Mrs. Andrews motioned approval of 33 the modified minutes; Mr. Bangert seconded. 34 35 The motion carried 4-0. 36 37 Page 2 of 3 Public Hearing Maryon A. Thiery 1 June 24, 2009 BA-320093965 23 Agenda Item #2 – Maryon A. Thiery 45 Linda Pendarvis stated: 67 Agenda Item 2 is the Petition of Maryon Thiery’s request for an amendment to the 8 previously approved Variance granted by the Board of Adjustment on August 27, 2008 to 9 allow a maximum encroachment of 11 feet in to the minimum front setback of 25 feet 10 required in the Residential, Single Family 4 dwelling units per acre zoning district. 11 12 The subject property is located at 5900 Sunset Boulevard within the Indian River Estates 13 Subdivision 14 15 At the May 27, 2009, the public hearing the applicant did not submit a modified plan as 16 requested by the Board on April 22, 2009. Therefore, the Board of Adjustment members 17 voted to continue the public hearing on this item to the June 24, 2009, regular meeting to 18 allow the applicant to have additional time to provide a modified plan to the Board with 19 accurate dimensions. 20 21 On June 18, 2009, the Growth Management Department received revised plan for the 22 requested amendment. The modified plans indicate a portico extending from the front of 23 the home for a maximum encroachment of 15.58 feet into the required front setback of 24 25 feet. 25 26 Staff has reviewed this petition and determined that it does not conform to the standards 27 of review as set forth in St. Lucie County Land Development Code and may be in conflict 28 with the goals, objectives, and policies of the St. Lucie County Comprehensive Plan. 29 Staff is therefore, recommending denial of the requested amendment to the Board of 30 Adjustment Resolution No. 08.022. 31 32 Mr. Harris asked Ms. Pendarvis to change the 15.58 to 15.6 because it is too precise of 33 a measurement and no one builds that closely. Ms. Pendarvis said it is acceptable to 34 staff. 35 36 Maryon Thiery, the petitioner, stated the new set of plans seem to fit her husband’s 37 needs. 38 39 Mr. Harris returned to the Board for discussion or a motion. 40 41 Mrs. Andrews made the motion: 42 43 After considering the testimony presented during the public hearing, including staff 44 comments, and the standards of review as set forth in section 10.01.02 of the St. Lucie 45 County Land Development Code, I hereby move that the Board of Adjustment approve 46 the petition of Maryon A. Thiery for an amendment to the Board of Adjustment 47 Resolution number 08-022 variance from the provisions of section 7.04.01, of the St. 48 Lucie County Land Development Code to permit the construction of a handicap 49 Page 3 of 3 accessible covered porch/driveway, which will encroach a maximum of 15.6 feet into the 1 minimum front setback of 25 feet required in the RS-4 (Residential Single Family 4) 2 Zoning District, because it is the minimum needed to accommodate Mr. Thiery’s 3 disability, and this new design is better than the prior approved design in both 4 functionality and practicality and aesthetics. Also, even though the encroachment is four 5 feet greater than the original approval, the area that it covers is much smaller and less 6 obtrusive. 78 Mr. Pancoast seconded, and upon roll call the motion carried 4-0. 9 10 Having no further business, the meeting adjourned at about 9:35 a.m. 11
