mixed-Use Development
- Harbor BranCh) Zoning District for 503 acres of land, located at 5600 North U.S, Highway No.
1.
Mr. Flores stated that the proposed use is for a Research Facility for Oceanography and
Aquaculture Facility. He stated that the zoning to the north and south is RS-2 (Residential,
Single-Family - 2 du/acre); R/C (Residential/Conservation) to the north; I (Institutional) to the
southwest; and CG (Commercial, General) to the west.
Mr. Flores stated that the petitioner has requested this change in zoning of 503 acres of land
located on both the west and east sides of Old Dixie Highway in order to develop the project
known as Harbor Branch. This project consists of 14 parcels t° be developed for research and
residential uses. As each parcel is deVeloped, Harbor Branch shall be responsible for submitting
final development'plans addressing the requirements of the Land Development Code. The plans
for those parcels will be reviewed by the Board of County Commissioners as Final PMUD's.
Substantial conformity with this preliminary PMUD will be required.
Mr. Flores stated that. the Planned Mixed-Use Development (PMUD) Zoning District is intended
to allow :for a combination of residential and non-residential land development of superior quality.
Harbor Branch requires the flexibility provided by the PMUD because their operation consists
of research and residential uses many of which cannot be defined at the current time. Approval
of this petition will allow for the continued development of Harbor Branch within the specified
parameters without the burden of constant rezonings. Approval of this petition also preserves a
significant portion of the area and allows St. Lucie County to plan for the ultimate buildout at
Harbor Branch.
Mr. Flores stated that staff has reviewed this petition and determined that it conforms with the
standards of review as set forth in the Land Development Code and is not in conflict with the
Comprehensive Plan. Staff is therefore recommending that you forward this petition to the Board
of Count~ Commissioners with a recommendation of approval.
Chairwoman Calabrese asked if there were any questions.
Chairwoman Calabrese asked if. the petitioner or their representative was present.
Ms. Marsha Wikfors, Dean, Mead'& Minton, 1903 South 25th Street, Fort Pierce, addressed the
Board and' stated that they represent Harbor Branch Oceanographic Institution.
Ms. Wikfors stated that with her tonight is Jim Leffew of Harbor Branch Oceanographic and also
Don Cuozzo of Houston-Cuozzo Group; they sUpport staffs report and recommendatiOn; they
have no objections to the conditions that they have imposed. To reiterate from their report, the
proposed rezoning is consistent with the St. Lucie County Land Development Code; it is
consistent with all elements of the St. Lucie County Comprehensive Plan; it is consistent with
the existing and proposed land uses in the area; it does not require an amendment; it will not
create significant additional demands on public facilities in the area; it Mll not create adverse
impacts on the natural environment nor adversely affect property values in'the area. Furthermore
an orderly ~d logical developmental pattern will occur with no negative effects and the proposed
amendment will not be in conflict with the public interest and is in harmony with the purpose
and iment of the St. Lucie County Land Development Code.
Ms. Wikfors further stated that Harbor Branch is an intricate part of our community, it provides
a tremendous service not only to our community but to the country, throughout, due to its
scientific research. You may have read in the newspaper recently that Harbor Branch has
discovered a new species of fish and has also reported .the first citing of various deep water fish
for .many years. This Institution is an asset to our community and draws tremendous positive
attention to St. Lucie County. Not only for its scientific research, Harbor Branch also provides
a great service to our educational facilities throughout the community by offering internships for
older students and educational tours and teaching to our younger students. By requesting this
rezoning to Planned MiXed-Use Development, Harbor Branch plans to expand its current facilities
and make their research more accessible to the community.
Ms. Wikfors stated that if you have any questions, especially technical questions, Mr. Cuozzo
and Mr. Leffew are here to answer those for you. Ms. Wikfors stated that she would like to
reserve additional time after the public hearing if necessary. Ms. Wikfors asked if there were any
questions at this time.
At this time, Chairwoman Calabrese opened the public hearing.
Chairwoman Calabrese explained the Planning and Zoning Hearing procedure.
Mr. Carl Pritchard, 5443 North U.S. 1 in Fort Pierce, addressed the Board. Mr. Pritchard stated
that he and his mother own approximately 1 acre of land just to the south of Harbor Branch. Mr.
Pritchard asked what type of impact this rezoning will have on their property taxes for the
property they have owned since 197'2.
Mr. Kelly stated. that tho zoning~and the use of Mr. Pritchard's property is not changing; likely
thoro ~11 bo no taxing .impact. Mr. Kelly stated that Mr. Pritchard's property is already zoned
CG Mth only a home located on the property; althOugh he is not tho property appraiser, he would
not anticipate any significant' change.
Mr. Pritchard stated that with the. change in zoning for Harbor Branch to PMUD would.that allow
it to be residential use also.
Mr.'Kelly stated this rezoning will make no change to Mr. Pritchard's property or its status.
Mr. Pritchard asked why he was sent a letter in tho mail to attend this public hearing.
Mr. Kelly stated that the.:County notifies everyone within 500 foot of the boundary as a matter
of law and procedure; so if you are Mthin 500 feet of the boundary you were notified that there
was a change on property ~nearby; but your property is not changing.
Mr. Pritchard stated okay as long as this has no direct impact on their property.
Chairwomrall Calabrese asked if there was anyone else that would like to speak to this petition.
Chairwoman Calabrese asked Ms. Wikfors if she would like to make any closing statements.
Ms. Wikfors stated no.
Hearing no further arguments in favor of or in opposition to the petition, Chairwoman
Calabrese. closed the public 'portion of the hearing.
Chairwoman Calabrese asked if there was any discussion from the Board.
Chairwoman Calabrese aSked for a motion.
After considering the testimony presented during the public hearing, including staff comments,
and the standards of review as set forth in Section 11.06.03, St. Lucie County Land Development
Code, l~.k. Whitley moved that the Planning and Zoning Commission recommend that the St.
Lucie County Board of County Commissioners grant approval to the application of Harbor
Branch Oeeanographie Institution for Preliminary Planned Development Site Plan Approval
for the project known as Harbor Branch - PMUD, and a Change in Zoning from the R/C
(Residential/Conservation), AR-1 (Agricultural, Residential - 1 du/acre), RS-2 (Residential,
Single-Family- 2 du/acre), RM-5 (Residential, Multiple-Family- 5 du/acre), CG (Commercial,
General), ~ (Industrial, Light), IH (Industrial, Heavy), and PMUD (Planned Mixed-Use
Development -Harbor. BranCh) Zoning Districts to the PMUD (Planned Mixed-USe Development
- Harbor BranCh) Zoning District.
Mr. Merritt seconded the motion, and upon roll call the Board voted 7-0 in favor of the motion.
Chairwoman Calabrese Stated that the petition for rezoning would be forwarded to the Board of
County, Commissioners with a recommendation of approval.
PUBLIC HEARING
ORDINANCE 98-002
FILE NO. PA-97-003
Mr. David Kelly presented staff comments.
Mr. Kelly stated that he was presenting Draft Ordinance 98-002, which is a petition of the Board
of County Commissioners to amend the St. Lucie County Land Development Code. The
amendment would be in Section 8.02,01 and wou!d create a paragraph (J) which authorizes.
special vehicle and boat sales events on sites not approved for permanent display of vehicle and
boat sales in the CG (Commercial, General), IL (Industrial, Light) and IH (Industrial, Heavy)
Z°ning Districts.
Mr. Kelly stated that the Draft Ordinance provided sets standards for such sales; including
standards in the way of zoning, access, requirement for St. Lucie County Occupational License,
paving, extension, signs, sanitary services, etc.
Mr. Kelly stated that if you will recall this was before the commission last month. The
commission asked staff to do two things at that time; I think we have done both of those. You
asked that we contact indian River County whose language this was modeled after to see if they
had any particular problems; they are not having any problems 'that we could locate;
administrating such an ordinance.
Mr. Kelly stated, that the other thing that you asked that we be sure to do; would be to invite
representatives of the Auto Dealers Association here tonight; there are two gentlemen here who
could help to answer your questions.
Mr. Kelly stated that Mr. Flores has just distributed a memo to~ each of you that was prepared
late this afternoon from Mr. Cappar, Civic Center Coordinator; his concern was that we not stop
all sales as you saw happen with the City of Fort Pierce simply because it is a revenue stream
for the County; at this time we are talking about this facility, which is in the City of Fort Pierce,
and has been eliminated .from the possibility of having any auto sale; the second place that the
County currently has auto sales is at the Stadium, which is in the City of Port St. Lucie; the
concern addressed in the memorandum is for the potential for a fairgrounds and a partnering
situation ~d the future of that use.
Mr. Kelly stated that he would be happy to answer any questions.
Chairwoman Calabrese asked-if anyone had any questions for Mr. Kelly.
Mr. Mike Wetzel of Sunrise Ford and Mr. Bob Caracello of Coggin Motor Mall addressed the
Board.
Mr. Wetzel stated that. Mr. Kelly's remarks were absolutely correct; they did not want a ban in
the City of Fort Pierce unfortunately they took the lesser of two evils; they did not understand
the explanation of the policing policies of actually our neighbors in the neighbOring counties
coming in here selling, automobiles and leaving.
Mr. Wetzel stated that two off-site sales per year permits are allowed in the City of'Fort Pierce
and the County and he knows that some of the neighboring dealers were coming down 6, 7 or
8 times per year.; whether it be under their own Occupational License or under someone else and
they just were a they are just loOking for an explanation and he believes what Mr. Kelly
has outlined is i what they are looking for but also some sort of policing activity to keep
the abuse of these neighboring dealers coming in numerous amounts of time, more than they are
allotted.
Ms. WesloSki asked Mr. Wetzel if they are allowed to go two times per year to the other
counties.
Mr. Wetzel stated that in order for them to go to the neighboring cOunties they must have an
Occupational License.
Chairwoman Calabrese asked if there were any other questions from the Board.
Chairwoman Calabrese asked if anyone from the public has any questions about the Ordinance.
Chairwoman Calabrese asked what would be the pleasure of the Board.
Mr. Moore stated that he would like to make a comment; he knows at the last meeting he was
in .the minority and he still is probably in the minority; he would just like to voice his opinion
on this; not withstanding what Mr. Wetzel and Mr. Caracello said, he apPreciates their concern
and their concern for their business.
Mr. Moore stated that he has a problem with the restriction; he feels this is a petition that would
.serve a special interest; you have their best interest versus the best interest of the business owners
that are in the' county at the present time that lease out space to dealership that are located
outside the county.
Mr. Moore further stated that if St. Lucie County residents choose to buy a vehicle at one of
these er{mrs; get a vehicle 'that is either at a better price or one that suits them better; he thinks
they should be able to stay in county instead of having to travel out of county to buy an
automobile; he appreciates the fact that other counties have this; but we are talking about this
¢Ollllty.
Ms. Wesloski stated that she also has concerns; just because someone else has it doesn't
necessarily make it fight or correct; perhaps we should look at an additional fee; if they want to
come: here to do business, then they are going to have to pay to do business; to base it on
someone, else has it doesn't seem to be a good thing:
Ms. Wesloski asked if Code EnforCement doesn't work on the weekends and the sales are mostly
on the weekends; how are ~we going to enforce it.
Mr, Wazny stated that the statement Code Enforcement does not work on weekends isn't quite
accurate; we certainly do provide officer enforcement on the weekends and certainly from an
enforcement standpoint; again, not representing the petition to be good or bad; to answer the
direct question can it be enforced, the answer to that is yes.
Mr, Morritt stated that he really has a problem with this; people that come to St. Lucie County
and hold these sales take that money out of tho county; we have enough of our money going into
Martin ~md Indian Ri'ver Counties at this point and it is time we stop it; if 'it takes an ordinance;
let's pass it.
Mr. Coward stated that at the last meeting there was some discussion that this might limit future
sales to only dealers; currently as it stands could a bank or some other business sell cars on a
temporary basis; do they work with someone who has an Occupational License; do they have to
work witth a dealership; how does that work.
Mr. Kelly stated that the county has had no regulations for this type of a use; there are at least
two ways that banks sell automobiles; they either rent their parking lot to someone who comes
in and holds a sale such as we are talking about; some banks also have a comer of their parking
lot with some repossessed vehicles for sale; we do not anticipate that this would affect what we
would consider an accessory~use; which is the sale of the repossessed vehicles; they are their own
vehicles and we believe they can sell them.
Mr. Kelly stated the other uses which is somebody renting their parking lot that is a different
person fi'om the bank; would be affected by this ordinance.
Mr. Matthes asked Mr. Kelly if he spoke with the officials in Martin County to see how the
ordinance ~was working for. them.
Mr. Kelly stated that it was Indian River County and yes we did call; there were no apparent
problems administering the ordinance; there was not a lot of experience with it; we are not sure
that anyone has come in and attempted to violate the ordinance; but there have been no problems
that we were able to identify,
Mr. Matthes stated that he agrees with Mr. Merritt in that this county has enough problems
generating revenue as it is, to allow people to come in, to take some of those hard earned tax
dollars away.
After considering the testimony presented during the public hearing, including staff comments,
and the standards of review as set forth in Section 11.06.04, St. Lucie County Land DeveloPment

Code, Mr. Merritt moved that the Planning and Zoning Commission recommend that the St.

ucle County Board of County Commissioners grant approval to the application of St. Lueie
County for.an amendment to ~e text of Section 8.02.01, St. Lucie County Land Development
Code, ~to provide, for the creation of Paragraph. (J) authorizing special Vehicle and boat sales
events on sites not.approved for the permanen~ display of vehicle and: boat sales.in the CG
(Commercial, General), 'IL (Industrial, Light), and IH (Industrial, Heavy) Zoning District.
Mr. Matthes seconded the motion, and upon roll call, 5 members vOted in favor of the motion,
with M~5. WeslOski and Mr. Moore voting in opposition.
Chairwoman Calabrese stated that the petition for amending the text of Section of 8.02.01, St.
Lucie County Land Development Code, to prOvide for the creation of Paragraph (J) would be
forwarded to the Board of Cowry Commissioners with a recommendation of approval.

OTHER BUSINESS:
Mr. Whitley stated that several months ago he had asked staff, and it may have been pushed
aside with more important items, to prepare a Draft Ordinance for Raceway and/or Speedway
changes; coUld staff hop back on this.
Mr. Kelly stated that we never fully hOpped off of it; we have had a number of single purpose
amendments to the code; most of which have been filed by individuals, and we had to bring them
fOrward..
Mr. Kelly stated that it is very difficult to amend the code that way; when we get an amendment
from an individual, we have processed it as required. We have discussed this proposed ordinance
for speedways, we have some ideas, but we really had hoped that we could roll it into a more
comprehensive series of changes and since there has been no pressure on it we really haven't
brought it back; we haven't forgotten it,
Mr. Whitley stated that he really didn't want to see the Board with a crisis situation again like
was faced when we ~had all of that opposition.
Chairwoman Calabrese stated since we have two vacancies and they are both at large; has the
county ever advertised for positions; other government agencies advertise for applications from
the public to fill the vacancies; have we ever done this for Planning and Zoning.
Mr. Kelly stated that he is not aware of the counW having previously advertised for available
positions; the need to fill the two vacancies was discussed today; we have a couple of names that
have been submitted already,
Mr. Kelly stated that ho contacted tho School Board today, Chapter 163 Florida Statutes indicates
that the School Board should be .given the opportunity, so he spoke to Superintendent Vogel and
he was going to consider that; so if we are not able to come up with some good names in a very
short period of~time we. have talked about the possibility of advertising.
Chairwoman Calabrese stated that she appreciates that; with two vacancies it makes it ~very
difficult.
Mr. Kelly stated that he understands it makes getting a quorum more difficult; we are working
hard to try to get some names.
Mr. Coward asked staff to fUrther look into the hotel that was approved on South Hutchinson
Island regarding the debate about the traffic concurrency that would be available to get off the
island; it was determined that A1A had plenty of capacity but the Jansen Beach Causeway
essentiall[y had no capacity; it seems ironic that we would have a traffic study that would be

consistent fOr the entire county as opposed to taking in a special considerations that :we have on
our barrier island.
Mr. Coward stated that staff was going to present some information about how that issue was
dealt witth; he personally believes we need to take a closer look at~ that; if development is going
to be-approved on the island, we need to make sure they can get on and off the island as well.
Mr. CoWard requested that the Board re-visit the issue, he believes it is one worth the time.
Mr. Coward also. asked staff for an update, mainly timing regarding the EAR based amendments
that will be coming before this Board at some time.
Mr. Kelly stated 'that the EAR is on the Board of County Commissioners Agenda for January
20th to transmit it; staff will be working in earnest on the amendments immediately after getting
the EAJ[ issues solved; we don't have a good time to give you; we are working on it.
