for change in land use is considered to be a PRELIMINARY DEVELOPMENT ORDER. Under the definition of Preliminary Development Order, and consistent with the County's concurrency regulations,
St. Lucie County neither warrants nor represents that there are sufficient public facilities or services available to serve the property on which the change in land use is sought. Further,

general statement describing whether and how the proposed amendment conforms to the St. Lucie County Comprehensive Plan. The St. Lucie Comprehensive Plan, adopted by Ordinance 90-01
in January of 1990 pursuant to the Local Government Comprehensive Planning Act of 1985, and as subsequently amended, lays out the framework for how the County will grow through the planning
period expiring in 2025. This plan includes a number of Goals, Objectives and Policies that are designed to ensure the highest quality living environment possible by providing a mixture
of land uses throughout the County, ensuring a high quality of life, creating a dynamic jobs market and reflecting the needs and desires of the local residents and how they want their
community to develop. At the time of the adoption of this plan, the petitioned property was classified under the Future Land Use Maps of the St. Lucie County Growth Management Policy
Plan (the precursor plan to the current St. Lucie County Comprehensive Plan) as CG (Commercial General). With the adoption of the current Comprehensive Plan in 1990, the same general
land use designation of “commercial” was applied to the petitioned property, except that the specific land use terminology used was adjusted slightly so that the old “CG” designation
was changed to the more general “COM (Commercial)” land use designation. Prior to 1984, the petitioned property was classified as RH (Residential High) under the St. Lucie County Growth
Management Policy Plan. At the time, the RH (Residential High) Future Land Use designation permitted up to 18 units to the acre. The RH designation under the County’s’ current Comprehensive
Plan caps out residential density at 15 units to the acre. In 1984, the Board of County Commissioners approved a change in the Future Land Use designation for the petitioned property
from RH (Residential High) to CG (Commercial General). That petition was initiated by St. Lucie County as part of the Settlement Agreement between the County and the then property owners
Roger Toffolon, for the purpose of addressing a pending lawsuit that the County as involved with at that time. At that time, it was the general consensus of the County Commission, and
the community at large, that this site might be suitable site for some type of local or neighborhood based commercial uses that would serve the then anticipated development densities
in this part of South Hutchinson Island. Since that time, actual development approvals have come in substantially lower than what the maximum Future Land Use densities could permit and
there is no longer a need for this level of commercial development. Attached, as Exhibit C, is a summary market study that assesses the overall need for commercial space on South Hutchinson
Island, and specifically whether the petitioned property is located in an area of the Island that makes it a viable commercial development tract. This requested amendment to the St.
Lucie County Comprehensive Plan is to provide for a change in the Future Land Use designation for a 6.619 acre parcel of land located on South Hutchinson Island, immediately north of
the Normandy Beach Public Beach Access, from COM (Commercial) to RM (Residential Medium). The proposed designation of this property to the RM Future Land Use designation is consistent
with the property owners’ objective of developing this parcel, along with his adjoining lands, into a 108 unit residential development site. The requested Future Land Use designation

accordance with Future Land Use Policy 1.1.5.3 provide the following information: a. Identification [of] future land use designations and existing land uses within ¼ mile of the subject
property that have the same or greater type of proposed future land use designation. Refer to the attached Future Land Use Classification Map (Exhibit F) and General Land Use Map (Exhibit
G) for the area around the petitioned property. The existing Future Land Use designations surrounding this site are; RH (Residential High); RM (Residential Medium); RU (Residential Urban).
b. Is the property under the land use amendment application within the Five Year Capital Improvement Program of the Water and Wastewater Master Plan for St. Lucie County or otherwise
meet the requirements of Policy 1.1.5.4. Utility services (water, sewer and reuse water) are presently available to the site. Water services are provided by the Ft. Pierce Utility Authority.
Wastewater services are to be provided by St. Lucie County and as part of the commitment for those wastewater services, reuse water will be provided back to the site for irrigation purposes

a traffic report of the potential impacts to the County’s transportation system brought about by the proposed land use change. The report must include existing, background, committed
trips, and the projected traffic volumes and the level of service for all affected roadways. Projected traffic volumes must be based on the highest density/intensity allowed under the
requested future land use designation. As discussed at the pre-application conference for this submission (held September 18, 2008), a full Traffic Impact Report has not been prepared
for this amendment petition since the requested change in Future Land Use represents a net decrease in traffic impacts over what the current Future Land Use designation could potentially

petitioned site is located in southern St. Lucie County. The site is bounded on the east by the Atlantic Ocean, on the west by the Indian River Lagoon, on the north by other lands owned
by the petitioner and on the south by the St. Lucie County public Normandy Beach access. The petitioned site is an undeveloped parcel typical of the barrier island system found along
the central and southern Atlantic coast. The property exhibits considerable non-native vegetation such as Brazilian pepper (Schinus terebinthifolius), Australine pine (Casuarina equisetifolia),
beach naupaka (Scaevola taccada). The plant community on the foredune is primarily composed of native grasses such as sea oats (Uniola paniculata) and bitter panicum (Panicum amarum)
and some low shrubs such as nicker bean (Caesalpinia bonduc), seacoast marshelder (Iva imbricata). The uplands, west of the foredune are comprised primarily of sea grape (Coccoloba uvifera),
gumbo limbo (Bursera simaruba), strangler fig (Ficus aurea) and blolly (Guapira discolor). A few clusters of Spanish bayonet (Yucca aloifolia) were also observed on the southern portion
of the property. There are no known wetlands in the petitioned area. There are areas of native habit in the petitioned area. The act of a change in Future Land Use from CG (Commercial
General) to RM (Residential Medium) will not, in and of itself, result in any greater impacts to the property than could be expected under the current Future Land Use designation. As
part of any subsequent development plans for the property, a complete Environmental Impact Report meeting the requirements of the St. Lucie County Development Code will be provided.
During field reconnaissance of the petitioned site, observations were made for the potential presence of listed species and other wildlife. Ghost crabs and their burrows in the foredune
and land crabs and their burrows in the coastal scrub were observed. Common crackle was the only bird species observed in the coastal scrub while various species of shorebirds were observed
foraging along the waterline on the beach. The dune and coastal scrub are potential nesting and foraging habitat for the Florida beach mouse, a state and federally threatened listed
species. Rodents were observed, however, without capture, formal identification is not possible. While no species of concern were directly observed, the table below summarizes the species

requests have been submitted to each expected service provider. As responses are received, the application materials will be updated accordingly. Potable water level of service standards
are not based upon site acreage, but rather the daily consumption of water on a per capita basis. Using the site acreage of 6.619 acres multiplied by the maximum potential number of
units per acre (RM @9 du/ac) results in an expected maximum unit potential of 59.971 units. It should be noted that Policy 11.1.1.15 of the County’s Comprehensive Plan sets the general
Levels of Service standard for potable water service addresses only the county operated water systems. The water service provider to this site will be the Ft. Pierce Utility Authority
(FPUA) and there is no LOS standard outlined in the County Comprehensive Plan for that provider. Applying the County standard to this site, even through the County is is not the retail
provider of potable water to this property, the expected daily water demand will be 13,105.62 gpd.
