Executive Assistant ANNOUNCEMENTS None BOA Minutes Page 1 of 5 December 8, 2010 40 Agenda Item #1 -Minutes of August 25, 2010 41 Mrs. Andrews motioned approval of the minutes. 42 Mr. Bangert seconded, and the motion carried 5-0. 43 44 Agenda .Item #2 - BA-1020104157 Lozano, Allison 45 Linda Pendarvis, planner presented the petition: 46 47 The petition of Allison Lozano (BA 10201041.57) for a variance from the 48 provisions of section 7.04.01.B of the St. Lucie County land Development 49 Code. 50 51 Mrs. Pendarvis stated that Mrs. Lozano is requesting a variance from the front 52 and side setbacks for a front porch and new roof which has already been 53 constructed. It should be noted that this is a quasi judicial Public Hearing. Proof 54 of advertising for this public hearing can be found i~t the agenda packet with a 55 copy of the legal ad which was .published on November 17, 2010. 'The subject 56 property is in the RS-3 (Residential, Single Family-3 du/ac) Zoning District, which 57 requires a minimum setback of 25 feet from the front property line and 7.5 feet 58 from each side property line. The front porch was constructed without obtaining 59 a building permit and the applicant is attempting to remedy this fact by obtaining 60 an "after the fact" permit. 61 62 The subject property fronts on a private 50 foot access easement. The house on 63 the subject property was constructed in 1956 and has a front setback of 25.5 feet 64 and 7.2 feet prior to the construction of the covered porch. The adjacent parcels 65 were developed approximately around the same time period. The granting of the 66 requested variance is not expected to impair or .injure other property or 67 improvements in the neighbarhoodThe applicant provided letters from adjacent 68 property owners which were included in the packets, supporting the variance. 69 One of the letters provided was signed by Mr. Fagarass, the actual property 70 owner of the 50 fpot access easement which provides frontage to the subject 71 property. The front porch and new roof encroaches up to six feet into the front 72 setback at one point and less than one foot into the west side setback. If the 73 variance is granted the front setback will be 19 feet and the west side setback will 74 be 6.8 feet. Mail notices went out to 30 property owners within 500 feet. The 75 planning division received four response forms: three in favor and one not in 76 favor. The variance sought arises from conditions that. are not unique and 77 peculiar to the land, structures and buildings involved, nor the particular physical 78 surroundings, shape or topographical condition of the property that would result BOA Minutes Page 2 of 5 December 8, 2010 79 in unnecessary hardship. Staff is recommending denial of the requested 80 variance. 81 82 Mrs. Andrews asked when was the property zoned RS-3 and what was it before? 83 Mrs. Pendarvis stated it was zoned RS-3 in 1984 when the county did acounty- 84 wide zoning change and prior to that it was also residential with the same 85 setbacks as they are now. 86 87 Mrs. Andrews stated it looks like it was 6 to the acre because those 6 lots equal 88 an acre with the frontage. 89 90 Mrs. Pendarvis stated she did not know the previous future land use would have 91 allowed on the property. 92 93 Mrs. Andrews asked another question regarding the property record that was 94 provided, under the special features and yard items which is where they normally 95 have the permitted additions; there is an entry that says "site d e v s-f'. Sited e 96 v is presumed to be development. single .family, what does that mean? And it is 97 .from 2001. 98 99 Mrs. Pendarvis stated she believed that'it is saying that is when the property 100 appraisers made their last site visit was 2001 for the single family dwelling on 101 that property. 102 103 Chairman Harris opened the public hearing. 104 105 Mr. and Mrs. Lozano, 3106 Dame Road, Ft. Pierce, FL 34981 were sworn in by 106 the recording secretary. 107 108 Mr. Lozano stated they are scared about the whole situation but they are going to 109 go for it. Before; they use to own a really nice. house and everything started 110 changing for them. As a working man, he tried to figure out a way to provide a 111 house for his family. They saw this property, it was pretty messed up but he told 112 his wife that they could live there; put time into it and fix it up. They did not know 113 all the regulations and codes. They went ahead, and then got cited by the code 114 enforcement. The code enforcement agent said they did it without a permit. 115 116 Mr. Lozano stated they did not know the process; they were just trying to fix the 117 house. It looks terrific 122 and he supports their request. 123 124 Mrs. Andrews stated she dittoed that. 125 126 Chief Emerson and Mr. Bangert did not have any comments or questions. 127 128 Chairman Harris stated they did beautiftl work, he assumed this was 129 owner/builder, did he do it himself. 130 131 Mr. Lozano stated they both did it. 132 133 Chairman Harris asked about the plans that were submitted to the building 134 department, were they drawn by an architect. 135 136 Mr. Lozano stated yes. 137 138 Chairman Harris asked the Lozanos if they had anything else to say. 139 140 Mr. Lozano stated they. just wanted this to be over so that they could go back to 141 their normal life, 142 143 Chairman Harris asked if there was anyone else wishing to speak for or against 144 this petition. 145 146 No one spoke. 147 148 Chairman Harris closed the public hearing. 149 150 Chief Emerson stated he did not see how this was substantially any different 151 than a private gated community coming in requesting a variance when the 152 property owners association has said it is ok. In this case, the owner of the 153 access easement on which the requested variance fronts has said it is ok. 154 155 Chairman Harris concurred with Chief Emerson. 156 BOA Minutes Page 4 of 5 December 8, 2010 157 Chief Emerson made a motion to approve: 158 After considering the testimony presented during the public hearing, 159 including staff comments, and the standards of review as set forth in 160 section 10.01.02 of the St. Lucie Land Development Code, I hereby move 161 that the Board of Adjustment approve the petition of Allison Lozano for a 162 variance from the provisions of section 7.04.Of1(B), of the St. Lucie Land 163 Development Code to allow the continued use of a front porch for a single 164 family residence which will encroach a maximum of six (6) feet into the 165 minimum front setback of 25 feet and a maximum of one (1) foot into the 166 minimum side setback of 7.5 feet in the RS-3 (Residential, single-family - 167 3 DU/AC) zoning district because the variance will not impair any of its 168 neighbors. It is consistent with the surrounding properties and because 169 the property owner of the access easement has said it was ok. 170 171 Mr. Pancoast seconded the motion. SCHEDULED IMPROVEMENTS: None Background The house on the subject property was constructed in 1965. The subject property is in the RE-2 (Residential Estate - 2 du/ac) Zoning District, which requires a minimum setback of 25 feet from the front property line and 10 feet from each side property line. The property owner constructed a swimming pool with pool equipment through Building Permit #0601- 0326, which received Final approval on August 1, 2006. The original survey of the house and backyard before the pool was constructed was completed in 2004 and depicted a shed with attached carport on the property. The shed was noted to be a CBS (concrete block structure) which would have also required a demolition permit to remove. The original shed was located 20 feet from the property line; and the attached carport was nine (9) feet from the property line in 2004. A variance for a one (1) foot encroachment into the side-yard setback would have been required at that time. The pool contractor submitted the pool permit illustrating that the edge of the water of the pool was 33 feet and the screen enclosure was 28 feet from the property line. The pool equipment was to be located at the rear of the existing CBS shed, approximately 20 feet from the property line. Further review of the pool permit resulted in a determination that the pool was properly permitted and the pool equipment was to be properly located 20+ feet from the property line on August 1; 2006. Typically, pool owners may install a small cover over the pool equipment which does not require a building permit. The existing shed to protect the pool equipment located on the property line, was added later and was constructed without obtaining a building permit. The applicant is attempting to remedy this fact by obtaining an "after the fact" permit. The survey that was submitted with the application illustrates that the shed has been built approximately one (1) inch from the property line in the front of the shed and three (3) inches from the property line in the rear of the shed. In addition, the new roof of the shed overhangs and encroaches up to 18 inches into the adjacent property owner's side-yard along the southern property boundary. There is also an orchid shade structure noted on the survey as being located abutting the property line that is also in violation of the side-yard setback. For the record, it should be noted that the house encroaches into the 10 foot side-yard setback along the northern property boundary line by 6 inches. However, since the house was constructed in 1965 it has been determined to be a legal non-conforming structure which cannot be expanded in that area. Further, the property owner was also cited as being in violation of Section 7.04.01 (B) of the LDC on the basis that the shed structure is abutting the fence and does not meet the ten (10) foot setback requirement for side-yards in the RE-2 Zoning District. There is also a shade structure located on the property line to the east of the shed that is abutting the fence. Additionally, the property owner was also cited as being in violation of Section 7.07.08 of the LDC due to the roof overhang of the shed causing drainage onto the neighboring property to the south which was determined to be a failure to maintain the proper drainage system. The property owner was given until September 9, 2010 to remedy the situation. Therefore, the property owner applied for this variance request on January 5, 2011. Although Section 7.04.01(B) permits the encroachment of an unsupported roof overhang up to thirty (30) inches within any required yard setback, this roof overhangs approximately 18 inches across the property line. If the applicant is not granted this variance, the new pool equipment shed would have to be cut down, rebuilt, or demolished to meet these provisions of the LDC and the pool equipment would be subject to the elements of possible inclement weather. Removal of the shed would likely resolve the issue of improper drainage onto the neighboring property. Relocation of the pool equipment, and the shed housing the equipment, to another location on the property which meets the required setbacks would be the optimum course of action to relieve the encroachment; protect the property rights of the property owner to the south; and ultimately bring the property into compliance with the St. Lucie Land Development Code. STANDARDS OF REVIEW AS SET FORTH IN SECTION 10.01.02, ST. LUCIE COUNTY LAND DEVELOPMENT CODE In reviewing this application for a Variance to the St. Lucie County Land Development Code, "The Board of Adjustment shall not grant a variance unless it shall, in each case, Petition: Paul & Laura Struve File No.: BA-120114219 February 23, 2011 make specific findings of fact based directly upon the particular evidence presented supporting written conclusions that:" 1. The variance requested arises from conditions that are unique and peculiar to the land, structures, and buildings involved; that the particular physical surroundings, the shape, or topographical condition of the specific property involved would result in unnecessary hardship for the owner, lessee, or occupant, as distinguished from a mere inconvenience, if the provisions of the Code are literally enforced; that it is a condition that is not ordinarily found in the same zoning district, and the condition is created by the regulations of this Code, and not by an action or actions of the property owner or the applicant. The variance sought arises from conditions that are not unique and peculiar to the land, structures, and buildings involved; nor the particular physical surroundings, shape, or topographical condition of the property that would result in unnecessary hardship. The conditions that require the variance were not created by the regulations of the Land Development Code, but by the placement of the pool equipment shed too close to the side property line with encroachment into the setback and overhanging into the neighbor's property to the south. The need for the requested variance to allow the continued use of the pool equipment shed, and a shade structure, is solely the result of actions of the property owner. 2. The granting of the variance will not impair or injure other property or improvements in the neighborhood in which the subject property is located, nor impair an adequate supply of light or air to adjacent property, substantially increase the congestion in the public streets, increase the danger of fire, create a hazard to air navigation, endanger the public safety, or substantially diminish or impair property values within the neighborhood. The granting of the requested variance is not expected to impair or injure other property or improvements in the overall general neighborhood. The underlying concrete pad supporting the pool equipment is approximately 10 feet by 4 feet and is located behind the single family residence. It is not visible from Indian River Drive. Therefore, the property will not impair an adequate supply of light and/or air to the public streets, increase the danger of fire, create a hazard to air navigation, endanger the public safety, or substantially diminish or impair property values within the neighborhood as a whole. Granting the variance for the continued use of the shed in its present location will, by the nature of the manner in which it was constructed with an overhang into the neighbor's yard to the south, create a negative impact on the property to the south if it is not modified. The placement of the shed abutting the property line is causing drainage onto the neighboring property to the south which was determined to be a failure to maintain the proper drainage system on the subject parcel. Granting said Petition: Paul & Laura Struve File No.: BA-120114219 February 23, 2011 variance will not resolve the drainage problem created by the overhang of the roof of the shed. Further, the orchid shade structure shown on the survey is abutting the property line and needs to be repositioned so that it meets the side-yard setback or relocated elsewhere on the site. 3. The variance granted is the minimum variance that will make possible the reasonable use of the land, building, or structures. The requested variance is the minimum needed to allow for the continued use of the pool equipment shed, and the shade structure; and to allow the applicant to apply for a building permit without altering the, already constructed shed and shade structure. However, the requested variance is equal to 100% of the required side yard setback and still would not resolve the drainage problem created by the shed on the neighboring parcel to the south. 4. The variance desired will not be opposed to the general spirit and intent of this Code or the St. Lucie County Comprehensive Plan. The subject property has a Future Land Use Classification of RS (Residential Suburban- 2 du/acre) which provides for residential development as the primary use. Objective 1.1.8 of the St. Lucie County Comprehensive Plan establishes that the investment owners make in residential property, and their quality of life in single family neighborhoods, shall be protected from the encroachment of commercial and/or other inappropriate land uses through consistent and predictable applications of the LDC. That is the basis of the Building and Code Regulation Division's Notice of Violation, to protect the property rights of the adjacent property owner to the south through the consistent application and implementation of the LDC requirements. The requested variance is not consistent with the intent of the St. Lucie County Land Development Code and the specific provisions of this section. The applicant is requesting the variance from the requirements of the side setback in order to support an already constructed shed to house pool equipment, and maintain a shade structure in its present location. The applicant has stated that it would be very costly to relocate the pool equipment and the shed is necessary to provide protection from inclement weather for the equipment. The shade structure can be repositioned to meet the set-back or located elsewhere on the site. The requested variance as proposed is not consistent with the Goals, Policies, and Objectives of the Comprehensive Plan. Recommendation Staff has reviewed this petition and determined that it may not necessarily be in conflict with the Goals, Objectives, and Policies of the St. Lucie County Comprehensive Plan if the applicant is willing continue this public hearing to a date certain, to allow enough time to modify or remove the structure.
