amendment to the Official Zoning Atlas of St. Lucie County, state whether the proposed amendment is in conflict with any portions of the LDC: This requested amendment to the St. Lucie
County Zoning Atlas is to provide for a change in zoning for a 6.619 acre parcel of land located on South Hutchinson Island, immediately north of the Normandy Beach Public Beach Access,
from CG (Commercial General) to HIRD (Hutchinson Island Residential District). The proposed designation of this property to the HIRD zoning district is consistent with the restrictions
of Section 3.01.03(aa)(2)(b) of the County’s Land Development Code that limits the options to which properties on Hutchinson Island may be rezoned to. The requested zoning designation
of HIRD (Hutchinson Island Residential District) is consistent with other existing zoning designations found in this area both to the north and the south of the petitioned site (refer
to Exhibit H). This petition for change in zoning is not in conflict with any applicable provision of the St. Lucie County Land Development Code. The intent of the HIRD (Hutchinson Island
Residential District) zoning district is that it be applied to those properties in the unincorporated areas of North and South Hutchinson Island. where the future land use designation
may support the development of multi-family residential projects 2. Please give a statement describing any changed conditions that would justify a rezoning: The St. Lucie Comprehensive
Plan, adopted by Ordinance 90-01 in January of 1990 pursuant to the Local Government Comprehensive Planning Act of 1985, and as subsequently amended, lays out the framework for how the
County will grow through the planning period expiring in 2025. This plan includes a number of Goals, Objectives and Policies that are designed to ensure the highest quality living environment
possible by providing a mixture of land uses throughout the County, ensuring a high quality of life, creating a dynamic jobs market and reflecting the needs and desires of the local
residents and how they want their community to develop. At the time of the adoption of this plan, the petitioned property was classified under the Future Land Use Maps of the St. Lucie
County Growth Management Policy Plan (the precursor plan to the current St. Lucie County Comprehensive Plan) as CG (Commercial General). With the adoption of the current Comprehensive
Plan in 1990, the same general land use designation of “commercial” was applied to the petitioned property, except that the specific land use terminology used was adjusted slightly so
that the old “CG” designation was changed to the more general “COM (Commercial)” land use designation.

change\zoning application book_102809.doc Prior to 1984, the petitioned property was classified as RH (Residential High) under the St. Lucie County Growth Management Policy Plan. At
the time, the RH (Residential High) Future Land Use designation permitted up to 18 units to the acre. The RH designation under the Countys’ current Comprehensive Plan caps out residential
density at 15 units to the acre. In 1984, the Board of County Commissioners approved a change in the Future Land Use designation for the petitioned property from RH (Residential High)
to CG (Commercial General). That petition was initiated by St. Lucie County as part of the Settlement Agreement between the County and the then property owners Roger Toffolon, for the
purpose of addressing a pending lawsuit that the County as involved with at that time. At that time, it was the general consensus of the County Commission, and the community at large,
that this site might be suitable site for some type of local or neighborhood based commercial uses that would serve the then anticipated development densities in this part of South Hutchinson
Island. Since that time, actual development approvals have come in substantially lower than what the maximum Future Land Use densities could permit and there is no longer a need for
this level of commercial development. Attached, as Exhibit C, is a summary market study that assesses the overall need for commercial space on South Hutchinson Island, and specifically
whether the petitioned property is located in an area of the Island that makes it a viable commercial development tract. Utility services (water, sewer and reuse water) are presently
available to the site. Water services are provided by the Ft. Pierce Utility Authority. Wastewater services are to be provided by St. Lucie County and as part of the commitment for those
wastewater services, reuse water will be provided back to the site for irrigation purposes. Refer to the attached Future Land Use Classification Map (Exhibit F) and General Land Use
Map (Exhibit G) for the area around the petitioned property. The existing Future Land Use designations surrounding this site are; RH (Residential High); RM (Residential Medium); RU (Residential
Urban). 3. Please state why there is a need for the proposed rezoning: The requested change in zoning to the HIRD (Hutchinson Island Residential District) district is for the purpose
allowing the petitioned property to be developed for a residential uses. A separate application outlining the specific site plan intentions for this property will be filed following
the rezoning process. 4. Please state whether and how the proposed rezoning is consistent with the St. Lucie County Comprehensive Plan: This requested change to the HIRD (Hutchinson
Island Residential District) zoning district is consistent with the pending application for amendment to the St. Lucie County Comprehensive Plan from COM (Commercial) to RM (Residential
Medium) for the subject parcel. The requested Future Land Use designation of RM (Residential Medium) is consistent with other Future Land Use designations found in this area both to
the north and the south of the petitioned site (refer to Exhibit F ). Land uses in this are predominately residential (refer to Exhibit G). The redesignation of this property to a Residential
Future Land Use Classification would be consistent with other land use designations found in the area.

area predominately residential (refer to Exhibit G). The redesignation of this property to a Residential zoning designation is consistent with other land use/zoning designations in the
area. B) Affects the capacities of public facilities, including but not limited to transportation, sewage, water supply, parks, drainage, schools, solid waste, mass transit, and emergency
medical service; The proposed change in zoning will not have any deleterious effect on the local transportation network, sewage or water supply needs, local parks, local drainage, local
schools, solid waste, mass transit, and emergency medical services. As discussed at the pre-application conference for this submission (held September 18, 2008), a full Traffic Impact
Report has not been prepared for this amendment petition since the requested change in Zoning represents a net decrease in traffic impacts over what the current Future Land Use designation
could potentially allow. The table below provides a brief summary review of the anticipated impacts from this petition for change in Future Land Use: Sands End Development LLC/Land Use

can be seen from the above Table, the requested change in land use results in a net reduction of just over 1,000 trips per day, using the assumed development intensities. Based upon
this brief summary analysis, it

accordingly. **************** Utility services (water, sewer and reuse water) are presently available to the site. Water services are provided by the Ft. Pierce Utility Authority. Wastewater

water level of service standards are not based upon site acreage, but rather the daily consumption of water on a per capita basis. Using the site acreage of 6.619 acres multiplied by
the maximum potential number of units per acre (RM @9 du/ac) results in an expected maximum unit potential of 59.971 units. It should be noted that Policy 11.1.1.15 of the County’s Comprehensive
Plan sets the general Levels of Service standard for potable water service addresses only the county operated water systems. The water service

for that provider. Applying the County standard to this site, even through the County is not the retail provider of potable water to this property, the expected daily water demand will
be 13,105.62 gpd. Service commitment requests have been submitted to each expected service provider. As responses are received, the application materials will be updated accordingly.
**************** The petitioned site may be characterized as mix of beach/dune and coastal strand. Specific stormwater design studies have not been conducted as part of this application
for Preliminary Development Order. As part of any application that may be filed for a Final Development Order, complete drainage reviews will be provided to the County at that time,
as required by Code. The petitioned site does not lie within any designated 298 Drainage District. At the time a Final Development Order is applied for, all applicable storm water management
regulations will be complied with in the final designs for the property. The petitioned property is located within a number of designated Flood Zones according to FEMA FIRM Map 12111C0311-H
dated August 19, 1991. Refer to the attached Exhibit I. **************** As the current site is zoned for commercial use, there are no student generation impacts from the property since
residences are not permitted in the CG (Commercial General) zoning district. The change of this property to the HIRD (Hutchinson Island Residential District) zoning district, a residential
zoning district, will result in the possibility of new student impacts. The Table below represents what “might” be anticipated as the worst case development/impact condition condition
on the local school system should this site be developed at its maximum intensities and should the residential product erected generate the maximum number of projected students. Residential

The redesignation of this site to the HIRD (Hutchinson Island Residential District) zoning district will provide for an increase in potential residential population. Consistent with
Policy 9.1.1.1, of the St. Lucie County Comprehensive Plan, Recreation Element, the following Level of Service for Recreation and Open Space shall be as apply: • Community Parks: 5 acres/1000
Residents in the unincorporated area. • Regional Parks: 5 acres/1000 Residents -County wide. Using the County’s adopted level of service standards, it is assumed that the build out population
of this site (148.9275 persons) will have their community and regional reaction addressed through existing facilities. The petition site is located on South Hutchinson Island. To the
immediate south of the petitioned site is the publicly owned and maintained Normandy Beach Access. There are additional beach access and beach access parks located within one mile of
the site in both a north and south direction. General purpose recreation facilities are found in on the mainland areas of the County. **************** At present there is no Mass Transit
service available to the petition site or the immediate area around it. The County does provide for a demand response transit service that could be of benefit to any future residential
development, should they elect to request use of that service. **************** Emergency Medical Services and Fire Services will be provided to the site by the St. Lucie County Fire
District. District Station Number 7 is located approximately 1.25 miles to the north of the project site. Refer to Section III of this application for status of required Fire Fire District
comments on this application for Preliminary Development Order. C) Affects the natural environment; (If no adverse impacts expected, please state why.) The petitioned site is located
in southern St. Lucie County. The site is bounded on the east by the Atlantic Ocean, on the west by the Indian River Lagoon, on the north by other lands owned by the petitioner and on
the south by the St. Lucie County public Normandy Beach access. The petitioned site is an undeveloped parcel typical of the barrier island system found along the central and

change\zoning application book_102809.doc southern Atlantic coast. The property exhibits considerable non-native vegetation such as Brazilian pepper (Schinus terebinthifolius), Australine
pine (Casuarina equisetifolia), beach naupaka (Scaevola taccada). The plant community on the foredune is primarily composed of native grasses such as sea oats (Uniola paniculata) and
bitter panicum (Panicum amarum) and some low shrubs such as nicker bean (Caesalpinia bonduc), seacoast marshelder (Iva imbricata). The uplands, west of the foredune are comprised primarily
of sea grape (Coccoloba uvifera), gumbo limbo (Bursera simaruba), strangler fig (Ficus aurea) and blolly (Guapira discolor). A few clusters of Spanish bayonet (Yucca aloifolia) were
also observed on the southern portion of the property. The act of a Change in Zoning from CG (Commercial General) to HIRD (Hutchinson Island Residential District) will not, in and of
itself, result in greater impacts to the property than could be expected under properties the current zoning designation. As part of any subsequent development plans for the property,
a complete Environmental Impact Report meeting the requirements of the St. Lucie County Land Development Code will be provided. D) Will result in an orderly and logical development pattern;
This requested Change in Zoning from CG (Commercial General) to HIRD (Hutchinson Island Residential District) is for a 6.619 acre parcel of land located on South Hutchinson Island, immediately
north of the Normandy Beach Public Beach Access. The requested zoning designation of HIRD (Hutchinson Island Residential District) is consistent with other Future Land Use and Zoning
designations found in this area both to the north and the south of the petitioned site (refer to Exhibits F and H). Land uses in this area are predominately residential (refer to Exhibit
G). The redesignation of this property to a Residential zoning category would be consistent with other land use/zoning designations found in the area. E) Will adversely affect the property
values in the area; The requested Change in Zoning from CG (Commercial General) to HIRD (Hutchinson Island Residential District) will not result in nay native effects on the surrounding
property. The petitioned property may have some limited value fluctuations until the site is developed for residential purposes. 6. Please explain the applicant's interest in the subject
property; The applicants for this Change in Zoning from CG (Commercial General) to HIRD (Hutchinson Island Residential District), Sand End Development LLC are the fee simple owners of
the property. 7. Please include such other information or documentation that may be deemed necessary or appropriate to a full and proper consideration and disposition of this particular
